I have scheduled a meeting with the Weld County Planning Commission for April 2, 1996, at 1:30 p.m. This meeting will take place in the County Commissioners' Hearing Room, First Floor, Weld County Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you and/or a representative be in attendance to answer any questions the Planning Commission members may have. It is the policy of Weld County to refer an application to any town or municipality lying within three miles of the property or if the property is located within the comprehensive planning area of a town or municipality. Therefore, our office has forwarded a copy of the submitted materials to the Town of Mead Planning Commission for its review and comments. Please call Kelly Smith, in Mead, at(303) 535-4477, for further details regarding the date,time,and place of this meeting. It is recommended that you and/or a representative be in attendance at the Planning Commission meeting to answer any questions the Commission members may have with respect to your application. A representative from the Department of Planning Services will be out to the property a minimum of ten days prior to the hearing to post a sign adjacent to and visible from a publicly maintained road right-of-way which identifies the hearing time, date, and location. As this property was originally zoned agricultural, I find no problem with this planned land use. One thing to keep in mind when constructing a home in this area is that the surficial material is composed of loess, which has a tendency to consolidate when wet. At least one subsurface soil sample should be collected from the building envelope and tested for consolidation and swell potential. The foundation design should incorporate thetest results to help prevent post-construction damage due to settling or swelling. Also, some shallow water-bearing alluvial gravels occur in the area that may pose a subsurface drainage problem to basements. Therefore, if subgradc construction is intended, it would be wise to dig a test pit or drill a test hole to the proposed foundation depth to evaluate the groundwater situation. If shallow groundwater is present,foundation drains should be installed. The submitted materials are in compliance with the application requirements of Section 21.7 of the Weld County Zoning Ordinance, as amended. 2. The submitted materials are in compliance with Section 21.5 of the Weld County Zoning Ordinance, as amended, as follows: A. The proposed change of zone is consistent with the intent of the Weld County Comprehensive Plan, as amended, Agricultural goals and policies. In 1987 the property was zoned PUD to allow for a Cryogenic Research Facility. This Facility was only developed on the property located directly north of the subject property. The subject property is currently in agricultural production. Staff feels that the change of zone to agricultural is consistent with the Agricultural Goals and Policies as stated in the Weld County Comprehensive Plan, as amended. B. The use allowed on the subject property by granting the Change of Zone will be compatible with the existing surrounding land uses which are predominately agricultural in nature. C. Adequate water and sewer service can be provided to this property. Water service can be provided by Little Thompson Water District and sewer can be provided by septic systems. D. Existing Weld County Road 7 provides access to the property which is adequate to meet the requirements of the uses which would be allowed in the Agricultural Zone District. E. The proposed rezoning will not interfere with the present or future extraction of commercial mineral deposits located on or under the property. Mineral resource development is a use allowed by Special Review in the Agricultural Zone District. G. The soil conditions on the site are such that they do not present moderate or sever limitations to construction of structures or facilities proposed for the site. This recommendation is based, on part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. The Department of Planning Services' staff recommendation for approval is conditional upon the following: 1. The applicant shall submit a new plat map meeting the criteria for application requirements as stated in Section 21.7.2 of the Weld County Zoning Ordinance, as amended. 2.
