FOR SNOW REMOVAL PROJECT R -AD 300 (1)
BE IT RESOLVED, by the Board of County Commissioners of Weld County,
Colorado, that the agreement with Warren Air Force Base for extraordinary snow
removal, a copy of which is attached and made a part of this resolution, be
and is hereby approved and signed.
The above and foregoing resolution was, on motion duly made and
seconded, adopted by the following vote:

AGREEMENT FOR EXTRAORDINARY SNOW REMOVAL
ON DEFENSE ACCESS ROADS SERVING THE WARREN
AIR FORCE BASE MINUTEMAN MISSILE SITES
IN COLORADO UNDER PROJECT R -AD 300(1)
This AGREEMENT is made and entered into by and between Weld County.
State of Colorado, hereinafter referred to as "Weld County," and the
United States Department of Commerce, Bureau of Public Roads, hereinafter
referred to as "Public Roads."
RECITALS
WHEREAS, pursuant to the provisions of Section 210 of Title 23, United
States Code, and authority delegated by the Secretary of Commerce, Public
Roads is authorised to provide for the maintenance of Defense Access !toads;
WHEREAS, the Acting Chief of Transportation of the Department of Defense,
acting pursuant to authority delegated by the Secretary of Defense, has
certified that it is important to the National Defense to provide for
extraordinary snow removal under the conditions herein set forth on the
Defense Access Roads hereinafter described and has requested that Public
Roads take appropriate action to provide for such extraordinary snow
removal out of funds transferred to Public Roads by the Department of the
Air Force; and
WHEREAS, Weld County is willing to cooperate in the interest of National
Defense by performing the extraordinary snow removal work herein specified
under conditions that will result in neither a profit nor a loss to Weld
County.
NOW, THEREFORE, the parties hereby agree as follows:
1. As used herein, unless the context indicates otherwise;
a. The term "Defense Access Roads" means those public highways
shown on the attached reap that are located in Weld County. These roads
were constructed under Colorado Access Road Project R -AD 36(1), completed
in 1964. The designated roads as shown on the attached map are described
as follows:
(1) Access road numbers I through 10, 12 through 23 and roads
27 and 28.
(2) The above roads are located between RS6W to R60W and from
T7N to '1'12N at the Nebraska State line.
h, '.'lto term "extraordinary snow removal" means that Weld County
will, upon notification by the agents of the United States Air Force,
react within two (2) hours to commencing placing snow removal equipment
in condition to remove snow from those access roads hereinbefore
designated in this Agreement, which snow removal is over and above that

ordinarily performed by Weld County for the class of road involved. Weld
County will then endeavor to the best of its ability to remove snow and
snow drifts from access roads to control centers and inoperative sites
as rapidly as possible. Denial of access to launch control centers or
to any inoperative launching site should not exceed twenty-four (24)
hours for any reason and that periods longer than twenty-four (24) hours
are operationally unacceptable to the National Defense.
2. Weld County agrees to perform the extraordinary snow removal on the
Defense Access Roads hereinbefore described in this Agreement, and
designated on the map attached to this agreement, when notified by one
of the following named authorised agents representing the Civil Engineer
of Warren Air Force Bass, Cheyenne, Wyoming:

In the event of transfer or replacement of any of the above named
personnel, Weld County will receive written notice forthwith, naming
the replacement.

3. a. In order to insure that equipment will be available at all times
for extraordinary snow removal, Weld County will purchase the following
equipment with funds made available under the terms of this Agreement,
and will keep it in proper operating condition and available for
extraordinary snow removal use:
One (1) 25,000 pound G.V.W. Truck with angle blade.
Six (6) two-way radio units for installation in the above truck
and in existing snow removal equipment presently used and housed in the
area hereinbefore described in section 1 of this Agreement.
One (i) Central transmitter -receiver station suitable and adequate
to maintain communication with the above two-way radio mobile field units.
b. Subject to prior authorization to advertise for bids and
concurrence in award of contracts for the new equipment, as itemised in
section 3.a above, Public Roads agrees to reimburse Weld County, out of
funds made available by the Department of Defense, for the actual costa
of the above equipment in the ratio and amount as listed below:
(1) One (1) 25,000 pound G.V.W. Truck with angle blade to be
reimbursed at 1OO percent of bid cost up to a maximum amount of $8,000.
(2) Six (6) two-way radio units and one (1) central transmitter -
receiver station to be reimbursed at 25 percent of bid cost up to a
maximum amount of $3,000.
c. It is further agreed that Weld County will provide for all
expenses necessary for operating and maintaining the *hove equipment
while in use for extraordinary snow removal in the herein defined access
roads. Such costs and expenses shall include all operator and labor
costs, fuel, repairs, depreciation, storage of equipment and any other
maintenance costs incurred.
4. Weld County, as a condition to the payment for equipment itemized
in section 3.b of this Agreement, agrees to provide extraordinary snow
removal as hereinbefore defined in section 1 of the Agreement for the
fiscal years 1965, 1966, 1967, 1968, 19b9, 1970 and 1971, subject to
the availability of funds therefor.
5. It is agreed that the equipment itemised in section 3.b of this
Agreement, when purchased, will become the sole property of Weld County
and will be used as necessary for extraordinary snow removal on the
Defense Access Roads set forth herein, or for snow removal on other
roads for which Weld County is responsible. Should this agreement be
terminated prior to the end of Fiscal year 1971, the Department of
Defense shall receive a salvage credit based on the following formula:

Where: A equals the 7 fiscal years noted in section r+ of this
Agreement;
B equals the fiscal years the equipment was used;
P equals the amount of funds authorized in section 3.b of
this Agreement.
6. It is further agreed that, with respect to any Federal activities
and Federal property within the affected area, nothing contained herein
will be construed as holding Weld County liable for any personal damage
or personal liability injury to any person or thing while removing snow
or snow drifts from the hereinbefore described Defense Access Roads.
7. It is further agreed that, except for any willful breach of this
Agreement by Weld County, Public Roads shall hold harmless Weld County
from any and all claims by its agents, contractors or subcontractors,
or any persons by Public Roads employed or under agreement with said
Public Roads, by reason of any failure of Weld County to fulfill this
Agreement.
S. Due to the uncertainties involved with the problem of extraordinary
snow removal, it is further agreed that this Agreement will be subject
to renegotiation on an annual basis, if so requested by either party
to the Agreement.

This is to inform you that on June 3, 1964, the Colorado
Department of Highways accepted the construction on Phase 5,
roads 27 and 28, of the 1963 season and on June 18, 1964,
accepted construction on Phase 2, road 23, of the 1964
season. The above roads were completed in substantial
conformity with the plans and specifications for the
subject project.
Maintenance of these completed roads will again become the
responsibility of Weld County, as stated in our maintenance
agreement, dated r.pril 3, 1963, and our letter to you,
dated .s.ugust 22, 1963.
