HomeMy WebLinkAbout991118.tiff RESOLUTION RE: POLICY REGARDING SMOKING IN BUILDINGS AND VEHICLES UNDER THE CONTROL OF WELD COUNTY, INCLUDING AREAS OUTSIDE OF SUCH BUILDINGS WITHIN FIFTY (50) FEET OF ENTRANCES THERETO WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, pursuant to Sections 30-11-107(1)(a) and 30-35-201(12) C. R. S., and Section 3-8(4)(1) of the Weld County Home Rule Charter, the Board of County Commissioners has the authority on behalf of Weld County to own and control real and personal property, including the establishment of reasonable rules regarding their use, and WHEREAS, by Resolution of the Board of County Commissioners dated May 9, 1988, the Board prohibited smoking in all buildings and vehicles under the control of Weld County, Colorado, by and through the Board of County Commissioners of Weld County, effective July 1, 1988, including, but not limited to, the Weld County Courthouse, and WHEREAS, although compliance with the prohibition has been substantial, if not complete, since July 1, 1988, smokers have congregated outside buildings in front of entrances in order to smoke, thereby subjecting persons entering the buildings to second-hand smoke, and WHEREAS, the Board of County Commissioners has, after careful consideration, deemed it advisable to reiterate such prohibition and to extend it to those areas outside buildings controlled by Weld County, within fifty (50) feet of any entrances thereto. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that smoking is prohibited in all buildings and vehicles under the control of Weld County, by and through the Board of County Commissioners of Weld County, and in the areas outside such buildings within fifty (50) feet of any entrances thereto. Signs shall be posted in all buildings and vehicles, and at the entrances to all buildings, which shall notify employees and visitors of the policies stated herein. BE IT FURTHER RESOLVED by the Board that employees of Weld County found to be in violation of the policies stated herein shall be subject to disciplinary actions as stated in the Weld County Personnel Policies Handbook, Weld County Ordinance 118, as amended. Any visitors found to be in violation of the policies stated herein shall be notified of such violation and asked to extinguish their smoking materials or to smoke outside of the fifty (50) foot area. Attached is the information sent to me by Sheri. Even though this information was not presented at the time the Board considered the resolution, I believe it can be considered as back up because the action taken by the Board on June 2, 1999, was legislative in nature, rather than quasi-judicial. Background information for the County's policy regarding smoking in buildings and vehicles under the control of Weld County, including areas outside of such building wihtin fifty feet of entrances thereto. 1. Smoking in county facilities- Larimer County (see attached) 2. Letter of support from Libby Conway, RN of the Health Department 3. Jefferson County Department of Public Health and Environment's Tobacco-Free Campus Planning Committee; summary of process, summary of work, recommendations and for our customers. (see attached) 4. North Colorado Medical Center wouldn't share a copy of their policy. But the policy states no smoking by hospital entrances. Signs read: "No smoking by this entrance. Employee smoke in designated areas only. Please inquire at front desk regarding smoking locations of designated areas". 5. Greeley Medical Center: Employees allowed to smoke only in designated "shack" in the back of the center. No signs are posted outside the facility, but there is a cigarette butt urn at the main entrance. They state they usually don't have any violators, however littering of the cigarette butts have been a problem. 6. Colorado Department of Public Health and Environment (CDPHE)- has a smoke free campus. The executive office okayed it, but they need to get approval from the leasing company. CDPHE has signs posted in parking lot and at doors stating smoke-free campus. Employees are notified in writing and it is enforced through CDPHE policy rules. 7. Youth Coalition Against Tobacco and Smoking (YCATS) are part of the Tobacco-Free Weld County Project testified of the importance of passing a smoking resolution by county entrances. 8. Dr. Kathleen Zavela, a professor of the University of Northern Colorado's department of Community Health and Nutrition spoke in support of passing the County's Smoking Resolution. CONTACT: Facilities Manager PURPOSE: To ensure the safety and health of patrons and employees and to achieve a uniform smoking policy throughout Larimer County facilities. POLICY: 1. No person shall smoke or carry a lighted smoking instrument in Larimer County facilities. This includes facilities owned and operated by Larimer County as well as those offices and other spaces leased and operated by Larimer County activities; 2- No smoking shall be allowed adjacent to the entrances to any county building. 3. The No Smoking Resolution will convey to the public that the Weld County Government is committed to protecting the health of its residents and employees. It also will make it much more inconvenient to smoke, which may serve as motivation for some people to quit. I'm proud to be work:'ing at an agency that is involved in educating the public on various health issues, and as an agency, we should serve as an example to the people we serve by not allowing people to smoke near our building. Tobacco-Free Campus Planning Committee Summary of Process In the spring of 1997 Dr. Johnson requested that a committee be formed of staff to invesitgate the barriers to and interest in JCDHE going smoke-free on its grounds; his request was prompted by several factors, such as an interest in the health department modeling healthy behaviors, as well as by a complaint by a customer about having to walk through smoke to get into the building. People volunteered 10 serve on the committee.Employees who participated in the committee include: short-term participation Christine Aloia(HPLM; WIC program) Karen Callahan(HPLM; Substance Abuse Counseling Program) Paula Moffel.(CHS; KIND dental clinic) long-term participants Pam Bell (CHS; International Travel Clinic) Jeanne Erly (CHS; supervisor) Jonathan Heitsmish(HPLM; Substance Abuse Counseling Program) Maureen Kloser(CHS; Community Health Nursing) Cheryl Price (HPLM; WIC) Donna Viverette (HPLM; supervisor) Two committee members researchd if/which health agencies have gone tobacco-free on their grounds and, if they were successful, how they did it (examples: CDPHE, Lutheran) In June/July of 1997, the committee piloted a questionnare with staff and clients asking their opinions about the idea and impact of going smoke-free on campus grounds. Once feedback about the questionnaire was given, the questionnaire was improved and implemented in August, 1997 155 clients were surveyed in all sites -51 (33%) were current tobacco users -overall, 95 out of 155 (61%) of clients responding said that tobacco use should be banned on the campus grounds -27 of the 51 (53%) tobacco using clients said that tobacco use should be banned on the campus grounds 109 employees were surveyed in the Lakewood, Edgewater, Arvada and Golden (admin) sites -at that time, 10 (9%) were people who used tobacco -54 out of the 109 (50%) indicated that tobacco use should be banned on campus grounds -33/72 (46%) of LW employees responding stated tobacco use should NOT be banned on campus grounds -9/17 (.53%) of Arvada employees responding stated tobacco use should NOT be banned on campus grounds -9/16 (.56%) of Golden employees responding stated tobacco use should NOT be banned on campus grounds -3/3 (100%) of Edgewater employees responding stated tobacco use SHOULD BE banned on campus grounds Using the feedback from clients and staff, the planning committee began shaping the guiding principles of their planning work (see below), in order to attempt the fairest solution 1. the first priority of JCDHE regarding tobacco use on agency grounds is to communicate a strong and clear position against tobacco use 2. any policy/procedure addressing tobacco use should communicate JCDHE's position, and be implementable,reasonable and equitable for clients and staff of JCDHE, wherever possible 3. implementation and enforcement of the policy should uphold the dignity of our customers and our agency. In November, 1997 the planning committee recommended that the campus grounds become tobacco-free starting January 1889. Dr Johnson took this recomendation to the County's attorney and to the Board of Health for approval. In July of 1998 Dr. Johnson indicated that the Boardd of Heatlh had approved the proposal and that plans for implementing could proceed In August of 1998 an updated draft of the proposal was submitted to and approved by Dr. Johnson. In early November, signs were installed at the 4 main sites to alert our constituents and staff about the plan for the campuses going tobacco-free on November 19, 1998. Summary of Tobacco-Free Campus Planning Committee Work August 27, 1997 At the meeting held on August 21 we reviewed the results of the surveys conducted with clients and staff. After a thorough discussion of the various options for limiting tobacco use on our campuses, we identified the following critical issues: 1. We feel the first priority of JCDHE is to communicate a strong and clear position against tobacco use 2. Any policy addressing tobacco use should communicate JCDHE's position, and be implementable, reasonable, and as fair as possible to all affected 3. Implementation and enforcement of the policy should uphold the dignity of our customers and our agency 4. The planning committee should be in full agreement about and willing to stand behind the recommendations we make regarding the limitation of tobacco use on our campuses With these issues in mind, the committee has made a preliminary decision on the following: -that tobacco use should be banned on all areas considered to be the "campus,"(also called "grounds" or"property") in and around the buildings in which the health department conducts major services in Lakewood, Arvada, Edgewater, and Golden (Admin) - these areas should be interpreted to include areas outside buildings, such as the parking lots and areas from buildings to streets and/or obvious other boundaries for the Lakewood, Arvada and Golden sites; campus for the Edgewater site should be interpreted as the areas near the entrances and exits of the building along the sidewalks. In order to make a recommendation to Dr. Johnson that tobacco use be banned on the campuses identified above the committee will be considering the following three issues: (please respond to the following and return responses to Donna by the next meeting- 1:30 Thursday, September 11 in Arvada) A)How to communicate the policy to the community we serve -what kind of signage will be needed to let employees and clients know of the policy - and where should the signage be posted? -what other forms of communication is needed (public service announcement in the local papers; memo to staff; notices of the plan for the campuses to go tobacco-free posted at the various sites, etc.)? -what should the notices, signs, etc., say that would communicate our strong committment to health and against tobacco use, while upholding the dignity of employees and clients who use tobacco? (Please give examples) B) How should adherence to the policy be monitored/enforced? (Please consider survey responses as well as conversations that the committee has had regarding this issue) C) What should be done if a client violates the policy; what should be done if an. employee violates the policy? (Please consider survey responses as well as conversations that the committee has had regarding this issue) The committee will discuss and decide about these items at the September 11 meeting. Recommendations from the Tobacco-Free Campus Planning Committee Revised July 13, 1998 Participating TFCPC Members: Pam Bell, Jeanne Erly, Jonathan Heitsmith, Maureen Kloser, Cheryl Price, and Donna Viverette The Tobacco-Free Campus Planning Committee (TFCPC) has re-visted its assessment of the issues related to restriction of tobacco use on the grounds/property of JCDHE service sites and is in agreement about and willing to stand behind the following recommendations regarding tobacco use on our campuses. Based on discussions and surveys conducted with JCDHE staff and customers, the TFCPC is recommending that: -all tobacco use be banned in all areas considered to be the "campus," of JCDHE (also called "grounds" or "property") in and around the buildings in Lakewood, Arvada, Edgewater, and Golden(Admin) -these areas should be interpreted to include areas outside buildings, such as the parking lots and areas from buildings to streets and/or obvious other boundaries for the Lakewood, Arvada and Golden sites; campus for the Edgewater site should be interpreted as the areas near the entrances and exits of the building along the sidewalks -and that employees of JCDHE working at the Mountain Resource Center, the Golden Family Resource Center, and the KIND office at Warren Tech abide by the policy of no tobacco use on the grounds of these sites -Dr. Johnson communicates this policy to the appropriate administrative staffs of the Mountain Resource Center, the Golden Family Resource Center, and the KIND office at Warren Tech in order to support JCDHE staff working in these facilities and to encourage similar policy development and enforcement at these sites -the following guiding principles be used with the implementation of all policies/procedures regarding tobacco use on our campuses: 1. the first priority of JCDHE regarding tobacco use on agency grounds is to communicate a strong and clear position against tobacco use 2. any policy/procedure addressing tobacco use should communicate JCDHE's position, and be implementable, reasonable and equitable for clients and staff of JCDHE, wherever possible 3. implementation and enforcement of the policy should uphold the dignity of our customers and our agency. If,during regular patrolling of grounds, a security guard sees anyone using tobacco products,the guard should inform the tobacco-using individual of the policy and request that the tobacco products be put out/away 2.If a staff member sees anyone using tobacco products on the grounds he/she should be encouraged to approach individual and inform the individual of the policy and the need to put tobacco products out/away enforcing the policy 1.Legal counsel should be sought regarding limitations to addressing clients' refusal to stop using tobacco products in accordance with the policy; once legal counsel is consulted,a protocol should be drafted and staff should be informed of how to address clients' refusals to honor the policy policy given to everyone 2. If an employee of JCDHE encounters another employee using tobacco which addresses how products on the grounds,the first employee should remind the other employee of violations are handled the policy 4. A procedure for addressing employee tobacco-use policy violations should be drafted and shared with all employees 5.
