RE: AUTHORIZATION FOR SALE OF WELD COUNTY TAX CERTIFICATE TO 1-76
CORPORATION
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Arthur L. Willis, II, Weld County Treasurer, has requested authorization to
sell Weld County Tax Certificate #90-01371/91, a copy of said certificate being attached hereto
and incorporated herein by reference, to John S. Kemp, Trustee, 1-76 Corporation, for the
amount of $10.00, and
WHEREAS, the Board of County Commissioners deems it advisable to sell said
certificate as requested by the Weld County Treasurer.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Arthur L. Willis, II, Weld County Treasurer, be, and hereby is,
authorized to sell Weld County Tax Certificate #90-01371/91 to John S. Kemp, Trustee, 1-76
Corporation, for the amount of $10.00.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 12th day of May, A.D., 1997.

RE: I-76 Corp - Taxes on Improvements
The attached information concerns the taxes on a now non-existent gas station along side I-76
near Keenesburg. The structures were taxed separately and went to tax sale in 1990. The taxes
were struck off to the County and the County did not take Title because of the liability for clean-
up. The gas station is abandoned and had underground storage tank problems. The Trustee for
the land owner, Mr. John (Jack) Kemp demolished the 20' x 40' building and abated the three
storage tanks in accordance with state requirements. Apparently the property will now be
redeveloped.
The problem facing the Treasurer is that the improvements securing the taxes no longer exist and
were removed for good cause, at least in the case of the tanks. Real property taxes cannot be
struck off as uncollectible as can personal property tax, so the best way to clear this account is to
sell the County held tax certificate to the property owner for $10.00. This would have the effect
of abating $5,776.82 worth of taxes. I do not have other viable alternatives. The question is
should the Board consider selling the Certificate for $10.00 to Mr. Kemp as Trustee.

THIS DEED is made by John S. Kemp as Personal Representative
of the Estate of Frank C. Mann, deceased, Grantor, to John S. Kemp us
trustee of the Pollyanna F. Mann Marital Trust, as to an undivided 41.226%
interest; to John S. Kemp, as trustee of the francea Kelley Trust, as to
an undivided 29.387% interest, and to John S. Kemp as trustee of the
Charlene Groves Trust, as to an undivided 29.387% interest, Grantees.
All of these trusts are created by the Will of Frank C. Mann, described
below. The address of John S. Kemp is 11610 Brighton Road, Henderson,
Colorado 80640.
WHEREAS, the abcve-named decedent in his lifetime mad,. and
executed his Last Will and Testament dated November 15, 1978, which
Will was duly admitted to informal probate on December 29, 1983, by
the District Court in and for the County of Adams, and State of Colo-
rado, Probate No. 83 -PR -382;
WHEREAS, Grantor was duly appointed Personal Representative
of said Estate on December 29, 1983, and is now qualified and acting in
said capacity.
NOW, THEREFORE, pursuant to the powers conferred upon Grantor
by the Colorado Probate Code, Grantor does hereby cell, convey, assign,
