ROLL CALL: The meeting was called to order by President Judy Curtis. Vice President Dan Oster, Councilman Ralph Campbell, Councilwoman Pam Malcom, and Councilman Al Roberts were present, constituting a quorum of the members. Also present: Stan Sessions, Dwaine Kurtz, Jim Gardner, Rob Masden, and the Council secretary, Bev Thomas. APPROVAL OF DOCUMENTATION: Approval of Meeting Minutes Councilwoman Pam Malcom made a motion to approve the October 20, 1998 meeting minutes. Councilman Dan Oster seconded the motion and it was approved unanimously. Signing of Salary Resolutions and Third Quarter Report to the People Council members signed Weld County Council Resolutions 119, 120, and 121 and the 1998 Third Quarter Report to the People. ADDITIONS TO THE AGENDA: Councilman Dan Oster asked the Council to consider the Council's January 1999 meeting date due to a potential conflict with his schedule. Councilman Roberts made a motion that the Weld County Council's January 1999 Council meeting be January 5, 1999, 6:30 p.m. at the Weld County Centennial Center, 915 10th St., Greeley, CO. Councilman Dan Oster seconded the motion and it carried. CORRESPONDENCE: The Council reviewed the correspondence. UNFINISHED BUSINESS: Social Services Grievance Board President Judy Curtis asked about the status of the Social Services Grievance Board. She said that she would check who had been appointed to the Grievance Board.Letter to Councilman Dan Oster made a motion that ate o that ttheCo Council rney l l send the letter composed during the meeting to the State Attorney General's office. Councilman Roberts seconded the motion and it carried. 411147-4130 982575 Weld County Council Minutes November 17, 1998 Page 2 of 3 Potential Conflict of Interest Letter from Commissioner Harbert Councilwoman Pam Malcom made a motion that Weld County Council's Resolution 122 be adopted as stated. Councilman Dan Oster seconded the motion and it carried. NEW BUSINESS: Payment of the Bills Councilman Dan Oster made a motion to pay the following bills: Mileage for Councilman Ralph Campbell $11.88 Mileage for President Judy Curtis $23.22 Mileage for Vice President Dan Oster $ 7.56 Mileage for Councilman Al Roberts $59.40 Copies by Al Roberts $21.62 Windsor Beacon Subscription Invoice $19.95 Councilman Roberts seconded the motion and it carried unanimously. COORDINATOR REPORTS: Midtown Materials Councilman Roberts reported that as of November 17 Midtown Materials continues to be in violation of planning ordinances within Weld County's MUD. It appears that this business will have to be processed through the Planning Commission regarding its many planning violations. Councilman Roberts will continue to monitor this situation. Councilman Campbell suggested that Councilman Roberts report the status of Midtown Materials to the citizens that had brought the concern to the Weld County Council. Election Petition Concerns The Council reviewed a letter dated November 17, 1998 from County Attorney Bruce Barker regarding the circulation of Weld County Council candidate petitions by Weld County Commissioners. Mr. Roberts presented a detailed accounting of the errors on election petitions filed by applicants for the Weld County Council. These petitions had been reviewed by Mr. Roberts, County Attorney Bruce Barker, and Elections Department employee Ms. Kathy Seiler. The check lists that the petition checkers use and the petition form itself have not been reviewed and updated since 1988. Mr. Roberts is going to ask for the written check list that petition checkers use. Kathy Seiler is looking into the matter of ditto marks being accepted on petitions. Jim Gardner requested that there be consistency in checking of petitions by the Election Department. The County Clerk/Recorder receives Colorado Revised Statutes updates from the state regarding petition laws and regulations. Mr. Bruce Barker will be examining these in Weld County Council Minutes November 17, 1998 Page 3 of 3 Weld County after the Spring 1998 State Legislature Session. Mr. Barker will then update Weld County election petition procedures. Mr. Roberts hopes to work with Mr. Barker to improve the instructions to the Weld County Council petitioners. Council members and citizens at the meeting agreed the present instructions to petitioners are vague. Question Regarding Money Lost by Weld County Councilman Al Roberts reported that the Weld County Council had done an extensive review at the time of the $4.5 million Weld County lost in an investment scam approximately ten years ago. He also noted that more than half of the money had been recovered by Weld County. Cost of Printed Information from Weld County Clerk to the Board Commissioner Baxter and Clerk to the Board staff assured Councilman Roberts that no special status was given to The Greeley Tribune in obtaining copies. Mr. Roberts was told that on occasion perhaps one copy would be given out without charge. Copies can always be reviewed cost-free under supervision of Weld County personnel. County Attorney Bruce Barker will be reissuing the Commissioners' guidelines of costs to the public for copies received from Weld County. NEW BUSINESS: Honoring of Retiring Weld County Council Members Councilman Dan Oster made a motion to empower the Council secretary, Bev Thomas, to purchase and prepare the appropriate plaques, memorabilia, and resolutions to honor the retiring Weld County Council members. Councilman Roberts seconded the motion and it carried. Welcoming New Weld County Council Members It was determined that the Council would invite the newly-elected Weld County Council members to join the 1998 Council members for dinner before the December 15, 1998 Council meeting.
