RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST TERRY AND MICHELLE MCKIBBEN FOR VIOLATION OF THE
WELD COUNTY ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Terry and Michelle McKibben, VI #9600003, are allegedly in violation of the
Weld County Zoning Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 11th day of June, 1996, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Michelle (Mickey) McKibben, property owner, was present at said hearing, and
WHEREAS,the Board of County Commissioners deems it advisable to delay referral of said
violation to the Weld County Attorney's Office for a period of ninety (90) days to allow adequate
time for the property owners to bring the subject property into compliance and for an inspection of
the property by the Department of Planning Services staff, and
WHEREAS, the Board deems it advisable to proceed with legal action against the above
named individuals without further Board action if the subject property is not brought into compliance
within ninety (90) days.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that if said violation still exists on September 11, 1996, the Weld County
Attorney be, and hereby is, authorized to proceed with legal action against Terry and Michelle
McKibben to remedy the violation of the Weld County Zoning Ordinance, and any other persons
occupying the properties, any persons claiming an interest in the properties, and any persons
acting in active concert with the identified parties.

The uses on the property are a violation of Sections 31.2, 31.3, 31.3.9, and 31.4 of the Weld
County Zoning Ordinance. To bring the property into compliance all the vehicles must be
currently licensed or must be removed from the property. The sink and oven must be removed

from the garage so that it is no longer considered a residence. All business uses must cease
and be removed from the property or a Special Review Permit must be applied for and
submitted to the Department of Planning services.
The Department of Planning Services also recommends that the County Attorney authorize
legal action against any other persons occupying the properties, any persons claiming an
interest in the properties, and any persons acting in active concert with the identified parties.

The property referenced above remains in violation of the Weld County Zoning Ordinance. I
have scheduled a meeting with the Board of County Commissioners on June 11, 1996 at
10:00 a.m. to consider the Zoning Violations occurring on the property. This meeting will take
place in the County Commissioners' Hearing Room, first floor, Weld County Centennial Center,
915 Tenth Street, Greeley, Colorado. It is recommended that you or a representative be in
attendance to answer any questions the Board of County Commissioners might have about the
violation.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the
violation. Our records indicate that you were made aware of the nature of the violation, the
action necessary to correct the violation, and that you were given sufficient time to remedy the

The uses on the above described property are being considered as a zoning violation of Section 31.2,
31.3 and 31.4 of the Weld County Zoning Ordinance. This is not a use allowed by right in the
Agricultural zone district.
The violation can be corrected by removing the residences(garage and RV)other than the principle
dwelling(the house)and the accessory to farm(the mobile home)from the property and removing any
business or business uses from the property. If you wish to continue any of the businesses or business
uses(other than the greyhounds)you may also apply for a Use by Special Review(USR)permit.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however,we have no discretion in this matter if you fail to correct this violation.You have 30(Thirty)
days from April 23, 1996 to correct this zoning violation. Failure to do so will result in this office
scheduling the violation before the Board of County Commissioners to consider whether to refer the
violation to the County Attorney's office for legal action.

HOWEVER THREE RV'S STILL ARE LOCATED ON THE PROPERTY.
MICHELLE MCKIBBEN INDICATED TO ME THAT ONE WAS HERS, ONE WAS
A FRIENDS AND ONE WAS THE GIRLFRIEND OF THE GUY LIVING IN
THE ACCESSORY MOBILE HOME. THE GIRLFRIEND HAS BEEN LIVING
IN THE RV AND I TOLD MICHELLE THAT THIS IS NOT A USE ALLOWED
BY RIGHT IN THE AGRICULTURAL ZONE. ANOTHER SIGN ADVERTISING
INCLUDING STORAGE OF GOODS OR EQUIPMENT FOR THE WELDING
BUSINESS WOULD NOT BE ALLOWED WITHOUT A USR PERMIT. THE
NON-COMMERCIAL JUNKYARD IS JUST ABOUT TAKEN CARE OF. THE
DERELICT VEHICLE HAS BEEN REMOVED AND MOST OF THE ITEMS OF
CONCERN HAVE BEEN REMOVED. MICHELLE DID INDICATE TO ME THAT
HER HUSBAND AND HER ARE GOING THROUGH A DIVORCE AND HE IS
LIVING IN THE GARAGE BECAUSE ONE OF THEM HAS TO REMAIN ON
THE PROPERTY. THIS IS ALSO NOT A USE ALLOWED. THE
PRINCIPLE DWELLING AND THE ACCESSORY TO FARM (MOBILE HOME)
WOULD BE THE ONLY DWELLING UNITS ALLOWED ON THE PROPERTY.
NO BUSINESS USES ARE ALLOWED ON THE PROPERTY UNLESS USR
PERMITS ARE APPLIED FOR AND APPROVED.

It has come to the attention of the Department of Planning Services' staff that the uses on your
property (3503 Highway 56)may not be in compliance with the Weld County Zoning Ordinance.
The potential noncompliance with the zoning ordinance is a non-commercial junkyard consisting
of derelict vehicles and miscellaneous building materials and other junk, an RV storage, a
