HomeMy WebLinkAbout982103.tiff ORDINANCE NO. 82-T IN THE MATTER OF REPEALING AND RE-ENACTING ORDINANCE NO. 82-S, THE SETTING OF FEES FOR SERVICES PROVIDED BY THE WELD COUNTY HEALTH DEPARTMENT BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF WELD, STATE OF COLORADO: WHEREAS,the Board of County Commissioners of the County of Weld, State of Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, has the authority, under State statute and the Weld County Home Rule Charter, to establish certain fees for services provided by the various departments of Weld County Government, and WHEREAS, the Board of County Commissioners of Weld County desires, through this Ordinance, to set fees and charges for services provided by the Weld County Health Department. NOW, THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of the County of Weld, State of Colorado, that Ordinance No. 82-S be, and hereby is, repealed and that the fee schedule set forth in Exhibits "A" and "B", copies of which are attached hereto and incorporated herein by reference,shall be the fees charged by the Weld County Health Department for the described services. BE IT FURTHER ORDAINED by the Board that this Ordinance shall supersede all prior ordinances and resolutions concerning fees for the services enumerated in this Ordinance. BE IT FURTHER ORDAINED by the Board that the effective date of said fee schedule shall be January 1, 1999, and such fees shall remain in full force and effect until the Board ordains to change such fees. 982103 ORD82 RE: ORDINANCE NO. 82-T PAGE 2 BE IT FURTHER ORDAINED by the Board, if any section, subsection, paragraph, sentence, clause, or phrase of this Ordinance is for any reason held or decided to be unconstitutional, such decision shall not affect the validity of the remaining portions hereof. The Board of County Commissioners hereby declares that it would have enacted this Ordinance in each and every section, subsection, paragraph, sentence, clause, and phrase thereof irrespective of the fact that anyone or more sections, subsections, paragraphs, sentences, clauses, or phrases might be declared to be unconstitutional or invalid. The above and foregoing Ordinance Number 82-T was, on motion duly made and seconded, adopted by the following vote on the 14"1 day of December, A.D., 1998.
