QUENTINE AVENUE, AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Amendment to Intergovernmental Agreement for the Improvement of Weld County Road 21, a.k.a. Quentine Avenue, between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, and the Town of Milliken, with terms and conditions being as stated in said amendment, and WHEREAS, after review, the Board deems it advisable to approve said amendment, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Amendment to the Intergovernmental Agreement for the Improvement of Weld County Road 21, a.k.a. Quentine Avenue, between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, and the Town of Milliken be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said amendment. Box 290, Milliken, Colorado 80543, and the County of Weld, Colorado, by and through the Board of County Commissioners of the County of Weld("County"),whose address is 915 10th Street, P.O. Box 758, Greeley, Colorado 80632. WITNESSETH: WHEREAS, on December 18, 1996, the parties hereto entered into an Intergovernmental Agreement for the Improvement of Weld County Road 21, a.k.a., Quentine Avenue ("the Agreement"), for the purpose of agreeing to various improvements and the sharing of the costs of said improvements, to Weld County Road 21, a.k.a., Quentine Avenue, between Broad and Green Streets, and WHEREAS,there is the need for an amendment to the Agreement to reflect an increase in the overall costs of said improvements and the sharing of such increased costs. NOW, THEREFORE, in consideration of the mutual promises and covenants stated herein, the parties hereto agree to amend the Agreement as follows: Delete paragraph 3.a. of the Agreement, and add the following: 3. COUNTY AGREES: a. To pay one-half of the costs associated with Street Improvements not to exceed $32,715, including those portions of Quentine Avenue which are currently in the jurisdiction of the County, upon the request of the Town. Schnelzer,Administrator Town of Milliken Town Hall 1101 Broad Street,Drawer 290 Milliken,CO 80543 RE: Amendment to Intergovernmental Agreement Dear Mr. Schnelzer: • Enclosed is a proposed Amendment to the Intergovernmental Agreement for the Improvement of Weld County Road 21, a/k/a/Quentine Avenue. A copy of the original Agreement is also enclosed. The Amendment amends Section 3.a.to increase the amount which Weld County will pay for the improvements to $32,715.00. I have enclosed two originals of the Amendment. If the Amendment is satisfactory,I request that you see that Mr. Chavez and Ms. Wakeman sign the same and send it to my office at: 915 Tenth Street, P.O.Box 1948, Greeley,Colorado 80632. Paragraph 2.d. of the original Agreement requires the Town to annex"those portions of Quentine Avenue as outlined in the recitals of this Agreement,which are within the jurisdiction of the County and become responsible for the maintenance thereof after the date of such annexation. The Town agrees to begin the annexation process on or before the time of commencement of construction by an enactment of a resolution of intent to annex." It is my understanding that the construction is now completed,or will be shortly. It is also my understanding that the Town has not enacted a resolution of intent as of this date. In our telephone conversation on Tuesday,February 10, 1998,you stated that you would ask the Town of Milliken attorney,Bruce Fickel,to begin the annexation process. I-ltnniediately called Mr. Schnelzer and he explained that there.were several other items that over ran during the construction and he was unaware of the details. I asked him to provide the details and''a cost breakdown so that I could-make a"recommendation to the Commissioners. ; • On October 28, 1997,I received a letter from Mr. Schnelzer accompanied by a memorandum from Derek Johnson • and detailed spread sheet of the project cost.—The County s'hare:had grown to $39,344. Since the preliminary construction estimate that established the County's share as$22,600, four items were added to the project that are clearly within Weld County's jurisdiction. The preliminary paving cross section was for three inches of asphalt and over four inches`of additional base course. The final design called for four inches of asphalt and over six inches of base course. A new culvert was placed under WCR 48;,,Three new culverts,were installed in the existing field accesses between WCR 48 and St. Hwy 60. Kirkmeyer, Chair Weld County Commissioners 915 10th Street Greeley, Colorado 80631 Dear Commissioners: The Town of Milliken would like to thank you for your participation in the paving of County Road 21. The citizen have greatly appreciated this improvement,and it is certainly an asset to Weld County. I am writing to you to request that you reconsider your position relevant to the assessed cost of this project. After doing our due-diligence on this project, it became evident that certain portions of this project were underestimated. At that time town staff contacted Mr. Drew Schehinga, County engineer, so that his input would be included. This increase in cost for the project is itemized on the attached spreadsheet, and summarizes the involvement of the contributing parties. As with many small communities,this differential cost, which is attributable to Weld County, makes a significant impact on the Town's budget.For these reasons I am requesting that you reconsider your previous decision, and fund the project to the full amount of$35, 829. Again I want to thank you for your interest and efforts in assisting Milliken with its growth issues, and look forward to working with you in the future.
