This is written to follow up my memo dated May 23, 1995, regarding a request to preadvertise
the Minor Subdivision Final Plat application referenced above.
The Greeley Planning Commission is scheduled to consider the Minor Subdivision proposal at
its June 13, 1995, meeting. Ttiis will allow staff the opportunity to review Greeley's concerns
prior to June 28, 1995, the date requested by the applicant for the Board hearing. The City of
Greeley Planning staffs report and recommendation may be available prior to our County
Planning Commission meeting on June 6, 1995.
Staff received one telephone call on Friday from a surrounding property owner regarding this
subdivision of land. Concerns about affects of the proposed land use on existing wildlife and
maintenance of the natural features of the site were raised. Submittal of a letter outlining these
concerns was suggested by staff, so that the applicant may answer theconcerns to the
satisfaction of the neighbor and provide the necessary documentation to the file. A letter has
not yet been received by staff.
Staff does not have an objection to theBoard granting the request to preadvertiseand hear the
case on June 28, 1995. Staff only wishes to provide all pertinent information prior to -the Board
making this decision.

Board of County Commissioners on July 10,1995.
The items on the June 20th Planning Commission were continued, along with Meadow
Brook Farm, until July 6th as the Planning Commission did not have a quorum!
Consequently, Meadow Brook Farm can not be heard by the Board on June 28th.

Dear Gloria,
This letter is in response to your concern about the legal right to consumptive use of the
water in the duck pond of the subject subdivision. The pond resulting from repair of an
existing dike, covers an area of 3.6 acres with only 2.1 acres within the subdivision and
allows flow through of all water that enters the pond from the drainage basin above as has
been done for many, many years. The water entering the pond is primarily tailwater from
irrigation of lands above the pond. There is no consumptive use of water from the pond
except that which evaporates from the pond.
A stock pond of the same size has existed at this location since approximately 1910 and
prior to the State of Colorado initiating its water augmentation program. The effects of
the duck pond created by repairing the old dike has not changed the historical conditions
at this location. Therefore no further action is realistically justified.
The applicant is prepared to meet the requirements of the Weld County Commissioners
and/or the State Division of Water Resources, however it is the applicants position that no
new water holding facility has been created.

THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE
APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements
of Section 4.4 of the Weld County Subdivision Ordinance.
2. It is the opinion of the Department of Planning Services' staff that the
applicant has shown compliance with Section 4.5.9 of the Weld County
Subdivision Ordinance as follows:
The proposed Minor Subdivision Final Plat is consistent with the Weld
County Comprehensive Plan. The property is located within the Urban
Growth Boundaries of the Town of Windsor and City of Greeley. The
Windsor and Greeley Planning Commissions have indicated that they have
no objection to the proposal. Parcel size and topography restrict the
use of the site for agricultural production.
The proposed Minor Subdivision Final Plat is compatible with the
surrounding area of rural residential uses and agricultural
production.
Definite provision has been made for a public water supply that is
sufficient in terms of quantity, dependability, and quality to provide
water for the minor subdivision, including fire protection. Little
Thompson Water District conditionally agrees to provide service to the
proposed development.

Provision has been made for individual septic disposal systems for the
Minor Subdivision which will be installed according to Weld County
Health Department regulations.
Soil or topographical conditions which require special precautions
have been identified by the applicant; the proposed uses of these
areas can be made compatible.
Streets within the Minor Subdivision will be adequate in functional
classification, width and structural capacity to handle the traffic
requirements of the proposed use.
Off -site street facilities providing access to the Minor Subdivision
are adequate in functional classification, width, and structural
capacity to meet the traffic requirements of the proposed use.
Proposed access is from Weld County Road 60, a gravel -surfaced local
road.
Two accesses to the Minor Subdivision will provide adequate access from
Weld County Road 60 to internal streets known as Willow Ridge Drive and
Brookside Drive. No additional accesses to Weld County Road 60 will
be created.
The Minor Subdivision is not part of a minor subdivision previously
approved by Weld County.
Construction, maintenance, snow removal, and other matters pertaining
to or affecting the road accesses and right-of-way for the minor
subdivision will be the sole responsibility of the resident land
owners or developer.
The minor subdivision will not cause an unreasonable burden on the
ability of local governments or districts to provide police and fire
protection, or other services. The Weld County Sheriff's Department
has reviewed the proposal and has no conflict. Windsor/Severance Fire
-Protection District can provide service if certain conditions are met.
The Utility Advisory Committee reviewed the minor subdivision final
plat on June 8, 1995, and conditionally approved the request.

This recommendation is based, in part, upon a review of the application materials
submitted by the applicant, other relevant information regarding the request, and
responses from referral entities.
The Department of Planning Services' staff recommendation for approval is
conditional upon the following:
1. Prior to recording the Minor Subdivision Final Plat:
a) The Board of County Commissioners shall approve the subdivision
improvements agreement and the form of collateral. The security for
the agreement shall be tendered and accepted by the Board of County
Commissioners for the -subdivision improvements agreement.
b) A completed Utility Service Statement Block shall be placed on the
plat.
c) The road construction plan shall be amended to show 20 -foot radius,
where possible, where Willow Ridge Drive and Brookside Drive intersect
with Weld County Road 60, and roadside drainage culvert at Brookside
Drive, as described in the memorandum dated May 25, 1995, from Don
Carroll, Weld County Department of Public Works.
d) A copy of the covenants approved by the Weld County Attorney's Office
shall be ready to be recorded.
e) The plat shall be amended to show the proposed equestrian trail and
duck pond to be constructed on Tract A.
f) The applicant shall provide documentation to the Department of
Planning Services indicating a willingness to meet the five conditions
required by the Little Thompson Water District, in a letter dated
February 10, 1995, for the commitment of six residential water taps.
The conditions are:
Payment of a $1,000 system impact fee per lot, due and payable
upon the acceptance of the main line extension.
All improvements to Water District facilities must conform to
Water District specifications.

Applicant has the financial responsibility of extending the main
water line from Weld County Road 60 to provide water service to
the minor subdivision.
Applicant is required to transfer one share of Colorado Big
Thompson water for each lot added to the water system within the
minor subdivision.
Payment of a $2,000 fire hydrant fee for each hydrant added to
the water system within the minor subdivision.
g)
The applicant shall provide documentation to the Department of
Planning Services indicating that all requirements of the State
Division of Water Resources regarding the duck pond have been met.
2. Prior to the Board of County Commissioners hearing:
a) The applicant shall provide written documentation to the Department
of Planning Services indicating that the Windsor/Severance Fire
Protection District has approved fire protection plans for the Minor
Subdivision.
b) The applicant shall demonstrate that there is a legal -right to
consumptive use of the water in the duck pond.
3. The following notes shall be placed on the Minor Subdivision Final Plat:
a) Uses permitted within the minor subdivision consist of E(Estate) uses
as listed in the Weld County Zoning Ordinance and described in the
application materials.
b) Access to the lots within the minor

minor subdivision.
d) Sewer service shall be provided by individual septic disposal systems
approved by the Weld County Health Department.
e) All lots within the minor subdivision shall comply with the
requirements of the Windsor/Severance Fire Protection District.
f) The Minor Subdivision shall be composed of no more than six rural
residential lots and one outlot known as Tract A, which is proposed as
private common open space for use by lots owners.
g) No permanent_ structures shall be built on Tract A.
h) Tract A shall be owned and maintained jointly by Meadowbrook Farm
Community Association.
i) The two internal streets within the minor subdivision, known as Willow
Ridge Drive and Brookside Drive, are private and shall be constructed
with a 40 -foot right-of-way, and in all other respects shall be built
to County standards. The streets shall be maintained by the
homeowners association, lot owners or developer.
j) No on -street parking shall be allowed within the Minor Subdivision.
k) Installation of utilities shall comply with Section 10 of the Weld
County Subdivision Ordinance.
1) Any work taking place in an existing wetland within the Minor
Subdivision shall meet the requirements of the Department of the Army
Corps of Engineers for permits pursuant to Section 404 of the Clean
Water Act.
m) No permanent structures shall be built on the Panhandle Eastern 50 -foot
right-of-way easement for its pipeline. A minimum of 42 -inch cover is
required over the pipeline.
n) A soils and foundation investigation report prepared by a qualified

soils and foundation engineer shall be submitted with each building permit
application, in accordance with the Geotechnical Engineering Report prepared
by EmpireS.aboratories, Inc. and dated October 20, 1994.

The applicant is requesting a 40 foot right-of-way for each of the two interior streets of this
minor subdivision,- rather than the 60 feet which is the _usual standard for countystreets.
According to Section 10.1 of the Weld County Subdivision Ordinance, all subdivisions except
minor subdivisions must comply with the design standards, including road specifications, set
forth in this section.. In response to a letter regarding this matter from Art Urich of Nelson
Engineers, former Director of the Department of Planning Services Chuck Cunliffe verbally
indicated that the 40 foot right-of-way streets as requested would be acceptable. The Department
of Public Works has no objection to thereducedright-of-way width.

Board of County Commissioners hearing
A request to preadvertise for a minor subdivision final plat has been received from Tri-City
Ventures, LLC. June 20, 1995, is the date scheduled for the Planning Commission to hear the
application. Applicant Jeff Perryman is requesting that the Board consider the case on
Wednesday, June 28, 1995. The minor subdivision final plat requirement for publication of legal
notice, as stated in Section 4.5.15 of the Weld County Subdivision Ordinance, is set at no less
than ten (10) days prior to the hearing.
Staff has no conflict with the request to preadvertise so that the case may be heard by the
Board on June 28, 1995.

Your application and related materials for the request described above are being processed at the present time. I have scheduled a meeting
with the Weld County Planning Commission for June 20, 1995, at 1:30 p.m. This meeting will take place in the County Commissioners'
Hearing Room, First Floor, Weld County Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended_ that you and/or a
representative be in attendance to answer any questions the Planning Commission members may have.
It is the policy of Weld County to refer an application to any town or municipality lying within three miles of the property or if the property
is located within the comprehensive planning area of a town or municipality. Therefore, our office has forwarded copies of the submitted
materials to the City of Greeley and Town of Windsor Planning Commission for their review and comments. -Please call City of Greeley
at350-9780 and Town of Windsor at 686.7476 for further details regarding the date, time, and place of this meeting. It is recommended
that you and/or a representative be in attendance at the Planning Commission meeting to answer any questions the Commission -members
may have with respect to your application.
A representative from the Department of Planning Services will be out to the property a minimum of ten days prior to the hearing to post
a sign adjacent to and visible from a publicly maintained road right-of-way which identifies the hearing time, date, and location. In the event
the property is not adjacent to a publicly maintained road right-of-way, one sign will be posted in the most prominent place on the property
and a second sign posted at the point at which the driveway (access drive) intersects a publicly maintained road right-of-way.
The Department of Planning Services' staff will make a recommendation concerning this application to the Weld County Planning
Commission. This recommendation will be available twenty-four (24) hours before the scheduled hearing. It is the responsibility of the
