The purpose of this memorandum is to follow-up my previous memorandum dated March 12,
1998, concerning the proposed sewer service for S-449, JER, a Partnership. As you recall, JER,
a Partnership proposed to serve the development with sewer service from the Hill-n-Park
Sanitation District. During our review information came to light that the Hill-n-Park Sanitation
District was not meeting effluent discharge limits and had other issues of non-compliance
concerning the design and operation of the treatment facility. In my March 12, 1998,
memorandum, we recommended against approving this application until adequate demonstration
could be made that the Hill-n-Park Sanitation District has the ability to appropriately manage the
hydraulic load from the homes proposed in this application.
We have reviewed several letters from both Victor Sainz of the Colorado Department of Public
Health and Environment and Pickett Engineering concerning the operating and compliance status
of the facility. Today, I also discussed the facility with Earl Smith of the City of Evans and
Victor Sainz. Both Mr. Smith and Mr. Sainz have indicated that much progress has been made at
the facility and the facility has the ability to handle the additional hydraulic load while
maintaining compliance with its operating permit. It should be noted that the City of Evans
assumed control of the facility in July 1998.
Based upon all available information, it appears that our concerns with the Hill-n-Park Sanitation
District have been adequately addressed. As a result, our Department has no further issue with
the sewer service proposed to serve this development.
However, we recommend that the following conditions be a part of any approval:
1) The applicant shall obtain water and sewer service from the City of Evans.
2) No permanent disposal of wastes shall be permitted at this site.
3) Waste materials shall be handled, stored, and disposed in a manner that controls fugitive
dust, blowing debris, and other potential nuisance conditions.

The Department has reviewed the submitted application materials for the JER Partnership. The
materials indicate that the proposed homes will be served by the Hill-n-Park Sanitation District.
As a part of our review of this application, Sheble McConnellogue contacted Earl Smith at the
City of Evans. Mr. Smith indicated that the City recently contracted with HDR Engineering, Inc.
to evaluate the Sanitation District. Mr. Smith provided us a copy of the evaluation. The
• evaluation, dated November 1997, states that there are many issues of non-compliance with the
District, including but not limited to inadequate aeration capacity, chlorine contact time, and feed
capacity. As well as measurable discharges from the facility that do not comply with current
Colorado Discharge Permit Regulations. In addition, our Department has received various
complaints, from homeowners served by the District, concerning sewage backing into their
homes and overflowing from manholes.
As a result, our Department recommends against approving this application, until such a time
that adequate demonstration can be made that the Hill-n-Park Sanitation District has the ability to
manage the additional hydraulic load from the proposed homes.

RE: Compliance Inspection of the Wastewater Treatment Facilities,NPDES Permit No. COG-582012,for
Hill-N-Park Sanitation District, Weld County.
Dear Mr Lundvall:
Enclosed is your copy of the above referenced report for the inspection performed on June 2, 1998.
The Technical Services Unit is conducting an evaluation of the District's wastewater facilities and its ability to
reliably and consistently meet discharge permit limits. This investigation was prompted by the City of Evans'
concerns regarding the District's ability to comply with present permit limits. The Water Quality ControljDivision
(the Division) is in possession of a set of tests performed (5/8/97, 5/15/97, 5/22/97, 5/29/97, 6/5/976,/12/97,
6/19/97 and 7/3/97)by City of Evans personnel that shows significant discrepancies between their results and the
ones reported by the District.
During the inspection the following deficiencies were noted that need to be brought to your attention:
I. There is a bypass line in the Ashcroft Draw manhole. The manhole is located south of West 1st Street and
west of the draw. This bypass line is in violation of the Colorado Discharge Permit System Regulations,
Regulation No. 61 (5 CCR 1002-61), Section 61.8 (3) (i), it needs to be removed immediately: Please
notify the Division in writing within 15 days of your receipt of this letter of the date by which this bypass
will be removed.
2. During the inspection, the operator reported that the old influent flow meter was unreliable. We were
unable to determine the date it was last calibrated, no records of its calibration were available. Therefore,
the discharge flows reported in the Discharge Monitoring Reports(DMRs)are unreliable and questionable.
The Regulations for Effluent Limitations; Regulation No. 62 (5 CCR 1002-62), Section 62.5(3)clearly
state that the District must measure flows within 10 percent of actual flow being measured. Therefore, the
Hill-N-Park Sanitation District has been reporting inaccurate flows in violation of the Regulation for
Effluent Limitations regulations. i
3. During the inspection we requested the laboratory bench sheets be provided. Dale Dameree, operator and
lab technician for the District agreed to provide them but to the date he has not been able to provide these
documents to us. The monitoring results, for BOD, TSS and flow, reported to the Colorado Department
of Public Health and Environment (CDPH&E) and the Environmental Protection Agency (EPA) are
unreliable in violation of Section(s) 61.8 (4), (b), (c), (d), (j) and (k) of the Colorado Discharge Permit
System Regulations, Regulation No. 61 (5 CCR 1002-61).

4. During the inspection we noted that the chlorine room does not meet the minimum safety requirements
described in the Colorado Design Criteria Considered in the Review of Wastewater Treatment!Facilities,
Policy No. 96-1, Section 6.1 (pages 28 and 29). I am including a copy for your use.
5. About a month ago I received a complaint, from a Hill-N-Park resident, regarding sewage back-up due to
the malfunctioning of the lift station that serves his property. The Division has no knowledge regarding
this lift station. Section 22.4 (I), of the Regulations for the Site Applications Process, Regulation No.
22(5 CCR 1002-22), requires a site application approval from the Division before any such str;u:tures are
built. Please provide all the information required in the regulations regarding this or any'other lift
station(s)serving the Hill-N-Park Sanitation District.
To complete our inspection and to determine your facility's compliance evaluation, the Division is requesting the
following additional information: a)Date and name of company that installed and calibrated the original flow meter.
b)Date and name of company that installed and calibrated the present flow meter. c)Date(s)of the illegal discharge
from the bypass line at Aschroft draw, duration of the discharge and estimated flow rate.
Finally,Mr. Kris Pickett, Professional Engineer and Consultant to the District has agreed to provide the Division
with an engineering analysis regarding the treatment capabilities for the Hill-N-Park lagoon system. Please direct
all of this information to Cary Pilon, Technical Services Unit, Water Quality Control Division, Colorado
Department of Public Health and Environment, at 4300 Cherry Creek Drive South, Denver, Colorado 80222, he
will conduct this compliance evaluation.
At this time, I want to thank Kris Pickett and Dale Dameree for their time and cooperation during the inspection.

Dear Mr. Sainz:
In November 1997, HDR Engineering, Inc. in Denver, Colorado prepared an evaluation of
the Hill-N-Park wastewater collection treatment system. They published this report on
behalf of the City of Evans because the City of Evans is pursuing the assumption of the
district and its facilities. That report indicated several areas where they believe that the
collection treatment system needed repair and/or did not meet state regulatory
requirements.
- The purpose of this letter is to inform you of the actions that have been taken to date, the
current status of the system, and to show that:
1. the existing system meets the effluent requirements of the existing permit
2. that the existing facilities, as they are today,are adequate to serve existing load, as
well as the requested addition of twenty taps by Mr. Roy Lundvall
3. to bring you up to date on the status of the City of Evans agreement with Bill-N-
Park to take over the facilities
4. . to discuss the improvements and intentions the City of Evans has with respect to
the system.
First, to address the comments and conclusions that were made in the engineering report,
refer to Pages 9 and 10. I would like to point out that the following items have been
completed:
• Both 15 h.p.aerators are operable, and are running 24 hours a day.
• A new influent measuring device with automatic metering has been installed.
• The effluent discharge location is directly south of the chlorine contact basin,
approximately 250 feet south of the discharge from the chlorine contact basin.

• The chlorine building has been cleaned and painted.
• At the time of last observation, the chlorine was being administrated at
approximately five pounds per day.
• The weeds have been removed and appear to have been mowed a second time.
1. The capacity of the existing system and its ability to meet existing permit
requirements: I have reviewed the DMR's for 1997, and it appears that each of the
reports indicates that the system is handling the inflows and discharging with effluents
within the permit limits. I also reviewed the flow measurements from January 27 through
April 7, 1998, and they indicate an average effluent discharge of 0.2047 mgd.
A. With respect to HDR's report Pages 13-16, I offer the following comments:
• The aeration capacity as stated has been repaired and remains at 30 h.p. The
HDR report indicates the capacity is therefore 0.28 mgd.
• HDR's report indicates that the limiting factor, once aeration capacity was
increased, is the chlorine feeder and chlorine contact time. The chlorine feeder
has been inspected and appears to be working properly. While the chlorine -
contact time is less than current State requirements suggests, it appears from the
effluent discharge that the chlorine contact time is not a significant issue in
meeting permit requirements. Therefore, the existing system meets existing
needs with adequate capacity to handle inflows.
2. The existing system will likely handle up to the 0.28 mgd capacity that HDR's report
estimates for the aeration limitation. From this, and with the knowledge that there are 794
permanent dwelling units on the system, this gives an average of 257.8 gallons per day,
per dwelling unit. If the system were to add twenty units, then this would mean influent of
0.2096 mgd, or a 2.5% increase in the treatment requirement. This should easily be
accommodated by the existing system. As an additional check, we are performing
independent sampling of the effluent discharge twice a week for the next four weeks to
have an independent sampling and testing of the effluent to confirm that the system is in
compliance with the permit requirements.
3. A meeting was held with representatives from Hill-N-Park Sanitation District, the
City of Evans, and HDR Engineering on April 24, 1998 to review the improvements that
have been made to the facility and to discuss negotiations for the City taking over the
wastewater collection treatment system at Hill-N-Park. From that meeting, it was
determined that I would write this letter to you to give you an indication that the system

is performing within its permit limits,that the additional 20 lots would still allow the
system to perform within its permit limits, and to inform you that the City of Evans is
pursuing a contract with Hill-N-Park to assume control and responsibility of the system on
or before July 1, 1998. Those negotiations and final contract are being drawn up now.
4. The City of Evans has agreed to make any improvements necessary to comply with
the existing permit regulations for the existing customers, as well as the additional 20 that
are being requested, and do those in a very timely manner, if needed. In addition, the City
of Evans that they have made commitments to additional users outside the existing system,
and will therefore be taking actions in the near future to both upgrade the system to meet
current State regulatory requirements for the existing load, but also to expand the facility's
capacity. Therefore, it appears that, while the existing system does meet effluent permit
requirements, that it does not have some of the current regulatory facilities that would be
required for a new system, that the City of Evans will be upgrading the system to not only
add capacity, but to bring the facilities to compliance to existing regulatory requirements.
In conclusion, please respond by indicating that the existing facility does work within the
existing effluent requirements of the permit, and that you find the 20-tap addition to be.
within the existing system's capacities: Should you have any question regarding this letter,

Dear Mr, Pickett:
This is in response to your letter of May 4, 1998 regarding the Hill-N-Park Sanitation District operations. In your letter you
request that the Water Quality Control Division(the Division) approve the connection of an additional 20 taps.
Pursuant to Colorado Law,C.R.S. 25-8-501 (5d&e),the permittee(in this case Hill-N-Park Sanitation District) is required
to initiate engineering and financial planning for expansion of the wastewater treatment facilities whenever throughput and
treatment reaches eighty(80)percent of design capacity. Whenever throughput and treatment reaches ninety-five(95)percent
of the design capacity,the permittee shall commence construction of the necessary treatment expansion.
According to your analysis,it appears that the District's facilities have not reached the 80 percent capacity,therefore, it is up
to the District officials to decide if they want to approve the connection of an additional 20 taps. In addition, it is the owner's
responsibility,or its agent,to meet discharge permit limits.
As we discussed during our recent telephone conversation, I have scheduled an inspection for June 2, 1998 to evaluate the
District's compliance with its discharge permit limits. At this point I would appreciate it if you would provide the following
information regarding this system's permit compliance: a)Your design evaluation for Total detention,b)detention time for each
cell, c) aeration capabilities for the total system, d) influent waste load, e) effluent quality, f) chlorine chamber contact time,
g)independent sampling you mentioned during our phone conversation,and any other information that may help me to perform
a detailed evaluation of this system's ability to meet its discharge permit limits.

Dear Mr.Hodges:
Terracon recently submitted a Ceotechnical Engineering Report(April 1998)on West Itill-n-Park
5"'Piling. Ten-aeon drilled six borings and analyzed three samples from two borings for swell-
consolidation potential. troundwater was present in borings 5 and 6,the easternmost borings at a
depth of about 8 ft. The groundwater in boring 5 is resting on hedmck,which was encountered at
8.5 ft. As the borings war.drilled in March and development and subsequent lawn irrigation will
alter the subsurface hydrology,the water table will most likely rise. Still,basement construction is
feasible with the limitations stated in the Terracon report,and with the understanding that
groundwater may be 2 ft higher in the eastern lots after development. Terracon suggests
implementing aoundwater monitoring plan to determine seasonal fluctuations in groundwater.
This is an excellent idea, but I've never seen it executed. Also,the monitoring would not account
for post-development inflow into the system,
The loessial soils show a moderate tendency to collapse and consolidate, A common and
inexpensive mitigation for this condition is to soak the soils and then thoroughly compact them.
Overexcavation and replacement is another mitigation. Iiydrocompaction is a condition of which
the builder needs to be aware so that the appropriate designs and earthwork for the subdivision may
he planned in advance.
•
t laystane bedrock that is within 5 ft of the proposed foundation level should be analyzed for swell
potential. If moderate or high swell capacity is determined,drilled pier foundations should be
consideredl.
In summary,there are no geologic conditions present at the site that would preclude development,
hut the recommendations stated in the Terracon report and above should he followed to ensure the
success of the project. Please call me if there arc any questions.

I reviewed the second submittal on West Hill-N Park, Filing #5. It appears that four of the
western-most lots have been consolidated into three, but otherwise the plat has not
changed. In the year between the two submittals, no subsurface investigation has been
performed on the property. Terracon states in the November 1997 letter to the developer
that additional soils information is provided, but this consists of a paragraph staring what
was encountered on an adjacent filing. This information does not meet the provisions set
forth for geologic suitability reports under State subdivision law (C.R.S. 30-28-101 et seq.)
It does not address the current project or the parcel area being considered for development.
In addition, none of the raw data for the adjacent filing were submitted, but rather a brief
summary of findings, so there was no way to evaluate these conclusions.
As I stated in my letter of May 22, 1997, loessal soil has a potential to collapse when
wetted and loaded, and the settlement can be damaging to structures and utility lines. I
recommended that 1) a minimum of four borings be drilled for the purpose of observing the
soil profile and obtaining geotechnical samples and 2) the operation should be supervised
by a soils or geotechnical engineer, and the geotechnical tests should include determination
of density,moisture content, and swell/consolidation. This is not an unreasonable scope
of work for a preliminary subsurface investigation.
In summary, CGS recommends that Weld County not accept the current preliminary plat
application until a preliminary subsurface investigation is performed on filing 5. Please

The Weld County Public Works Department has reviewed this proposal; the following requirements are
recommended to be a part of any approval:
COMMENTS:
West Hill-n-Park is a maintained county subdivision located at the intersection of 47th Avenue and WCR 52. All
the water and sewer, paving, curb and gutter has been completed at this location.
The applicant has submitted a primary drainage report for West Hill-n-Park, 5th Filing. This report was prepared
by Peter Abplanalp from AbPL Engineering from Thornton, Colorado. I have reviewed the document and
calculations for the drainage facility and have no conflict with the submittal.
Mesa Verde Drive was constructed in the 4th Filing. The pavement is 38 feet wide, two inches thick with four
inches of aggregate base course, and a two foot wide concrete valley pan adjacent to the pavement.
I did not find a certificate regarding collateral for on-site improvements. This might have been covered in the 4th
Filing. My only question would be if the detention pond facility was covered at that particular time.

Subject: West Hill-N-Park 5th Filing Major Subdivision (Preliminary)
Dear Todd:
The City of Greeley Planning Commission held a meeting to discuss the proposed 5th
Filing at West Hill-N-Park, reviewed the request, and have the following comments:
West Hill-N-Park was originally zoned R-5 in 1971. The subject property was originally
approved as part of West Hill-N-Park Third Filing in 1984, and then replatted out of the
Third Filing in 1989. This application seeks to plat the lots which were removed in
1989.
The property is located outside the City's Long-Range Expected Growth Area (LREGA)
and Mid-Range Expected Service Area (MRESA), but within the three-mile area of
influence of the City. Therefore, the proposal is within the purview of the Greeley
Comprehensive Plan.
It is the practice of the City of Greeley Planning Department to review Weld County
requests principally for conformance with the City's Comprehensive Plan policies.
Specific design issues are addressed only to the degree necessary to ensure consistency
with the City's Comprehensive Plan and Zoning Code.
The City of Greeley's Comprehensive Plan does not directly address the issue of
subdivisions located outside of the LREGA. However, several sections of the
Comprehensive Plan, including segments discussing Sanitary Sewer Service, Fire Service,

Police Service, and Recreation, indicate subdivisions should be located where urban level
services are available. These sections of the Plan indicate land use patterns influence the
cost associated with providing these services. This subdivision will not provide urban-
level services. Therefore, the City of Greeley Comprehensive Plan suggests this
development should not occur until urban-level services are available.
Staff also wants to indicate the City would not normally recommend approval of a rural
residential subdivision and feels strongly that this type of development should not be
encouraged outside of an incorporated area. The area in question already includes the
Indian Hills Subdivision (21 lots) and the Dos Rios Subdivision (51 lots), as well as the
first three filings at Hill-N-Park Subdivision (450 lots), and the Arrowhead Subdivision
(approximately 63 lots). The proliferation of residential lots creates a demand for urban-
type services such as schools, storm drainage, and police and fire protection. The
unincorporated areas were never planned for this type of development and urban-type
services and facilities will not be available. We have also discussed the potential code
enforcement problems which must be managed by the governing entity.
If this new development is approved and built as proposed, the population of this
undeclared rural town will again increase. The staff suggests Weld County exercise
caution about approval of this type of development. Other issues of note which should
be addressed include a 350' setback from all oil and gas appurtenances to occupied
structures.
Since design elements are not reviewed, and the zoning has been established for a
subdivision, it seems appropriate to indicate the subdivision meets Comprehensive Plan
requirements. However, this type of development in general should not be encouraged
as noted earlier in this correspondence.
