RE: APPROVE WELD COUNTY JAIL BALLOT QUESTION FOR VOTE ON NOVEMBER 7,
1995
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on April 4, 1995, the Greeley City Council approved a Final Planned Unit
Development (PUD) for the construction of the Weld County jail on Tract A of the Weld County
Business Park located in Greeley, Colorado, with certain terms and conditions set forth therein, and
WHEREAS, the applicant for said PUD for the Weld County jail is the Board of County
Commissioners, and
WHEREAS, on June 13, 1995, the registered electors of Weld County, Colorado, approved
an amendment to the Weld County Home Rule Charter, that being Article XV, Section 15-5, which
requires approval by the registered electors of the County for the location and siting of correctional
facilities, including jails, which are to be located in Weld County prior to their occupancy, and
WHEREAS, on Wednesday, June 21, 1995, the Board of County Commissioners passed
Weld County Ordinance Number 185, which requires all persons constructing correctional facilities,
including jails, in unincorporated areas of Weld County, Colorado, to receive approval by the
registered electors of the County for the location and siting of the correctional facility prior to
receiving building permits, and
WHEREAS, although the Weld County jail is to be located entirely within the jurisdictional
boundaries of the City of Greeley, Colorado, and the Weld County Attorney has advised that Article
XV, Section 15-5, and Weld County Ordinance Number 185 do not apply to the location and siting
of the jail, the Board of County Commissioners directed staff to place the issue of the location and
siting of the Weld County jail on the ballot for vote by the registered electors of Weld County,
Colorado, on November 7, 1995.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the ballot question for vote by the registered electors of Weld County,
Colorado, on general election ballot for November 7, 1995, regarding the location and siting of the
Weld County jail on Tract A of the Weld County Business Park, Greeley, Colorado, shall be as
follows: "Shall Weld County, Colorado, construct the Weld County jail on Tract A of the Weld
County Business Park, Greeley, Colorado, in accordance with the terms and conditions of
the Final Planned Unit Development (PUD) as approved by the Greeley City Council on
April 4, 1995?"

BE IT FURTHER RESOLVED by the Board that the above stated ballot question be
transmitted to the Weld County Clerk and Recorder as of the date of the signing of this Resolution.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 19th day of July, A.D., 1995.
