HomeMy WebLinkAbout980565.tiff RESOLUTION RE: APPROVE AGREEMENT FOR TEMPORARY SERVICES OF ELECTRICAL INSPECTOR AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Agreement for Temporary Services of Electrical Inspector between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Planning Services, and Douglas Jones, 813 37th Avenue, Greeley, Colorado 80634, with terms and conditions being as stated in said agreement, and WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Agreement for Temporary Services of Electrical Inspector between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Planning Services, and Douglas Jones be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said agreement. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 8th day of April, A.D., 1998. Kirkmeyer 980565 PL0053 AGREEMENT FOR TEMPORARY SERVICES OF ELECTRICAL INSPECTOR THIS AGREEMENT is made and entered into the date and year set forth below by and between the County of Weld,State of Colorado,by and through the Board of County Commissioners of Weld County, whose address is P.O. Box 758, 915 10th Street, Greeley, Colorado 80632, hereinafter referred to as "Weld County", and Douglas Jones, whose address is 813 37th Avenue, Greeley, Colorado 80634, hereinafter referred to as "Electrical Inspector." WITNESSETH: WHEREAS,Weld County employs John Roberts, an electrical inspector, to perform routine electrical inspections as part of the enforcement of the Weld County Building Code Ordinance, and WHEREAS,Mr.Roberts is temporarily unable to perform the electrical inspection work,due to a recent back surgery, and may not be able to return to said position until his time of convalescence is complete, which time is expected to end in approximately six (6) to twelve (12) weeks, and WHEREAS, Electrical Inspector has the qualifications necessary to perform electrical inspections according to the Weld County Building Code, and has the time available to perform the work of electrical inspection during the time of Mr. Roberts' convalescence, and WHEREAS, Electrical Inspector and Weld County desire to enter into a written contract whereby Electrical Inspector will perform electrical inspection tasks in accordance with the Weld County Building Code Ordinance as more particularly set forth hereinafter. NOW, THEREFORE, for and in consideration of the promises and mutual agreements contained herein, Weld County and Electrical Inspector hereby agree as follows: 1. Recitals The above recitals are incorporated herein by reference. 2. Term of Agreement This Agreement shall be effective for the period beginning March 26, 1998,to and until such time as Mr. Roberts' convalescence is complete (estimated to be between 6 and 12 weeks). 3. Compensation In consideration of the services to be provided by Electrical Inspector as set forth Page 1 of 5 Pages hereinafter,Weld County agrees to pay Electrical Inspector the amount of$16.52 per hour. Electrical Inspector shall use a Weld County owned vehicle for transportation during and in the course and scope of performing the services set forth hereinafter. Electrical Inspector is not entitled to any of the benefits and compensation afforded regular employees, including, but not limited to, retirement, except the liability and workers' compensation insurance stated in Paragraph 5., below. 4. Electrical Inspector Services and Oualification Requirements A. Essential Duties and Responsibilities Inspects electrical wiring in buildings to assure that it meets or exceeds code standards; makes recommendations for corrections in wiring; works with builders to help resolve routine problems with electrical wiring. Conducts construction inspections related to administration of the Weld County Building Code Ordinance (119). Provides technical direction and assistance on building and electrical inspections; discusses field inspection problems and procedures; answers technical questions regarding code enforcement; assists in inspection training program as assigned. Studies codes and technical manuals; recommends changes in local codes or ordinances and office procedures to the supervisor or the Director of Planning Services. Prepares special and periodic reports as assigned. Prepares reports of construction work completed and inspections conducted;maintains routine records and files as directed. Reports on gas used; logs mileage driven daily; maintains files as necessary. Assists Planning personnel in conducting field inspections related to the administration and enforcement of the Weld County Zoning Ordinance. Other duties may be assigned by the Lead Inspector. B. Oualification Requirements Electrical Inspector represents that he possesses the following knowledge and education and/or experience: Page 2 of 5 Pages Knowledge Thorough knowledge of current building and electrical construction methods, materials, principles, practices, tools and equipment. Thorough knowledge of applicable building codes and ordinances. Ability to read and interpret plans, specifications and blueprints and compare them with construction in progress. Ability to detect hazards or violations and recommend corrective measures. Ability to administer regulations with firmness, tact and impartiality. Ability to communicate effectively orally, and in writing. Ability to write in a legible manner. Ability to establish and maintain effective working relationships with employees,building owners,contractors and the public. Education And/or Experience High school graduation or equivalent. Four years of practical electrical experience in an inspection area. 5. Parties' Relationship The parties to this Agreement intend that the relationship between them contemplated by this Agreement is that of independent entities working in mutual cooperation. No employee, agent, or servant of one party shall be or shall be deemed to be an employee, agent, or servant of another party to this Agreement. Additionally, the parties hereby acknowledge and agree that Electrical Inspector is not an employee of Weld County, but is providing services as an independent contractor. 6. Insurance Electrical Inspector shall be covered by Weld County's standard liability and workers' compensation insurance while performing the electrical inspection services set forth herein. 7. Non-Assignment This Agreement shall not be assignable without prior written consent of Weld County or Electrical Inspector, whichever is the non-assigning party. 8. Termination Either party may terminate this Agreement for any reason immediately upon notice to the other party. If this Agreement is so terminated, Electrical Inspector shall receive that compensation which duly reflects the actual number of hours during Page 3 of 5 Pages which Electrical Inspector provided services, pursuant to the terms of this Agreement. 9. Modification and Breach This Agreement contains the entire agreement and understanding between the parties to this Agreement and supersedes any other agreements concerning the subject matter of this transaction,whether oral or written. No modification, amendment, novation, renewal, or other alteration of or to this Agreement and the attached exhibits shall be deemed valid or of any force or effect whatsoever, unless mutually agreed upon in writing by the undersigned parties. No breach of any term, provision, or clause of this Agreement shall be deemed waived or excused, unless such waiver or consent shall be in writing and signed by the party claimed to have waived or consented. Any consent by any party,whether express or implied, shall not constitute a consent to, waiver of, or excuse for any other different or subsequent breach. 10. Severability If any term or condition of this Agreement shall be held to be invalid, illegal, or unenforceable, this Agreement shall be construed and enforced without such a provision, to the extent this Agreement is then capable of execution within the original intent of the parties. 11. Records Each party agrees to keep any and all records and information confidential, in compliance with all laws and regulations concerning the confidentiality of such records. 12. Inurement This Agreement shall inure to the benefit of the heirs, assigns, and successors in interest of the parties hereto. 13. No Third Party Beneficiary Enforcement It is expressly understood and agreed that enforcement of the terms and conditions of this Agreement and all rights of action relating to such enforcement shall be strictly reserved to the undersigned parties, and nothing contained in this Agreement shall give or allow any claim or right of action whatsoever by any other person not included in this Agreement. It is the express intention of the undersigned parties that any entity, other than the undersigned parties, receiving services or benefits under this Agreement, shall be deemed an incidental beneficiary only.
