WELD _COUNTY COUNCIL

The Weld County Council met in regular session in full conformity with the Weld
County Home Rule Charter at the Weld County Centennial Center, 915 10th St.,
Greeley, CO, Tuesday, June 17, 1997, 6:30 p.m..
ROLL CALL: The meeting was called to order by President Pam Malcom. Vice
President Judy Curtis, Councilman Dan Oster, and Councilman Al Roberts were
present, constituting a quorum of the members. Councilman Ralph Campbell was
excused. Also present: Nickey Jean Wilson, Kerry Patrick Jarvis, Sharon Hopper,
Janet Meisinger, and the Council secretary, Bev Thomas
APPROVAL OF MINUTES: Councilman Dan Oster made a motion to approve the May
20, 1997 meeting minutes. Councilman Al Roberts seconded the motion and it was
approved unanimously.
ADDITIONS TO THE AGENDA: There were no additions to the agenda.
APPOINTMENTS: Councilman Al Roberts will attend the July 14 Elected Officials
Meeting if he is in town. Councilman Dan Oster will participate in the July 15 KFKA
Coffee Break at 9:00 a.m. The July 15, 1997 Council meeting will be at 6:30 p.m. at
Weld County Centennial Center, 915 10th Street, Greeley, CO, rather than at Gilcrest,
CO.
CORRESPONDENCE: The Council reviewed the correspondence. Each member
received a packet of parliamentary procedure information from Parliamentarian Art
Willis.
COORDINATOR REPORTS:
Drainage Problem
Councilman Dan Oster reported that on June 5, 1997 he received a telephone call from
a County resident in the Barnesville area. The resident had 18" of water covering his
yard due to a recent storm and a plugged County culvert. The resident was frustrated
by the lack of response to the problem from Weld County. After inspecting the
situation, Councilman Dan Oster contacted Dave Becker of Weld County Road and
Bridge with concern regarding Weld County's liability for the problem. Subsequently
County personnel arrived and pumped out the water, and later replaced the culvert.

UNFINISHED BUSINESS:
July 4 Stampede Parade
Councilman Dan Oster and Councilman Al Roberts will each check on the use of a
vehicle of vintage earlier than 1940 for use by Weld County Council in the July 4
Stampede Parade. President Pam Malcom will contact Jerry Pickett regarding the
Council's proposed parade entry.
Review of Weld County Finance Corporation
Councilman Al Roberts made a motion to table the review of the Weld County Finance
Corporation until the December 31, 1996 -audit of Weld County is available for the
Council's review. Vice President Judy Curtis seconded the motion and it carried.
NEW BUSINESS;
Adoption of Council's 1998 Proposed Budget
Councilman Dan Oster moved that the Council adopt the 1998 proposed budget as
follows: Personnel Services: 12,000.00

Councilman Al Roberts seconded the motion and it carried unanimously.
Payment of the Bills
Councilman Dan Oster made a motion to pay the following bills:
Mileage for Councilman Al Roberts $28.08
Mileage for Councilman Dan Oster $22.68
Mileage for Vice President Judy Curtis $23.22
Councilman Al Roberts seconded the motion and it carried unanimously.
PUBLIC COMMENT: Sharon Hopper pointed out that if Weld County has to pay The
Villa for architectural plans for the proposed pre -parole prison in Dacono, Weld County
would then own those plans and they could not be used again by The Villa. Also, she
felt that if the architectural plans were the same plans that had been used to build the
Weld County jail that was a conflict that should be addressed.

Mrs. Hopper gave an article to the Council from the Longmont Times Call May 25,1997
regarding the Town of Firestone annexing a portion of Weld County Road 22. She
stated that rural Weld County residents feel that if they are going to remain rural they
need to keep their roads rural. The eighteen Weld County residents living along the
section of the WCR annexed by Firestone had signed a petition requesting that their
road remain a County road. Sharon said that the citizens' petition was not recognized
by the Board of County Commissioners and once again the will of the County citizens
was ignored.
Mrs. Hopper also wanted in the record her concern about the apparent lack of
contractual agreements between the Weld County Commissioners and the Weld
County Finance Corporation. She further noted that no where in the Weld County
Finance Corporation minutes was Bruce Barker appointed to serve as the secretary of
the Weld County Finance Corporation.
Nicked Jean Wilson stated that no where did he see a corporation seal on the
documents of the Weld County Finance Corporation. Mr. Wilson asked questions
about how the transactions between the Commissioners and the Weld County Finance
Corporation took place. Mr. Wilson asked to be able to examine any contracts or
communiques between the Weld County Finance Corporation and the Board of County
Commissioners. Councilman Dan Oster encouraged citizens to contact Weld County's
Finance Director or the Board of County Commissioners to clarify the financing
procedure used by the County.
Janet Mesinger read to the Weld County Council a Declaration of True Facts -
"Constitutional Reservation of Rights, Refusal of Responsibility and Demands." She
also presented a copy of the document to the Weld County Council. Mrs. Meisinger
stated that the County uses certificates of participation to get around the will of the
people which is criminal. Certificates of participation are also used to "get around the
laW' which is breaking the law. Janet asked the Council to prove to her that no public
officials are making money from the arrangement between the Weld County Finance
Corporation and the Board of County Commissioners. She also asked to see the"trust
deed" that is surely involved in the certificates of participation initiated by the Weld
County Finance Corporation.
After one hour of public input and dialogue with the Council, Vice President Judy Curtis
moved to close public comment. Councilman Dan Oster seconded the motion, and it
carried unanimously.
Secretarial Research Requests
Each Council member received a copy of the May 20, 1997 revised Weld County
Council's Rules and Regulations.
