HomeMy WebLinkAbout630202.tiff• 4448219 ABANDON AND VACATE A PORTION OF COUNTY ROAD NO. 84: BOOk'Th4 ) PAGE 427 WHEREAS, The Weld County Municipal Airport Board has submitted a petition for the abandoning and vacating of a portion of County Road No. 84, more particularly described as follows: That portion of County Road No. 84 between Sections 2 and 3, Township 5 North, Range 65 West of the 6th P.M., running — North from the present County Road designated Colorado Highway No. 263, for a distance of 350 feet; said portion of road to be vacated and abandoned from 200 feet south of the center line of the runway, and 150 feet north of the center of the runway, measured perpendicularly. and WHEREAS, a public hearing was duly held in the office of the Board of County Commissioners at 2:00 p.m., May 3, 1963 for the purpose of hearing objections, if any, to said abandoning and vacating of said portion of County Road No. 84, and WHEREAS, there appeared no objectors to said petition for abandoning and vacating said portion of County Road No. 84, and the Board of County Commissioners therefore believes it to be in the best interests of the County to abandon and vacate that portion of County Road No. 84 between Sections 2 and 3, Township 5 North, Range 65 West of the 6th p.m., as herein described. NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, Weld County, Colorado, that the aforementioned portion of County Road No. 84 be abandoned and vacated as follows: that portion of County Road No. 84 is and shall be vacated from 200 feet south of the center line of the runway, and 150 feet north of the center line of the runway, measured perpendicularly. A special meeting of the Board of County Commissioners, Weld County, Colorado was held in the Weld County Courthouse, office of the Board of County Commissioners, on May 3, 1963 at 2:00 p.m., for the purpose of hearing objections, if any, to the proposed vacating and abandoning of a portion of County Road No. 84. Present at the hearing were: Millard H. Ewing, Chairman of the Board Tom V. Reed, Commissioner for District No. 1 Samuel S. Telep, County Attorney Deputy County Clerk Interested persons in attendance: Tom A. Barber Robert W. Noffsinger C. W. Bessee Albert H. Purdy, Jr. R. A. Peterson Richard H. Tatman E. H. Mr. Peterson asked for clarification of the exact proposed location of the i,andonment of the road, and asked about the relocating of a road. Mr. Reed explained that another road would be improved just one mile West of the existing Airport Road. Mr. Noffsinger asked if this road would be built whether or not the petition for abandonment is granted. Mr. Reed stated that it would be built in any event, as he believed that the people living in that area were entitled to a better access road to Greeley. An open discussion was held, v,ith various people participating, and Mr. Ewing then asked for a vote from all those in favor of abandoning the portion of County Road No. 84 as petitioned. Dick Tatman was the only vote in the affirma- tive. He went on to explain in his capacity as Secretary of the Airport Board, the purpose for the petition, stating that FAA would not approve the Airport as it is, and would not grant federal funds until the airport meets with strict federal specifications. He stated that there is no appeal to these qualifications. Mr. Bessee stated that he was objecting to the vacating strenuously on the grounds that he would actually lose access to his property on the South side. Mr. Noffsinger stated that he would lose a silo, and that he was in a pecular position. H e was a member of the Airport Board, and was also a property owner in the immediate vicinity, and would in fact, lose his silo. Mr. Barber asked Mr. Bessee if he would object if it could be arranged so that he would not lose his access road. Mr. Bessee stated no, providing that other changes were not made, including water backing up. Mr. Tatman stated that it was illegal to dam any natural drainage, and if this seemed impossible to avoid, they would build a bridge in the area, and that Mr. Bessee v,ould suffer no hardship whatsoever in connection with the abandonment, providing the footage could be shortened. 2. Mr. Bessee stated that very little of his land had been taken previously. Mr. Reed asked that if assurance could be given that the road would be maintained, providing that it is vacated, and with no loss to Mr. Bessee, if he would still object to it. Mr. Bessee stated that he didn't want to stand in the way of progress, but on the other hand, didn't want a hardship to himself. He felt though, that he would be in favor of the abandonment, providing he didn't lose access to his land. Mr. Reed guaranteed maintenance of the road ---though not as fully as before, since it would not be a through road. Mr. Barber explained that the FAA has certain glide patterns to which they adhere, and that he thought 400 feet was the minimum. A telephone call was made, and Mr. Barber then suggested that Dick Tatman call to get the exact minimum for a glide pattern. Mr. Telep suggested that Mr. Peterson be allowed to voice his views, and Mr. Peterson stated that he was not in favor of the petition as it stands. He stated that he tended to lose all and gain nothing. Mr. Bessee asked chat would happen if the road is closed and someone would get the idea of moving his fence line out to the middle of the line. Mr. Telep stated that once a road is vacated, naturally that portion goes on the tax list of the immediate owner, and he gets his part, that is the law in the state of Colorado. Mr. West asked who would maintain the road. At this point, Mr. Reed told them that they were asking for two things: they were asking that a portion of a county road be closed, and in the same breath were asking for maintenance of it. Mr. Reed stated again, that the road would be maintained by the county much as it is now, but less frequently, since it would not be a through road. Mr. Telep asked whether the federal government would go along with the airport as it stands. Mr. Tatman stated flatly that they wouldn't. If the road is not abandoned, the matter will be closed as far as the federal government is concerned. Mr. Telep said that if all would cooperate, he felt this matter could be settled amicably. He said further, that rarely did the Commissioners get credit for the good things they do, but everyone leaped on them if they made a mistake. He stated further that in his own personal opinion, the less the government was involved in anything ---the better. Mr. Tatman stated that the state agencies of the FAA were helpless in the face of problems such as this, that the federal government set up flying rules. Dick Tatman called to confirm that 350 feet would be adequate, and once this was resolved, the landowners in the immediate area, with Mr. Telep's help, found that the matter could be settled amicably, and this was done. The final decision was that 350 feet of County Road No. 84 be abandoned from 200 feet south of the center line of the runway, and 150 feet north of the center of the runway, measured perpendicularly. The meeting adjourned at 3:15; Mr. Telep had suggested to Mr. Peterson that he quit claim hiwaynd either to the county or the airport• as he would lose the use of more of his road/than anyone else, and when the road is vacated, the adjoining landowner is automatic owner of that portion abandoned. ROAD PETITION TO THE HONORABLE BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY, COLORADO. GENTLEMEN: The Weld County Municipal Airport Board respectfully represents that the necessities of the public require that a public highway be constructed, pursuant to and in accordance with that Resolution of the Board of County Commissioners of the County of Weld, State of Colorado, passed and adopted on the 12th day of October, A.D. 1889, which resolution has been duly recorded; and the Board further represents that the public safety and the directives of FFA require that, if the airport is to be properly classified and improved, that portion of the present county road below described immediately adjacent to west end of present east -west runway be closed. Now, therefore, the Board petitions your honorable body to close that portion of the present county road existing between Sections 2 and 3, Township 5 North, Range 65 West of the 6th P.M., running north from the present county road designated Colorado Highway No. 263, for a distance of 400 feet beginning approximately 2250 feet north of intersection of said road with Colorado Highway No. 263, and relocate said road between Sections 3 and 4, Township 5 North, Range 65 West of the 6th P.M., running north from the present Colorado Highway No. 263.
