RE: APPROVE CONTRACT AMENDMENT NO. 2 FOR HEALTH EDUCATION
STANDARDS BETWEEN HEALTH DEPARTMENT AND COLORADO DEPARTMENT
OF PUBLIC HEALTH AND ENVIRONMENT AND AUTHORIZE CHAIR TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with Contract Amendment No. 2 for Health
Education Standards between the County of Weld, State of Colorado, by and through the Board
of County Commissioners of Weld County, on behalf of the Weld County Health Department,
and the Colorado Department of Public Health and Environment, effective October 15, 1996,
with further terms and conditions being as stated in said amendment, and
WHEREAS, after review, the Board deems it advisable to approve said amendment, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Contract Amendment No. 2 for Health Education Standards
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Weld County Health Department, and the
Colorado Department of Public Health and Environment be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said amendment.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 7th day of October, A.D., 1996.

CONTRACT AMENDMENT NO. 2
THIS AMENDMENT, made this 1st day of October, 1996, by and between the State of
Colorado for the use and benefit of the Colorado Department of Public Health and Environment
4300 Cherry Creek Drive South, Denver, Colorado 80222-1530 hereinafter referred to as the
State, and Weld County Health Department, 1517 16h Ave. Ct. Greeley, CO 80631 hereinafter
referred to as the contractor.
FACTUAL RECITALS
Authority exists in the Law and Funds have been budgeted, appropriated, and otherwise made
available and a sufficient unencumbered balance thereof remains available for payment in Fund
Number 100, Appropriation Code F86, Contract Encumbrance Number ADM 960540 FAA; and
Required approval, clearance and coordination have been accomplished from and with appropriate
agencies; and
The parties entered into a contract dated October 1, 1995, with contract encumbrance number
ADM 960540,contract routing number 9650540, and amended the contract on March 1, 1996,
contract routing number 96-05345, hereinafter referred to as the "Original Contract". The
Original Contract is attached hereto as Exhibit A and incorporated herein by the reference.
The Original Contract is being amended to reduce the dollar amount of the Original Contract from
$22,800 to $20,839 because of a reduction of federal Prevention Block funds available to the
State.
NOW THEREFORE, it is hereby agreed that:
1. Consideration for this Amendment to the Original Contract, CE Number ADM 960540,
Contract Routing Number 960540, dated October 1, 1995, consists of the payments which shall
be made pursuant to this Amendment and the promises and agreements herein set forth.
2. It is expressly agreed by the parties that this Amendment is supplemental to the Original
Contract CE Number ADM 960540, Contract Routing Number 960540, dated October 1, 1995,
and Contract Amendment 1, dated March 1, 1996, contract routing number 96-05345, which has
been incorporated as Exhibit A, and all terms, conditions, and provision thereof, unless

specifically modified herein, are to apply to this Amendment as though they were expressly
rewritten, incorporated, and included herein.
3. It is agreed the Original Contract is and shall be modified, altered, and changed in the
following respects only:
a. The parties hereby agree that the Original Contract shall be reduced by $1,961.00
to a new total of$20,839.00 and that paragraph 5 shall be changed accordingly.
4. The effective date of this Amendment is October 15, 1996
5. Except for the"Special Provisions" and "General Provisions," in the event of any conflict,
inconsistency, variance, or contradiction between the provisions of this Amendment or any of its
attachments or exhibits, and any of the provisions of the Original Contract, the provisions of this
Amendment shall in all respects supersede, govern, and control. The "Special Provisions" and
"General Provisions" shall always be controlling over other provisions in the contract or
amendments. The factual representations in the Special Provisions concerning the absence of
bribery or corrupt influences and personal interest of State employees are presently reaffirmed.
6. FINANCIAL OBLIGATIONS OF THE STATE PAYABLE AFTER THE CURRENT
FISCAL YEAR ARE CONTINGENT UPON FUNDS FOR THAT PURPOSE BEING
APPROPRIATED, BUDGETED, AND OTHERWISE MADE AVAILABLE.
7. THIS AMENDMENT SHALL NOT BE DEEMED VALID UNTIL IT SHALL HAVE
BEEN APPROVED BY THE CONTROLLER OF THE STATE OF COLORADO OR SUCH
ASSISTANT AS HE MAY DESIGNATE.

Subject:
Amendment No. 2 to the Health Education Standards Contract
Enclosed for Board approval is Amendment Number Two to the Health Education Standards
Contract between Weld County Health Department and the Colorado Department of Public
Health and Environment.
In December 1995,the Board approved the contract which is funding a half-time health
education specialist to help local health departments perform an agency assessment of capacities
to do health education functions. In May 1996, the Board approved Amendment Number One
which changed the start and stop dates of the contract. Amendment Number Two will reduce the
amount of funding by 8.6% ($1,961) from $22,800 to $20,839 because of a reduction of federal
Prevention Block funds available to the State. The Health Department was notified earlier this
year of this reduction in funding and has made budget adjustments accordingly.
I recommend approval of this amendment.
