The terms of this conservation easement are as follows: 1 . The Grantor shall not erect residential structures or structures which are not accessory to an agricultural use. 2. The Grantor shall not divide the Property into two or more parcels, separate interests or interests in common unless such division is exempted under C.R.S.. § 30-28-101O0) and the Weld County Subdivision Ordinance. 3. Agriculturally related buildings and structures are permitted if: (i) they are not used for residential purposes; (ii) they are constructed and used as accessory structures to a single principal use of agriculture; and (iii) they are determined to be in accordance with county land use regulations under presently existing zoning. However, it is the intention of this Easement not to limit Grantor(s)' discretion to employ their choices of farm and ranch uses and management practices so long as those uses and practices are consistent with the purpose of this Easement. 4. No hunting or fishing shall be allowed on the Property except strictly in accordance with Colorado game and fishing laws by licensed hunters and fishermen. The Grantee shall have the right to enter upon the Property to inspect for violations of the terms and covenants of this easement End to remove or eliminate any conditions or operations which violate the same, by injunction, if necessary. No further right of access, entry or possession is conveyed hereby. Such entry shall be made in a manner that will not unreasonably interfere with Grantor(s)' use and quiet enjoyment of the Property. No right of entry is created for any member of the public or any third party to this easement. 6. This easement shall run with the land and shall remain an easement on the land until terminated or transferred by the Grantee according to one of the following provisions: (a) Termination: This easement may be terminated pursuant to C.R.S., § 38-30.5-107. (b) Transfer: With the consent of the Grantor, the Grantee may transfer this easement to a governmental entity or to any other charitable organization exempt under Section 501(03) of the Internal Revenue Code of 1986, as amended, or any subsequent revision thereof, which organization was created at least two years prior to the transfer, provided: (1) such transfer is consistent with the current county comprehensive plan and county land use and subdivision regulations: and (2) the Grantor receives compensation equal to the fair market value of the easement less costs of transfer, or waives such compensation. 7. The provisions hereof are binding upon and shall inure to the benefit of the parties hereto, their successors, assigns, heirs and personal representatives, and all persons who may hereafter acquire an interest in the Property or any part thereof. It is intended that the conservation easement herein granted and any other interest created under this Agreement vest immediately. If any future interests in land are created, those interests shall vest, if at all, within the lives of the individuals who have executed this document, plus 20 years. 8. Nothing contained in this Easement shall be construed to entitle Grantee to bring any action against Grantors for any injury to or change in the Property resulting from causes beyond Grantors' control, including, without limitation, fire, flood, storm, and earth movement, or from any prudent action taken by Grantors under emergency conditions to prevent, abate, or mitigate significant injury to the Property resulting from such causes. 9. Morrison, Assistant Weld County Attorney Brief description of t c roblem/issue: Conservation Easement for Jack and Marilyn Bedford The Bedford's have applied for and received a conditional approval of the recorded exemption generally in the southwest quarter of section 35, T5 NR 66W which is generally along the South Platte River. Lot A of the conditionally approved recorded exemption is not particularly useable as a residential site due to its proximity to the river. The goal was to obtain that ten acre site for pasture(Lot A)and the recorded exemption was based on the representation that it would not be used for a residential site. Because there are subdivision and zoning regulations that provide that each lot of a recorded exemption is a legal building site for a residence, something other than a note on the plat of a recorded exemption is required to assure that the representation that Lot A was not to be used as a residence would be kept. Recommendation to the Board: I recommend to this staff that they obtain a conservation easement for that lot. The Bedfords have proposed providing a conservation easement to Weld County for the entire Lot A. This particular conservation easement does not make Weld County responsible for maintenance or upkeep of the property and the Bedfords have assumed all liability as property owners should personal injury occur on the property. The County's only role is to enforce the provision that no residential structures or structures that are not accessory to an agricultural use can be constructed on Lot A. The County is not obligated to inspect at any particular time and could inspect based only on complaints but also could use this easement as a basis for locking out building permits on the County computer system. The County's role is similar to enforcement of a condition in a special review permit. Approved with Conditions The Department of Planning Services has determined through the review, that the standards of Section 11.4.2.1 through 11.4.2.6 of the Weld County Subdivision Ordinance have been met. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations. 2. Prior to recording the plat: A. In accordance with Weld County Public Works Ordinance #180, Lot A shall be granted one residential/agricultural access. Lot B shall utilize the existing residential and agricultural access points. No circle drives or additional accesses shall be granted. B. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld County Public Works Department to determine if a culvert is necessary at any approved access point. C. The Conservation Easement shall be recorded in the office of the Weld County Clerk and Recorder and a copy be filed with the Department of Planning Services. D. The parcel will indicate, on the plat, a dedicated, private easement or a deed to provide adequate access to the parcel. Section line accesses are considered private lanes with no county maintenance. E. The following notes shall be placed on the plat: 1) All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. 2) Any future structures or uses on site must obtain the appropriate zoning and building permits. 3) All construction or improvements occurring in the flood plain as delineated on FEMA Community Panel Map 080266-0750C, dated September 22, 1982, shall comply with the Flood Hazard Overlay District requirements of Section 26 of the Weld County Zoning Ordinance. 4) The installation of any septic system within the 100-year flood plain shall comply with the Weld County I.S.D.S. flood plain policy. Flood Plain Policy Septic systems will not be allowed to be located in the floodway. Septic systems will be allowed in the flood plain, but the system must be installed in a manner as to prevent the infiltration of groundwater into the septic tank and to prevent the release of sewage from the tank during a flood event. If the tank is above the flood plain elevation, no special installation requirements would be necessary. If the tank is not above the flood plain elevation then the access to the tank manhole lids must be covered with 20 mil PVC and sealed with plumbers cement. When the seal is broken, i.e. the tank is opened for pumping, etc., the tank must be re-sealed prior to backfilling again. A backflow preventer or one-way valve, must also be installed in the effluent line between the tank and the absorption field. All other percolation and suitable soil criteria must be met for a conventional septic system to be installed. For inspection purposes, the materials to seal the manhole lids must be on site. The manholes are not required to be sealed at the time of inspection in order to allow for the inspection of tcc's in the tank. The City of Greeley Planning staff has reviewed the application for a recorded exemption from Jack Jay Bedford located northeast of WCR 50 and 33 and wish to forward the following comments to you. Resolution 7, 1985, by the City of Greeley Planning Commission (see attached) gave administrative review authority to the Greeley Planning staff for review of recorded exemptions. The resolution indicates we cannot recommend approval on any application where the overall gross density exceeds one dwelling unit per 20 acres outside the 2010 growth ring. Since this application appears to create two buildable lots through the exemption process on a 94 acre parcel, we can recommend approval of the request based on Resolution 7. Planning staff did note the creation of an additional parcel for a simple lot line adjustment seems inappropriate. This site is distant from the City limits and areas we are likely to grow into. Additionally, incorporating this type of development into municipalities in the future is difficult at best. The Public Works Department noted a reservation of a minimum of 50' of right-of-way from the centerline of the proposed property line separating Lots A and B would be appropriate to facilitate future development of this area if the proposal is approved. In addition, it appears that some of this site is impacted by floodplain. It may be appropriate to locate that information on the site plan. To reiterate, the City of Greeley believes this request can be approved based on density, although several elements of the proposal do not seem appropriate.
