APPLICATION NO. 478 The following sets forth a description of the proposed operation and use of the property under consideration for an Amended Use by Special Review Permit: The purpose of this application is to amend U.S.R. No. 478, which was approved on November 4, 1981. The approved application authorized the Applicants to operate a greyhound breeding, raising and training facility in the area south of the Stanley Ditch, in the N$NE4, Section 35, Township 1 North, Range 68 West of the 6th P.M. The approved application granted the owners of the property the right to operate a facility with a maximum capacity of 300 animals. The reason for this Amendment is that the partners who operate the greyhound facility have determined that it is a better practice to separate the brood stock and stud animals from the younger, racing population. The breeding animals have been moved to the north part of the 76 acre tract, while the racing stock have remained south of the Stanley Ditch. The partners have discovered that keeping these populations together can cause undue stress to the breeding stock and can inhibit the daily care routine for racing animals. The approved U.S.R. did not allow for the placing of animals in facilities on the north part Df the property, north of the Stanley Ditch. The Applicants were unaware that the authorized permit restricted the animals and facilities to the property south of the Stanley Ditch. The Applicants in no way wish to have the Use by Special Permit altered to allow anything other than the continued operation of a greyhound breeding, raising and training facility. The Applicants now wish, however, to have the permit amended to allow for the placing of several structures north of the Stanley Ditch, for purposes of housing the brood stock and stud animals. Two mobile homes have been placed north of the Stanley Ditch to house these greyhounds. The younger, racing population, will remain south of the Stanley Ditch. As mentioned above, the Applicants desire to make this change, as experience has shown that separation of these classifications of the greyhounds is beneficial to all. In accordance with the Special Review Permit issued in 1981, no more than 300 animals will be housed upon the entire 76 acres. The majority of these greyhounds will be the younger, racing animals, which will be housed south of the Stanley Ditch. Most of these greyhounds will be under the age of 15 months, and training of these greyhounds will occur primarily during the ages of 10 to 15 months, during which time the proposed sprint field and training track would be used extensively. Once trained, these greyhounds would either be sent to out-of-state tracks in order to run, or be kept on the farm to race on the Colorado circuit tracks. At present, one person operates the entire facility. To date, the operation has never exceeded 100 animals. This one person resides in the home north of the Stanley Ditch. It is projected that the operations would require two persons in the next several years. It is anticipated that if the operation ever reaches the maximum of 300 animals, that the operation could employ five people in total. Three of these persons would be on a full—time employment basis, and the remaining two would be on a part—time basis. The hours of operation of the facility would be 7:00 a.m. to 9:00 p.m. The first "turnout" of the animals would be at 7:00 a.m., and the training and other operations would be conducted between 7:00 a.m. and 9:00 p.m. At 9:00 p.m., the last "turnout" of the animals would occur. The nearest residence to the north of the site under consideration is one -quarter mile away. To the west there is a party residing in a mobile home, which home is approximately 1,000 feet to the west of the site under consideration. To the south of this site is another mobile home residence, which residence is approximately 800' south of this site. To the east of this site lies the 950452 Northglenn Sewage Plant, and there are no residences near this site in an easterly direction. Access to the property is by virtue of Weld County Road 11 which borders the property on the east. There is no need for easements to the property because the location of County Road 11. The frequency of vehicular traffic upon the property is low, as the only vehicles which need to enter the property are those driving to the residences on the property and those transporting the animals and trash removal service. The vehicles normally coming on the property are passenger vehicles, pick-up trucks and an occasional dumptruck for removal of trash. The waste generated by the greyhounds will be collected from the turnout pens after each turnout during the day. There are four turnouts during each day. The waste will be stored in commercial dumpsters and collected on a regular basis by commercial trash collectors. Air and water pollution are virtually non-existent, and, although greyhounds will bark from time to time, the Applicants' past experience shows that greyhounds sleep during the evening and night, on the same schedule as most humans. As a result, the Applicants believe that noise pollution should be minimal. The Applicants would note that immediately to the east of the subject property is the City of Northglenn Sewage Treatment Plant. Further, the Applicants have not received complaints from neighbors concerning noise. There are currently three permitted wells drilled upon the 76 acres included in the site under consideration. In the opinion of the Applicants, these wells are sufficient to supply the water needed for the domestic needs of the residences upon the property and the needs of servicing the greyhounds. The Applicants would note that greyhounds by nature use very minimal water, as they are shorthaired and are self-cleaning animals. Therefore, it is not necessary to give them bathes. It has been the experience of the Applicants since 1981 that the water available to the subject property is sufficient for this operation. The residence which has been built upon the property north of the Stanley Ditch was erected in 1983. It utilizes a septic tank for sewage purposes. The septic tank permit for the residence north of the Stanley Ditch is No. 83-0080. The residence which lies south of the Stanley Ditch has Septic Tank Permit No. G721120. The mobile homes which have been placed upon the north half of the property are not used by humans, but, rather, are utilized solely for the housing and caretaking of the brood stock and stud animals. The site in question is located within the Erie Fire Protection District, and receives its fire services from that district. In addition, and in accordance with the rules and regulations of the Colorado State Racing Commission, each of the shelters or mobile homes which house greyhounds is equipped with at least one fire extinguisher. The Applicants have utilized this property as a greyhound facility since 1981 and have experienced no ill effects from any storm water drainage. The Applicants believe that the vast majority of the storm water upon the property is absorbed into the surface, as most of the area under consideration remains in native vegetation. Very little of the surface area has been converted from anything other than those mode of vegetation, as only the homes, mobile homes and patios for those homes do not absorb water. The Applicants believe that the vast majority of any run—off from the site would drain into the Stanley Ditch. Further, the Applicants have undertaken no landscaping or erosion control efforts, as they have experienced no difficulties whatsoever with those matters. As stated above, most of the subject property remains in native vegetation. 950462 SUPPORTING STATEMENT AND DOCUMENTS REGARDING AMENDED U.S.R. APPLICATION NO. 478 The applicants' amended proposal is consistent with the Weld County Comprehensive Plan, as it does not create any additional residences or businesses, and it continues the use of the property in primarily an agriculturally related endeavor. The subject property is zoned agricultural, and the property in the surrounding area is likewise zoned agricultural. The site in question consists of non -irrigated ground. The vicinity has a low density population. The proposal is likewise consistent with the intent of the district as it continues the use of the property in the same manner as which it has been used for a number of years. The property for which the amended U.S.R. is sought consists of dryland, and this property will now be placed to better and fuller use as facilities for breeding, raising and training greyhounds. There is adequate provision for the protection of the health, safety and welfare of the inhabitants of the neighborhood and the county, as the facility has been and will continue to be operated in a professional manner, and all of the animals located upon the facility are fenced from outside intervention or are housed safely in mobile homes or buildings. The uses sought by this amended U.S.R. will be compatible with the existing surrounding land uses as the adjacent properties are used primarily for agriculture and for sewage treatment. The applicants would note that a number of the adjacent landowners executed consents to the applicant's Petition for U.S.R. in 1981. The proposed use will be compatible with the future development of the surrounding area and with future development as projected by the Comprehensive Plan of the County, as it does not interfere in any way with the present plans of the municipalities in the area near the site, and the amended U.S.R. does not create a new residence which would pose demands upon the County's services. The area under consideration is not located in a floodplain, geologic hazard or Weld County Airport overlay district. The water supply available to the property is adequate in terms of quantity, quality and dependability, as evidenced by the fact that the water supply has been satisfactory for the last seven years for the same purposes for which this amended permit is sought. There are presently three permitted wells located upon the 76 acres comprising the property under consideration. The water well permit for the well north of the Stanley Ditch is No. 133371. The two wells south of the Stanley Ditch have permits No. 63132 and 124684—A. Copies of the deeds whereby the applicants acquired title to the subject property are attached hereto. In addition, attached hereto is a description of the soils located upon the subject property and a vicinity map showing the subject property's location relative to the remainder of Section 35 and adjacent sections. The mobile home located in the southwesterly portion of the 76 acre tract was shown in the 1981 Special Review Application in the same site, and it was approved in that Special Use Permit Application. That mobile home was occupied by a gentleman known as David Trostle. Mr. Trostle solicited and obtained from Richard and Marcia Chana a deed to a one acre tract in which the mobile home lies. The Chanas had previously deeded the small tract in the 76 acres prior to the adoption of the Weld County regulations concerning the conveyance of agricultural property in lots smaller than 80 acres. The Chanas once again deeded such property without a recorded exemption being first obtained. The Chanas are prepared to cooperate and assist the county in any reasonable way to address the problem of the conveyance to Mr. Trostle.
