RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST JAY AND DENISE GEGENHEIMER FOR VIOLATION OF
THE WELD COUNTY BUILDING CODE ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Jay and Denise Gegenheimer, VI #9600190, are allegedly in violation of the
Weld County Building Code Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 7th day of January, 1997, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Jay and Denise Gegenheimer were not present or represented at said
hearing, although all parties were notified of said hearing by Department of Planning Services
staff, and
WHEREAS, the Board deems it advisable to bring legal action against those individuals
as hereinabove named to correct said violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Weld County Attorney be, and hereby is, authorized to
proceed with legal action against Jay and Denise Gegenheimer to remedy the violation of the
Weld County Building Code Ordinance, and any other persons occupying the properties, any
persons claiming an interest in the properties, and any persons acting in active concert with the
identified parties.

December 16, 1994 Last inspection where were capable of gaining entry to the home.
November 13, 1995 Progress inspection. No one was home. Left correction notice that the
installation had to be completed by November 30, 1995.
January 11, 1996 Five Day compliance encouragement letter.
August 20, 1996 Ten Day compliance encouragement letter.
September 25, 1996 Violation Notice Issued.
October 8, 1996 Board of County Commissioner's Hearing - Violation continued to
January 7, 1997.
December 19, 1996 Progress Inspection. No one home. Left a correction notice telling the
property owner that the final electric, plumbing, mechanical and
building inspections had not been performed and approved. In
addition the skirting was not completed.
December 19, 1996 Telephone call. No answer, phone not in service.
December 26, 1996 A certified letter sent to property owner with same information as above.
As of January 2, 1996 return certificate not received.
The failure to complete the installation of this home is a violation of Section 70.4.2 of the Weld
County Building Code Ordinance. To bring this property into compliance the owner must install
the skirting, and have the final electrical, plumbing, mechanical and building inspections
conducted and approved.
The Department of Planning Services also recommends that the County Attorney authorize
legal action against any other persons occupying the properties, any persons claiming an
interest in the properties, and any persons acting in active concert with the identified parties.

On December 12,1996 I attempted to conduct the final inspections on the installation of the
mobile home located at 47256 WCR 96. No one was at home. I left a correction notice telling
you that the permit for this home had expired on June 13, 1995 and that the following
inspections still needed to be conducted and approved.
1. Final Electric
2. Final Plumbing
3. Skirting
4. Mechanical
5. Final Building
The Board of County Commissioners at the hearing conducted on October 8, 1996 continued
the violation to January 7, 1996. If the installation and inspections are not completed prior to
this date, the case will be brought before the Board for their disposition. It is recommended
that you or a representative be present at this meeting which will commence at 10:00 in the
County Commissioners' Hearing Room, first floor, Weld County Centennial Center, 915 Tenth
Street, Greeley, Colorado.

Dear Jay and Denise Gegenheimer
The Weld County Building Code Ordinance, Section(s) 70.4.2
requires that the installation of the home be completed within 180 days
of the issuance of the permit. According to our records the appropriate
inspections have not been conducted. This is a violation of the Weld
Weld County Building Code Ordinance.
To remedy this situation, the required inspections must be approved and
a Certificate of Final Inspection issued. If you are unable to correct
this violation, you have the opportunity to meet with the Board of County
Commissioners at a hearing scheduled on 10/08/1996, at 11:00 a.m. to
discuss your concerns. This hearing will take place in the County Commis-
sioners' Hearing Room, first floor, Weld County Centennial Center, 915
Tenth Street, Greeley, Colorado. It is recommended that you or a repre-
sentative be in attendance to answer'any questions the Board may have
concerning this matter.
The Building Inspection Department will be recommending that the Board
authorize the County Attorney's office to proceed with legal action.
