RE: APPROVAL OF RECORDED EXEMPTION #1769 - BAY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under Section
30-28-101(10)(d), CRS, as amended, did determine at a public meeting held in the Chambers of
the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known
as Recorded Exemption #1769, does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land", and
WHEREAS, the request for Recorded Exemption #1769 was submitted by Marvin L. and
Mildred N. Bay, 36986 Weld County Road 49, Eaton, Colorado 80615, for property which is
located in part of the Lot B of Amended RE #370, in part of the NW'/ and part of the E'/ of
Section 1, Township 6 North, Range 65 West of the 6th P.M., Weld County, Colorado, being more
particularly described in the plat which shall be provided by the applicant and known as Exhibit "A",
said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels estimated to be approximately
146 acres and 6 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from
the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1769 submitted by
Marvin and Mildred Bay be, and hereby is, approved conditional upon the following:
1. Prior to recording the Recorded Exemption plat:
a. The applicant shall either:
Submit to the Department of Planning Services a complete Use by
Special Review Permit application for the existing auto service
business on Lot A; or
ii. Close the existing auto service business currently located on Lot A.

b. The applicant shall show on the plat a 30 -foot -wide access easement across
Lot A for the benefit of Lot A of Amended RE #499. Said access easement
shall be dedicated on the plat for the use as shown using the language set
forth in Section 11.7.12.5 of the Weld County Subdivision Ordinance.
2. No additional accesses to the County roads shall be allowed to either Lot A or Lot B.
3. A Weld County septic permit is required for any proposed home. The septic system
shall be installed according to the Weld County Individual Sewage Disposal System
(ISDS) regulations.
4. The applicant shall submit a mylar plat to the Department of Planning Services to
be recorded in the office of the Weld County Clerk and Recorder. The plat shall be
prepared in accordance with the requirements of Section 11.7 of the Weld County
Subdivision Ordinance. The plat shall be submitted within sixty days from the date
of approval by the Board of County Commissioners. The applicant shall be
responsible for paying the recording fees.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 23rd day of August, A.D., 1995.

This request for a recorded exemption is submitted by Marvin L. and Mildred N. Bay. The
parcel of land under consideration is described as Lot B of Amended RE -370 in part of the NW4
and part of the E2 of Section 1, T6N, R65W of the 6th P.M., Weld County, Colorado. The
property is located south of and adjacent to Weld County Road 74 and west of and adjacent to
Weld County Road 49. There are no existing residences on proposed Lots A or B. Lot A
contains a shed which currently houses an unpermitted auto service business; Lot B's primary
use is agricultural production.
North Weld County Water District is able to provide water to both proposed lots. The Weld
County Health Department has indicated no objection to the use of individual sewage disposal
systems on the property. Existing access to Lot A is from Weld County Road 74 and to Lot B
from Weld County Roads 72 and 49. The access on Weld County Road 74 also supplies
ingress and egress to Amended Lot A of RE -499, approximately five acres in size, which is a
land -locked parcel and the site of an abandoned hog operation. An existing 20 -foot wide
access easement (through proposed Lot A of the subject property) is delineated on the RE -499
plat; the easement is approximately 1,596 feet in length.
Recorded Exemption 370, approved by the Board of County Commissioners in 1979, divided a
138 acre parcel into two parcels of 131 acres and 7 acres, more or less. In 1982, Subdivision
Exemption 169 was granted to the applicants, dividing three additional acres from Lot B of RE -
370 in order to create a building site for a dairy employee across Weld County Road 49. Lot B
was changed in size and configuration two more times in 1984 and 1987 through amendments
to RE -370.
Mr. and Mrs. Bay are now applying to further divide the existing 152 acre parcel into two
parcels of 146 acres and 6 acres, more or less. The reason for the request is to sell Lot A as

a homesite for a family seeking residential assistance from Habitat for Humanity.
The Department of Planning Services recommends denial of this recorded exemption based on
noncompliance with the Agricultural goals and policies as stated in the Weld County
Comprehensive Plan. According to Agricultural policy #3, "Conversion of agricultural land to
residential...development shall be discouraged when the subject site is located outside of a
municipality's comprehensive area and activity centers...(This policy) is intended to minimize
the incompatibilities that occur between uses in the agricultural district and districts that allow
urban -type uses." The subject site is not located within an Urban Growth Boundary of any
incorporated municipality in the County. The division of this parcel would create the potential
for two buildable lots on the property. Staff does not see the benefits to the Agricultural zone
district for establishing the potential for increased development at this location. It is the staffs
opinion that this proposal does not encourage or enhance agricultural land uses as intended by
the Comprehensive Plan.
In addition, the Department of Planning Services' staff does not support this request because it
conflicts with efficient and orderly development and does not uphold the intent of the
Agricultural zone district. In the staffs opinion, the level of development that has occurred in
this area is becoming unmanageable for surrounding farmers. The potential for continued
divisions and additional residences will contribute to further encroachment upon agricultural
land uses. Seven recorded exemptions and one subdivision exemption have taken place in
Section 1 (see map A). Since December 1993, three of these recorded exemptions have been
approved by the Board. Fourteen buildable lots have been created through the
recorded/subdivision exemption processes in Section 1; ten of these lots presently contain
residences. The granting of this request will create one additional building site and the potential
for two additional residences on the property. Continued divisions of this type evade the intent
and purpose of the Weld County Subdivision Ordinance.
For the above -stated reasons, the Department of Planning Services recommends that the
Board of County Commissioners deny this recorded exemption request.

SUBJECT: Request from Floyd Oliver to waive Recorded Exemption
application fee and Building permit fens.
Property owner Marvin Bay is requesting that the Board of County Commissioners waive fees for a
-recorded exemption application -and building permits associated with a newly created parcel which
is proposed. The applicant wishes to divide six acres from a 152 acre parcel located in part of
Section 1,T6N, R65W. Seven recorded exemptions have been approved by the County in -Section
1, as well as one subdivision exemption which created a separate parcel. Two of the eight
applications were requested by Mr. Bay and his wife.
According to the letter datediune 8, 1995, and referenced above, the purpose of the request is to
allow the smaller parcel to be used as a future homesite in conjunction with the Habitat for Humanity
program.
The Department of -Planning -Services staff offers the following options to the Board:

Dear Gloria,
Marvin Bay is seeking a recorded exemption Tor a
acreage he owns located East of Eaton. The purpose of the
requested exemption is to make it possible for Marvin to
give a small partial to Habitat for Humanity. Habitat
intends to build -a home on this partial for a family of nine
which needs suitable housing.
As you knew, Habitat for Humanity uses volunteer
workers and -donated material to build housing for families
in need. The receiving family is carefully screened to
qualify for the home. The home is not a gift, but is made
affordable to the family by people, business and trade
donations.
The purpose of this letter is to request on behalf of
Habitat for -Humanity a waiver of Weld County fees in
connection with the requested recorded exemption and
building fees for this home. _Please pass this request on to
persons who have authority to act on this request.
