A public hearing was conducted on September 27, 1999, at 10:00 a.m.,with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated August 27, 1999, and duly published September 1,
1999, in the Fort Lupton Press, a public hearing was conducted on September 15, 1999,
at 10:00 a.m. to consider the request of Shiloh, Inc., % James Scott, Jr., for a Site Specific
Development Plan and Final Plan S #497, for a 24-lot Planned Unit Development, at which time
the Board deemed it advisable to continue this matter to September 27, 1999 at 10:00 a.m.to allow
Department of Planning Services staff adequate time to post a sign on the property. At said
hearing on September 27, 1999, Lee Morrison, Assistant County Attorney, made this a matter of
record. Ben Patton, Department of Planning Services, presented a brief summary of the proposal
and entered the favorable recommendation of the Planning Commission into the record as written.
Mr. Patton gave a brief description of the location and surrounding uses. He stated the lots are
approximately one acre with septic systems;the development will exceed the minimum open space
requirement; the Public Works Department has given preliminary approval of the Improvements
Agreement; and no concerns have been expressed by the surrounding property owners. He further
stated Condition of Approval #1.C should be deleted because it is no longer required, and he
submitted a letter from the Windsor-Severance Fire Protection District stating Condition of Approval
#1.e has been met, therefore it can be deleted. In response to Chair Hall, Mr. Patton stated
Condition of Approval #6.8 is correct because the geotechnical survey will address the type of
foundations required, therefore, the foundations can be built prior to releasing building permits. In
response to Commissioner Geile, Mr. Patton stated the site will be served by the North Weld
County Water District.
James Scott, Jr., represented the applicant and stated he and the applicant have reviewed and
agree with the Conditions of Approval and Development Standards. No public testimony was
offered concerning this matter.

Commissioner Commissioner Vaad moved to approve the request of Shiloh, Inc., %James Scott,
Jr., for a Site Specific Development Plan and Final Plan S #497, for a 24-lot Planned Unit
Development, based on the recommendations of the Planning staff and the Planning Commission,
with the Conditions of Approval and Development Standards as entered into the record with the
deletion of Condition of Approval#1.C. The motion was seconded by Commissioner Commissioner
Baxter, and it carried unanimously.
This Certification was approved on the 29th day of September, 1999.
