RE: APPROVE PURCHASE OF SERVICES AGREEMENT BETWEEN HUMAN SERVICES
FENWC AND COLORADO DEPARTMENT OF HEALTH AND ENVIRONMENT,
MIGRANT HEALTH PROGRAM AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Purchase of Services Agreement
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of Human Services FENWC, and Colorado Department
of Health and Environment, Migrant Health Program, commencing June 19, 1995, and ending
September 1, 1995, with further terms and conditions being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Purchase of Services Agreement between the County of Weld, State
of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of
Human Services FENWC, and Colorado Department of Health and Environment, Migrant Health
Program, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized
to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 21st day of June, A.D., 1995, nunc pro tunc, June 19, 1995.

PURCHASE OF SERVICES AGREEMENT
THIS AGREEMENT, made and entered into this 1.5 day of June, 1995,
by and between the Colorado Department of Health's Migrant Health Program,
hereinafter referred to as "Health Program," and the Weld County Division of Human
Resources' Family Educational Network of Weld county, hereinafter referred to as
"FENWC."
In order to provide medical and dental services to approximately 386 eligible
Migrant Head Start children ages 0 - 5 in the following areas in Weld County:
Frederick, Ft Morgan, and six sites located in Greeley, and the Western Slope
(Olathe & Grand Junction).
FENWC cooperatively enters into this Agreement with the Colorado Department
of Health's Migrant Health Program, such services as defined within will be provided
per this Agreement.
NOW, THEREFORE, in consideration of the mutual covenants herein, the
parties hereto agree as follows:
1. Physical Examinations:
The Health Program will provide physical examinations for eligible Migrant
Head Start children. FENWC agrees to reimburse the Health Program a
maximum of $20.00 per child ($20.00 x 386 children) for the examination
services not to exceed $7,720.00.
2. Personnel services to be provided: Time and Cost Breakdown
All staff will keep accurate time records documenting time allocated to the
FENWC program and billing.
A. Nursing Services:
The Health Program will provide nurses and nursing students to serve
all centers. The services to be provided are defined in the attached
Memorandum of Understanding.
Budgeted time and cost for nursing staff is as follows:
Greeley Sites
1 Nurse (100%) @ 14.20/hr x 536 hrs =$7,611
1 Nursing (100%) @ $12.88/hr x 536 = $6,904
Total of $14,515.00
Frederick Site
1 Nurse (100%) @ 14.20/hr x 536 hrs = $7,611.00
Delta Site
1 Nurse (100%) @ 14.20/hr X 408 hrs = $5,794.00

Grand Junction Site
1 Nurse (50%) @ 14.20/hr x 136 hrs = $1,931
1 Nurse (70%) @ 14.20/hr x 96 hrs = $1,363
Total of $3,294.00
Fort Morgan Site
1 Nurse (50%) @ 14.20/hr x 116 hrs = $1,647
1 Nurse (100%) @ 14.20/hr x 176 hrs = $2,499
Total of $4,146.00
Nursing Coordination/Supervision
Jean Schuhle @ $23/hr x 300 hrs = $6,900.00
(Hourly rate includes fringe benefits)
FENWC agrees to reimburse the Health Program a maximum of $12.88 -
$14.20 per hour for nursing services and 300 hours of
nursing/supervision at $23.00 hour for a total not to exceed $42,260.00.
All staff will keep accurate time records documenting time allocated to
the FENWC program and billing.
B. Health Aides:
The Health Program will provide health aides for all centers. The
services to be providedaredefined in the attached Memorandum of
Understanding.
Budgeted Time & Cost for is as follows:
Fort Morgan
1 Health Aide (50%) @ 6.68/hr x 184 hours = $1,229.00
Greeley
2 Health Aides (100%) @ 6.68/hr x 544 hours/each =
$7,268.00
Frederick
1 Health Aide (50%) @ 6.68/hr x 272 hours = $1,817.00
Western Slope
2 Health Aide (50%) @ 6.68/hr x 184 hours each =
$2,458.00
FENWC agrees to reimburse the Health Program a maximum of $6.68 per
hour for health aides for a total not to exceed $12,772.00 ($6.68/hr x
1,912 hours = $12,772.00).

C. Dental Hygienists
The Health Program will provide dental hygienists to all centers. The
services to be provided are defined in the attached Memorandum of
Understanding.
Budgeted time and cost for dental hygienists is as follows:
Greeley/Frederick
1 Dental Hygienist (50%) @ $11.69/hr x
148 hrs = $1,730.00
Ft. Morgan Site
1 Dental Hygienist (25%) @ $11.69/hr x 60 hrs
= $701.00
Delta/Olathe Site
1 Dental Hygienists (25%) @ $11.69/hr X 70
hrs = $818.00
Grand Junction Site
1 Dental Hygienists (25%) @ $12.88/hr x 84 hrs = $1,082.00
Dental Hygiene Coordination/Supervision/Follow-Up
Kristin Lund @$23/hr x 250 hrs - $5,750.00
(Hourly rate includes fringe benefits)
FENWC agrees to reimburse the Health Program $11.69 - $12.88 per
hour for dental hygiene services and 250 hours of dental
coordination/supervision/follow-up at $23.00 per hour for a total not to
exceed $10,081.00. All staff will keep accurate time records
documenting time allocated to the FENWC Program and billing.
3. Fringe Benefits:
FENWC agrees to reimburse the Health Program a maximum of $6,846.00
for fringe benefits on all seasonal staff noted in this agreement
calculated at approximately 13.05% of gross salary.
4. Dental Services:
The Health Program will provide dental work specified in the attached
Memorandum of Understanding for FENWC centers. FENWC will
reimburse the Health Program a maximum of: $15.00 per child served
up to a maximum of 386 children totalling $5,790.00.

5. Medical Care:
The Health Program will arrange and provide medical care for acute
conditions and follow up on abnormal screening results specified in the
attached Memorandum of Understanding for all FENWC centers. FENWC
agrees to reimburse the Health Program $35.00 per child served up to
a maximum of 386 children totalling $13,510.00. All staff will keep
accurate time records documenting time allocated to the FENWC program
and billing.
6. Pharmacy Services:
The Health Program shall arrange and provide for pharmacy services
to include prescriptions and supplies for all FENWC Centers. FENWC
agrees to reimburse the Health Program a maximum of $12.50 per child
served up to a maximum of 386 children totalling $4,825.00.
7. Travel:
The Health Program will pay summer staff for travel related to fulfilling
this contract including nurses, health aides, and dental hygienists
assigned to all sites. FENWC agrees to reimburse the Health Program
.20/documented mile up to a maximum of $5,800.00.
8. Operating Expenses:
The Health Program will provide direct operating cost to the staff it
employs to fulfill this contract including costs for recruitment,
equipment, orientation, nursing supplies, dental supplies, health
education supplies, office supplies, forms and keypunch.
FENWC agrees to reimburse the Health Program for direct operating
expenses up to a maximum of $4,309.00. All staff will keep accurate
time records documenting any costs allocated to the FENWC program and
billing.
9. Indirect Costs:
FENWC agrees to pay the Health Program a maximum of 15% indirect
costs calculated on actual costs of program, not to exceed $17,087.00.
10. Maximum Reimbursement:
The total maximum amount to be reimbursed to the Health Program
under this Agreement is $131,000.00. The H•alth Program will submit
a bill for services to FENWC no later than November 15, 1995.

11. Assurances:
a. The Health Program agrees that it is an independent contractor
and that its officers, employees, and clients do not become
employees of Weld County, and therefore are not entitled to any
employee benefits as Weld County employees, as a result of the
execution of this Agreement.
b. FENWC, the Weld County Board of Commissioners, its officers
and employees, shall not be held liable for injuries or damages
caused by any negligent acts or omissions of the Health Program,
its employees, volunteers, or agents while performing this
Agreement. The Health Program, its officers and employees,
shall not be held liable for injuries or damages caused by any
negligent acts or omissions of FENWC, or its employees,
volunteers, or agents while performing functions as described in
this Agreement. The Health Program shall provide adequate
liability and worker's compensation insurance for all of its
employees, volunteers agents engaged in the performance of this
Agreement, as required by the Colorado Worker's Compensation
Act. Likewise, FENWC, by and through the Board of Weld
County Commissioners, shall provide adequate liability and
workers' compensation insurance for all employees of FENWC
engaged in the performance of this Agreement.
c. No officer, member, or employee of Weld County and no member
of their governing bodies shall have any pecuniary interest,
direct or indirect, in the approved Agreement or the proceeds
thereof.
d. The Health Program understands that monitoring and evaluation
of the performance of this Agreement shall be conducted by the
Weld County Division of Human Resources and the results
provided to the Weld County Board of Commissioners.
e. The Health Program and FENWC assure compliance with Title VI
of the Civil Rights Act of 1986, and that no person shall, on the
grounds of race, creed, color, sex, handicap, or national origin
be excluded from participation in, be denied the benefits of, or
be otherwise subjected to discrimination under the approved
Agreement.

IN WITNESS WHEREOF, the parties hereunto have caused this
Agreement to be duly executed as of the day and year first hereinabove set
forth.

Enclosed for Board approval are three (3) Purchase of Service Agreements between
the Colorado Department of Health's Migrant Health Program and the Family
Educational Network of Weld County's Migrant Head Start Program.
The Migrant Health Program agrees to provide medical and dental services to
approximately 386 eligible Migrant Head Start children in Frederick, Ft. Morgan,
six sites located in Greeley, and the Western Slope.
FENWC agrees to reimburse the Health Program under this Agreement $131,000.00.
The term of this Agreement is from June 19, 1995, through September 1, 1995.
