Re: WCR 3 Half -ROW Dedication, Vista Commercial Center

Dear Todd:
Horizon Limited LLC owners of Vista Commercial Center, have dedicated the east 40 feet
of Weld County Road (WCR) 3. Frank and Andrea Bigelow own the property to the west
of Vista Commercial Center. They wish to dedicate the west 40 feet of WCR 3 at this
time Horizon Limited LLC will build the entire WCR upon the development of Phase II,
Vista Commercial Center.
Enclosed is the legal description of the west half of WCR 3. Also enclosed is a legal
description of an access easement for the current property owners south of Vista
Commercial Center, Phase L, who utilize the private drive now existing. The Title
Commitment shows that the Bigelows own the property, and describes any and all
easements and right-of-ways (ROW) for the property being dedicated.
Please inform me of the process and needed information to dedicate WCR 3 to Weld
County and to record the access Easement. If you have any questions, please contact me.

Subject: One year extension for filing the plat for Vista Commercial Center Filing II
Dear Mr. Stacey:
Thank you for your letter of request dated January 8, 1998 concerning the filing of the plat for Vista
Commercial Center Filing II. Department of Planning Service's staff and Weld County Attorney's
office reviewed your request and based on the facts outlined in your letter staff will not pursue
revocation of the final plat approval for an additional year past the original approval date. The
approval date for Vista Commercial Center Filing II was approved on April 23, 1997 therefor, the
matter of filing the plat will be re -addressed on April 23, 1999.

Filing II

Dear Commissioners:
As owners of Vista Commercial Center we would like to request a one-year extension to filing the plat for
Filing II. We view Filing II as a continuation of the process of development of the entire project. As you
are aware the infrastructure is in place and approved for Filing I. We are now in the process of marketing
and have completed sales of 8 lots and have contracts on 4 additional lots. This is approximately 30% of
Filing I, we, therefore, feel it prudent not to begin the improvements for Filing II at this time. For that
reason we would like to wait before filing the final plat and putting up collateral for Filing II construction.
This delay in addition will allow us to farm the remaining 67 acres for the coming year.
In addition we have been approached by two parties that might have interest in the entire area of Filing II as
a single user, which of course, would require modification of the plat.
We are in the process of awarding contracts for the landscaping of all the common and open space areas of
Filing I and will commence this as soon as the weather permits.
