Health Department • COLORADO CASE NO.: USR - 1215 NAME: Weld County Public Works Environmental Protection Services has reviewed this proposal; the following condtions are recommended to be part of any approval: 1) ' All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2) - No permanent disposal of wastes shall be permitted at this site. 3) Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 4) . Fugitive dust shall be controlled on this site. 5)- A dust abatement plan shall be submitted to the Weld County Health Department for approval prior to operation. The facility shall have sufficient equipment available to ✓ implement the dust control as required by the Weld County Health Department. 6) . An Air Pollution Emission Notice(A.P.E.N.)and Emissions Permit application must be submitted to the Air Pollution Control Division, Colorado Department of Health for emissions of criteria, hazardous or odorous air pollutants. Sources of such emissions include but are not limited to the following: sandblasting operations, mining, spray paint booths, dry cleaners, haul road traffic, composting, boilers and incinerators. 7) , The applicant shall remove, handle, and stockpile overburden, soil, sand and gravel from the facility area in a manner that will prevent nuisance condtions. 8) r The operation shall comply with all applicable rule and regulations of the Colorado Division .7 of Minerals and Geology. 9) , The maximum permissible noise level shall not exceed the industrial limit of 80 db(A)as -- measured measured according to 25- 12-102, Colorado Revised Statutes. 10)- The facility shall utilize port-a-pottys for employees. 1 1) ' A safe drinking water source shall be provided for the employees. 12) , A NPDES Permit shall be obtained from the Water Quality Control Division of the Colorado Department of Health for any proposed discharge into State Waterways,. Lockman : Thank you for the opportunity to comment on the Site Specific Development Plan and Use by Special Review Permit for the proposed Bearson Sand and Gravel Pit . These comments are intended to supplement those previously submitted by Rick Moss , Senior Biologist with the Division of Wildlife , in June of 1998 . Please refer to his comments regarding assessment of impact and mine reclamation recommendations . As Rick pointed out in his comments , wintering Bald Eagles use that stretch of the South Platte River running through the Bearson property and adjacent riparian areas for hunting . In addition, Bald Eagles have an established night roost in the riparian area north of the Bearson property, on the Kuiper and Magness properties at county road 22 . 5 . A DOW Bald Eagle monitoring project has documented eagle usage in the vicinity of the proposed project area for the past 3 years . Observers regularly recorded 4- 10 Bald Eagles in that area . CDOW recommendations include elimination of activity within 1/4 mile of winter roosts during winter months , with limited restrictions on activity out to 35 mile if there is a direct line of sight from the roost to the activities . Since the proximity of the roost to the proposed gravel pit is approximately 1 mile , there should be no adverse impact on the eagles . CDOW further recommends protection of hunting perches from human encroachment by establishing buffer zones of 1/8 mile (200 meters) to 1/4 mile (400 meters) from November 15 through March 15 depending upon topographic or vegetational screening . Monitoring data indicates that the project area does include important hunting perches .
