The Weld County Health Department has reviewed this proposal. We reviewed this
application with the understanding that the applicant is in the process of amending this
application in order to comply with the density requirements described in Section 2.13 of
the Planned Unit Development Ordinance, No. 197. You have also informed me that this
development lies within the 100-year flood plain.
The application has satisfied PUD Ordinance No. 197 in regard to water and sewer service.
Water will be provided by the North Weld County Water District and sewer will be provided
by individual sewage disposal systems. Once the application is amended, the minimum
lot sizes and the overall density of homes per acreage will meet both current Health
Department policy as well as the PUD Ordinance.
However, according to the United States Geologic Survey', the depth to ground water at
the site may very shallow. This could require that any septic system constructed on the
site be designed by a Registered Professional Engineer. High ground water limits the type
of septic systems that can be installed, and often very large leachfields are required. Large
leachfields near other natural obstacles, such as irrigation ditches, limit the usable area of
a lot. As a result, we are recommending that the applicant amend the application to
include a building envelope and two septic systems envelopes (one envelope for the initial
system and the second for a replacement system). Each septic system envelope should
be a minimum of 10, 000 square feet.
The application materials appear to adequately address impacts as described in section
6.3.1.2.1 of the PUD Ordinance. In addition, at this time, our staff is not aware of any
potential environmental impacts or risks that this proposed development may pose that
may represent an increased environmental impact or risk in excess of other similar
developments. However, we did observe what appeared to be an abandoned railroad
track near the site. The applicant should provide relevant information concerning the use
of the track.
Our staff observed several agricultural type homes in the vicinity of the site. Many of these

homes have livestock that include but may not be limited to cows and horses. We also
observed that a small feedlot is located to the south of the site. It is our opinion that any
future property owner should be made aware that these agricultural uses exist and that
they may be exposed to noise, dust, flies, odors, etc. in excess of the common urban
experience. As a result, we recommend that the "Right to Farm" covenant be required to
be placed on any recorded plat.
In the event that you find the submitted application to comply with the PUD Ordinance, we
recommend that the following conditions be a part of any approval:
1) The applicant shall obtain water service from the North Weld County Water District.
2) A Weld County Septic Permit is required for each proposed home septic system and
shall be installed according to the Weld County Individual Sewage Disposal
Regulations.
3) The installation of any septic system within the 100-year flood plain shall comply with
the Weld County ISDS flood plain policy. In accordance with the Colorado ISDS
Regulations, no septic systems shall be installed in the floodway.
4) The applicant shall designate one building envelope and two septic system envelopes
on each lot.
Please note: The Weld County Health Department, Environmental Protection Services
recommends alternative strategies regarding water conservation and waste minimization.
Considerations such as xeriscaping, low flow water fixtures, backyard composting and
recycling are a few options available to home owners. We also recommend that
preliminary radon mitigation measures be incorporated in the construction of new homes.
Radon kits are available in our office. Please contact our Department for further
information.

The Weld County Public Works Department has reviewed this proposal; the following requirements are
recommended to be a part of any approval:
COMMENTS:
Due to the size of the PUD, Weld County Public Works Department will waive the requirement for a Traffic Impact
Analysis in Step#2 of the PUD process, Change of Zone.
A Storm Water Drainage Permit was submitted at the sketch plan stage (S-419). This was reviewed and was
signed and stamped by a professional engineer. We have no conflict with the submittal.
REQUIREMENT:
At the sketch plan stage, it was requested that the typical cross section reflect six inches of Class 6 material as
stated in my memo dated July 1, 1997.
All lots will utilize an internal road system with no direct access to WCR 70.
The applicant has agreed to elevate the driveway onto WCR 70 to provide adequate sight distance to the east, see
my memo dated July 31, 1997.

DISCUSSION:
On October 21, 1998 the Windsor Planning Commission voted to
recommend approval of this rezoning request, subject to additional right-of-
way being dedicated along the south side of WCR 70 to bring this right-of-
way width up to Weld County's road standards, with this dedication being
accomplished either by (a) being shown on the recorded subdivision plat, or
(b) via deed prior to the issuance of any building permits, whichever is
sooner.

Dear Julie,
I have received and reviewed the packet sent by your office concerning the Winter Knolls PUI)
application. 1 visited the site on the 4th of October. As an Officer with the Division of Wildlife, I
have patrolled the area for over 16 years and am therefore very familiar with the Winter farm and
surrounding lands. Division's comments are based on this background
The Winter farm is a typical irrigated agricultural operation found throughout the Windsor-
Severance corridor. There are a series of irrigation laterals that deliver water to fields on this
farm and on to adjacent properties. Agricultural production generally involves row crops and or
hay production. There is very little, if any land left in native pasture.
Grass and forbs growing along the ditches provide food and cover for miscellaneous small
mammals,Red Fox, Coyote,Raccoon and Striped Skink Miscellaneous songbirds including:
Western Meadowlark, Song Sparrow, Grasshopper Sparrow,Lark Sparrow and Vesper Sparrow,
also use the grassy ditch margins. Pheasants will nest and hide along weedy ditches. During
winter,large flocks of Canada Geese and miscellaneous ducks enter fields in this area to feed on
waste grain and use the fields for day roosting. The firms in this area, including the Winter Farm
are hunted for geese and other species. Many of them are leased for substantial monetary
remuneration. In fact,while looking at the site I noticed lease signs posted across road 70.
Consequently the Division would disagree with the Winter's comment that, "there is no wildlife
activity associated with this Development " The development of this PUD will impact
wildlife and potentially impact associated wildlife recreation on the Winter Farm and adjacent
parcels. These impacts deserve to be considered before the PUD is approved.
The Division appreciates the effort to cluster home sites in this PUD. From a resource standpoint
this is the least damaging development design. However the cluster will be sited mid section on
the County Road. By placing the PUD midsection,the development will effectively cut section 14
and possibly 11 in half. This often makes it more difficult to farm neighboring fields(crop
dusting for instance may be precluded near the PUD). It also increases negative impacts by

increased intrusion for ground nesting species,roosting species and species sensitive to humans
and their pets. All to often when development occurs in these types of areas,native fauna like
meadowlarks and Lark Sparrows disappear to be replaced by generalist species like Robins,
English House Sparrows(a nonnative European invader), and Starlings(another European
invader). PUDs always place pet containment clauses in covenants. However,reality indicates
that dogs are allowed to run at times and feral cats are a constant problem in the vicinity of rural
subdivisions. Species like Raccoon and Striped Skunk,that at times come in conflict with
humans, can also be expected to flourish in and around the PUD.
The development will also potentially impact the ability to hunt on adjacent properties. In this
portion of Colorado there is a regulation prohibiting waterfowl hunting within 150 yards+air
space from any residence without the permission of the occupants. This effectively removes
bunting from within 250 yards of occupied home sites. With all the ranehette development in
Weld County,Division of Wildlife and Sheriff's officers spend increasing time responding to
these complaints. If you draw a 250-yard perimeter around this PUD it is apparent that adjacent
properties may be effectively shut down to hunting. This would have a negative impact on
landowners that rely upon lease dollars from goose hunters.
The Division applauds the Winter's efforts to secure raw water for landscaping on the PUD. To
avoid grazing by Canada Geese,use of Blue grass should be limited to immediately around home
sites. Tree and shrub plantings should incorporate the use of weed barrier and mulch techniques.
Trees and shrubbery should be selected from species that provide wildlife value and or low water
consumption. Icon supply a list of suitable species on request.
Based on these considerations,the Division would recommend:
1. That the PUD be placed as close as possible to the NW corner of section 14,near the
intersection of Weld Roads 70 and 21. This would decrease potential negative impacts on
farming,hunting and wildlife.
2. That Subdivision Covenants notify purchasers that they will be responsible for nuisance
wildlife control using only techniques permissible by Local, State and Federal law.
3. That Subdivision Covenants incorporate right to hunt wording for adjacent properties. The
Division will actively work to control hunting practices that are unsafe. However,we will not
become involved in attempts to eliminate hunting because it is inconvenient or philosophically
objectionable to new neighbors.
4. Subdivision Covenants shall include wording that prohibits the free movement of all pets,
including cats, offproperty.
5. Subdivision Covenants shall include restrictions that mandate the use of scavenger proof trash
receptacles.

RE: Winter Knolls PUD, Case #Z-518
The Winter Knolls PUD Subdivision has been reviewed, a drawing with the required hydrant
location is attached. The requirements for fire hydrants are listed below. If the fire hydrant is not
capable of meeting the minimum 1000 gpms at 20 psi, an alternative must be proposed by the
developer of the project.
Types of Hydrants:
Fire Hydrants shall be the Mueller Centurion or the Waterous Pacer.The Waterous Pacer shall be equipped with an upper standpipe
section with a nominal height equal to the Mueller Centurion. Fire hydrants shall be dry barrel. Fire hydrants shall have two 2 'A"
ports and one 4'/,"port. All thread shall be National Standard Thread,(NST). Fire Hydrants shall operate by opening in a counter-
clockwise direction and closing in a clockwise direction. The hydrant shall have the standard live sided nut on the port caps and the
operating stem[. The hydrant shall be installed with the 4 '/;"port facing the roadway.
I lydrant Installation:
Fire Hydrants shall be constructed such that an isolation valve is located between the hydrant and the water main.The valve shall be
accessible. The hydrant shall be installed so that the base flange is above grade with at least the base flange bolts exposed,and not
greater than five inches from the grade to the bottom of the base flange bolts. Hydrants shall have a break away section per
manufacturers specifications. The breakaway should be installed level with grade. All tire hydrants shall be installed with a course
gravel bed to ensure adequate drainage from hydrant weep holes. Thrust blocks shall be installed in accordance with AWWA and
NFPA.
Hydrants shall be visible and accessible for tire lighters without difficulty. Vegetation and landscaping shall not conceal the
hydrant.
Hydrant Spacing:
Residential -Fire Hydrants should be no greater than 600 feet apart:with no structure greater than 3(X)(6tH)/300).
Low Density Residential-An individual analysis will be conducted for each rural subdivision where lots within the subdivision are
equal or greater than 2 acres.Low Density Residential shall comply with residential unless the District approves an alternative.
Alternatives shall be based upon the individual analysis and the proposal submittal by the developer. Cisterns,dry hydrants and open
water sources are not acceptable alternatives.
Hydrants shall not be more than 10 feet from an approved lire access or roadway. The grade tiom the roadway or access and the hydrant
shall be near to level.
Ch• placement of hydrants at the end of the dead end street is for use as a blowout and it is not credited for use in tire lighting
op rations.

Blowouts should meet the same criteria as hydrants for tire fighting operations,or designed to ensure that the blowout will not adversely
affect tire fighting operations due to failure.
Streets with islands may require additional hydrants unless the hydrants are placed in the islands.
Fire Flows:
Fire flows shall be not less than 1000 gpm at 20 psi minimum for single family residential. Multi-Family Residential will he evaluated
based upon the size of the structures involved.
