Approved with Conditions The Department of Planning Services has determined through the review, that the standards of Section 11.4.2.1 through 11.4.2.6 of the Weld County Subdivision Ordinance have been met. This Recorded Exemption is approved with the following conditions in accordance with information submitted in the application and the policies of the County. 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations. 2. Prior to recording the plat: A. Due to the prime agricultural soils on Lot B, the applicant shall submit a proposed building envelope to the Department of Planning Services for review. Upon approval by the Department of Planning Services, the building envelope shall be delineated on the plat. B. In accordance with Weld County Public Works Ordinance#180, Lot A and Lot B shall utilize the existing residential and agricultural access points. No circle drives or additional accesses shall be granted. ggait $y RE9a C. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld County Public Works Department to determine if a culvert is necessary at any approved access point. D. A total of 40 feet from the centerline of State Highway 388 right-of-way reservation for future expansion of State Highway 388 shall be delineated on the plat. E. The following notes shall be placed on the plat: 1) All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. 2) Any future structures or uses on site must obtain the appropriate zoning and building permits. 3) Prior to the release of building permits on Lot B, the applicant shall submit evidence to the Department of Planning Services that the lot has an adequate water supply of sufficient quality, quantity and dependability. 3. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty (60) days from the date of approval by the Department of Planning Services. Hoshiko Ladies and Gentlemen: Enclosed is a packet containing the required submittal items for a recorded exemption. The purpose of this request is to enlarge the existing Lot B of Recorded Exemption Number 0963-13-2-RE92 from approximately 2.0 acres to approximately 3.0 acres. The following statements are provided as required: 1. The existing Lot B has a water supply from North Weld County Water District. Please see the attached letter from North Weld County Water District. The existing Lot A is agricultural and has access to water from North Weld County Water District. 2. Lot B has a septic system for which permit number SE-9600082 was issued. Please see the attached copy of a Septic Loan Approval and related documents. 3. Lot B is currently used as a residence for Steve Anderson and his family. Lot B consists of a house and three outbuildings. The Andersons keep their family horses on Lot B, but otherwise, there is no livestock on Lot B. Lot A is vacant, agricultural land. 4. This recorded exemption is to enlarge the existing Lot B. Lot B will be used for residential purposes only and Lot A will be used for agricultural purposes only. AP Department of Planning Services July 8, 1998 Page 2 5. Lot B is located in the SW'/, Section 13, Township 5 North, Range 64 West. The address for Lot B is 29027 WCR 388, Kersey, Colorado 80644 (WCR 388 is also known as Weld County Road 56'/x.) Existing Lot B consists of 2.0 acres, more or less; existing Lot A consists of 38.0 acres, more or less. Proposed Lot B would consist of 3.0 acres, more or less, and proposed Lot A would consist of 37.0 acres, more or less. The exact acreage, allowing proper setbacks, will be provided after a survey is completed. 6. There are no unique characteristics to either Lot B or Lot A. 7. All existing structures on Lot B meet minimum setback and offset requirements for the agricultural zone district in which the property is located. There are no proposed structures for Lot B. 8. The applicant is not willing to place a conservation easement on the property to maintain farm production or open space. 9. No building envelope will be provided on either lot unless required by Weld County. 10. There are no municipal plans nor approved inner-governmental agreements applicable to this recorded exemption. The applicant's proposal is consistent with the Weld County Comprehensive Plan. This recorded exemption merely allows the enlargement of the existing Lot B. The granting of this recorded exemption will not create conflicts between agricultural uses and residential uses that would be contrary to the intent of the Comprehensive Plan. 11. Lot B's present use as a principal residence is compatible with the existing surrounding land uses(specifically agricultural and residential land uses). The applicant proposes to continue using Lot B as a residential site. Lot A will continue to be agricultural land. The applicant will not be creating a new or negative impact on any of the existing surrounding land uses. 12. The applicant's property is within the Agricultural Zoning District. This recorded exemption proposal is consistent with the intent of the Agricultural District as expressed in the Weld County Zoning Ordinance. The granting of this recorded exemption proposal will not remove lands from agricultural production. Lot A will be used for the same purposes it is currently used. Additionally, Lot B will be used for residential purposes only, as it is currently used. This proposal will not create any conflicting land uses and will allow both Lot A and Lot B to be used consistent with their historical use. Department of Planning Services July 8, 1998 Page 3 13. This proposal is consistent with efficient and orderly development as defined in the Weld County Subdivision Ordinance § 1.3. This proposal will assist in the orderly and integrated development of lands in Weld County because the continued use of the property will be consistent and compatible with the surrounding property uses. This proposal promotes the health, safety and general welfare of the residents of Weld County. The applicant is not aware of any public improvement plans of Weld County or any of the various municipalities in Weld County that this recorded exemption would impact. The granting of this amendment to recorded exemption will not require or necessitate any public improvements. 14. This amendment to recorded exemption can meet or exceed all standards for design and improvement for this property. Granting this recorded exemption does not negatively impact the interest of the public, the homeowner, nor the applicant. 15. The granting of this recorded exemption will not have a negative impact on agricultural land, and, in fact, promotes its continued use consistent with its utilization in the past. The enlargement of Lot B through this recorded exemption will not disassociate irrigation water from any farm or agricultural land. Additionally, irrigation water is not now applied to Lot B . Lot A will be used in the same manner it has been used in the past. 16. The enlargement of a lot through this recorded exemption will not negatively impact the preservation of natural vegetation and cover which promotes the natural beauty of Weld County. No new construction is planned on Lot B and all existing vegetation will remain undisturbed. Lot A will remain undisturbed. There will not be a negative impact on the natural vegetation and cover on Lot A. The applicant's property is not subject to floods and no mitigation measures to prevent flood damage are necessary. There are no geologic hazards on the applicant's property and no risk to land slides or mud flows. 17. The creation of a larger lot through this recorded exemption does not change or negatively affect any of the considerations identified in Weld County Subdivision Ordinance § 1.3. The creation of a larger lot through this recorded exemption will not impact schools or parks and does not negatively impact the space currently existing for the development of schools and parks. FROM: Donald Carroll, Engineering Administrator 0 COLORADO SUBJECT: RE-2301; Jean Hoshiko The Weld County Public Works Department has reviewed this proposal; the following requirements are recommended to be a part of any approval: COMMENTS: WCR 388 is designated on the Transportation Plan Map as a Collector Status Road requiring 80 feet of right-of-way at full build out, there is presently 60 feet. WCR 59 is designated as a local gravel road. Both of these roads are maintained by Weld County. REQUIREMENTS: The applicant should reserve an additional 10 feet of right-of-way adjacent to WCR 388 to accommodate future build out. This should be designated on the plat. Lot A, the 37-acre agricultural lot, will remain in agricultural use. The applicant should utilize the existing accesses to this property as no additional accesses will be granted. Lot B, the three-acre residential/agricultural parcel, will access from WCR 388.
