RE: ACTION OF THE BOARD CONCERNING CONDITION OF APPROVAL #4 OF MINOR
RESUBDIVISION FOR THE VACATION OF RIGHT-OF-WAY IN THE
UNINCORPORATED TOWN OF BARNESVILLE - LINDSEY AND RUTH WILSON
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated September 1, 1999, the Board did approve the
application of Lindsey and Ruth Wilson, 33830 Weld County Road 61.5, Gill, Colorado 80624,
for a Minor Resubdivision for the Vacation of right-of-way in the unincorporated Town of
Barnesville on the following described real estate, to-wit:
Part of the unincorporated Town of Barnesville,
located in part of the NE'/ of Section 18,
specifically, all of Ahlstrand Avenue, adjacent to
Blocks 58 and 59; all of Weldon Avenue, adjacent
to Blocks 57, 58, and 59; and the alleys between
and around the lots within Block 59, leaving a
minimum width of sixty feet (60') for Weld County
Road 61.5 as it exists adjacent to Block 59, all
being north of State Highway 392, all of which are
located in Township 6 North, Range 63 West of the
6th P.M., Weld County, Colorado, and
WHEREAS, by a letter dated November 16, 1999, the applicant requested the Board
consider the deletion of Condition of Approval #4 requiring the removal of an access on Lot 58,
which they do not own, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
staff from the County Attorney's Office and the Weld County Departments of Planning Services
and Public Works, and all of the exhibits and evidence presented in this matter and, having
been fully informed, finds that this request shall be approved and Condition of Approval #4 be
deleted.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Condition of Approval #4 of a Minor Resubdivision for the Vacation
of right-of-way in the unincorporated Town of Barnesville for Lindsey and Ruth Wilson be, and
hereby is, deleted.

RE: Vacation of Right of Way
Owners -Lindsey and Ruth Willson
This letter is in regards to our application for vacation of right-of-way in the unincorporated
Town of Barnesville. The resolution to vacate was passed at a meeting on September 1, 1999
and recorded September 22, 1999 at Reception#2722037.
We were not notified by the Weld County Planning Department when the meeting was scheduled,
and therefore we were not present. Therefore, we are requesting that Item 4 be deleted from this
resolution regarding the removal of the West access to Lot 58. Our reason for this is that Lot 58
is not owned by us and should not have been included in the vacation process.
We would appreciate a meeting with the County Commissioners as soon as possible to get this
matter resolved.
