RESOLUTION RE: ACTION OF BOARD CONCERNING VACATION OF PORTION OF EAST 18TH STREET - CORRALES WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, at said hearing of July 20, 1998, the Board deemed it advisable to continue said matter to July 27, 1998, due to an incorrect notice date. WHEREAS, at said hearing of July 27, 1998, after hearing all testimony presented, the Board found vacation, in its opinion, would not increase the safety of the traveling public and, therefore, deemed it advisable to deny the request of Antonio and Rosalia Corrales to vacate a portion of East 18th Street. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request of Antonio and Rosalia Corrales to vacate a portion of East 18th Street, be, and hereby is, denied. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 27th day of July, A.D., 1998. I received notification of the hearing on Saturday the 18th of July, by a letter that was drafted and mailed on July 17. It was fortunate that the letter made the Saturday delivery. However, I was unable to make arrangements on such short notice. The county may consider that having responsible citizens means that they have obligations that require planning. I would like to express concern that this appears to be a public notice for a hearing with out the required due notice. Since I cannot attend I hope that you will consider my opinion and concerns with the same weight as if I had made it in person. This letter is a formal protest to the vacating of the roadway at 18 Street and Fern Ave (Weld County Road 45). This road has been actively used for well over sixty years. There are several problems with closing this section of road. The roadway is used by cars as well as walkers and horse back riders to avoid the section Fern Ave. that borders the property. Next to the Corralles' property Fern Avenue ascends to a hill. Visibility is obscured and it is not possible to see approaching traffic when traveling in either direction on Fern Avenue. The turn at the intersection of Fern and 18th Street is at an extreme angle. The 4 EXHIBIT q299 t: . : roadway is used by larger vehicles to access Fern from 18th Street. The roadway is also used to access Fern during the winter months when the hill is slick and impassable and is used to access Richard Osters property. One issue is the actual intersection of Fern and 18th Street. If traveling north on Fern Avenue it would not be possible to turn west onto 18th without the roadway. Cars and small vehicles can negotiate the corner. However it is not possible or practical to turn west with larger vehicles and impassable with any larger than a regular pick-up truck. A truck and trailer can not make the corner as it is constructed now. Another point to consider is that if the roadway is closed it will not be possible for large vehicles to turn right onto Fern from 18th Street. Our neighborhood is dependent on emergency Fire and Medical response from Greeley. Typically when responding they come up 18th Street. Making the turn impassable to emergency vehicles doesn't appear to be a viable option. At issue is the roads suitability as a housing pad (which is the ultimate goal in vacating the road). The property is very small and at an intersection on a hill. Anything placed on the property will be close to the roadway This will cause visibility problems for traffic turning West on 18 street from Fern Ave. Also there are dangers inherent in placing a home so close to the road on a blind hill. Another concern is the potential for the septic tank and leach field to leak across 18 Street. This has happened with a similar raised septic system owned by Mr. Vega in the neighborhood. Raw sewage has drained onto a neighboring property. The septic system for the property is already in place and is located above 18th Street. I ask the board to refer to an engineer for assurance that sewage leakage will not be a problem. The City of Greeley has indicated that water is unavailable from the water main at this location and that a well will have to be drilled. This combined with the other set back requirements (i.e.. septic, leech field, roadway and power line.) raises further concerns about the suitability of the road and property as a housing site. Another concern is that with all of the setbacks where will the driveway be placed for the property. Parking over the leech field will not be possible with this type of system and parking on the roadway is not appropriate. The size of the property appears contrary to current policies for development of planned subdivisions or larger parcels of land. Especially with the county's ordinances regarding splitting small acreage's. The development of this property appears contrary to those policies. I have personal concerns about Mr. Vega's representing Mr. and Mrs. Corrales in this concern as he currently owns a non- commercial junkyard that is in violation almost directly across the street from Corralles property. I know that this is an issue that is being addressed by the board and planning and zoning. I know this has no bearing on how Mr. and Mrs. Corralles will maintain their property but this certainly does not ease my mind. Especially when the closing of this roadway presents so many problems. 98,199 I encourage the Board of Commissioners to deny the vacating of the roadway on 18th Street and Fern Avenue. If the board considers closing the roadway I would encourage that the site be visited before making a final decision to close the roadway. I would also encourage you to contact other county services such a Fire, Ambulance and District Six School buss service for input on how it would impact their services. I paid $21,500 for this property. But, I have been told that if one of my neighbors do not want the road closed they can buy it for $21,000.
