Box 459 1402 North 17th Avenue Greeley, CO 80632 DENVER METRO (970) 659-7576 FAX (970) 330-2969 File No. 4271 RE: Moark Hatcheries, LLC - Use By Special Review for Commercial Egg Production Facility Dear Keith: The purpose of this letter is to supply the information requested by the Use By Special Review questionnaire with regard to Moark Hatcheries, LLC's ("Moark") application for a Use By Special Review permit for a commercial egg production facility on property located on 227 acres in the east half of section 13, Township 2 north, Range 63 west of the 6th P.M., Weld County, Colorado. Please be advised that Moark has been in the egg production business for 35 years and has successful existing facilities in Grand Junction, Colorado, Neosho, Missouri and Carthage, Missouri. Applicant is the principal egg supplier to King Soopers. The proposal of Moark is to construct a 1.4 million bird, egg processing facility on 227 acres of ranch land approximately 1.5 miles south of Roggen, Colorado. The site has been carefully selected from a transportation and land use point of view. Applicant will run a first class egg production operation that will be an asset to both Weld County and Roggen. Applicant's contracts with the buyers of the eggs require that the facility be clean and run in an efficient manner. The Town of Roggen and the surrounding agricultural community will benefit from having a quality operation near its borders and having an outlet for local farmers to sell their grain as feed to the chickens. The 227 acre Use By Special Review area will be surrounded on three sides by property that will be owned by applicant and a sister entity. The surrounding acreage (2413 acres) will not be included in the Use By Special Review, but should provide an adequate buffer for the facility. The total property being sold by Jimmie and Iris Groves is 2460 acres. 227 acres in Section 13 952340 Weld County Department of Planning Services August 17, 1995 Page 2 will compose the Use By Special Review area, while the remaining acreage in Section 13 will be owned by Moark. As is shown on the Use By Special Review plat, applicant's uses will be developed in three phases and a "future expansion area". The first phase is to be built immediately and will consist of a building where eggs generated at other facilities will be processed for marketing. As business develops, phase 2 will be implemented, i.e. two chicken houses, labeled as number 1 and 2 on the Use By Special Review plat. Each of the said buildings will house 100,000 laying hens. As business develops further, chicken houses numbered 3 and 4 will be built, again housing 100,000 chickens per building. The remaining area known as "future expansion area" on the Use By Special Review plat will be built as business grows and demand for eggs increases. The "manure treatment area", "feed mill area" and the "pullet houses" will be built as shown on the Use By Special Review plat as needed, sometime after implementation of phase 2. The seven modular or mobile home sites will be built for employee housing when needed. The following information corresponds numerically to the Use By Special Review Questionnaire: 1. HOW IS THIS PROPOSAL CONSISTENT WITH THE WELD COUNTY COMPREHENSIVE PLAN? The Weld County Comprehensive Plan indicates an intent to encourage agricultural and farm use. The proposal of Moark is entirely consistent with the Comprehensive Plan since the proposed uses are agricultural in nature and will directly benefit the surrounding community and the surrounding farm operations. Moark will buy feed from local grain suppliers and farmers and employ 21-48 people in the Roggen area (21 people to start, 48 when finished). The Weld County Comprehensive Plan states: "Agricultural zone districts shall be established and maintained to protect and promote the County's agricultural industry. The agricultural zone district is intended to preserve prime agricultural land and to provide areas for agricultural activities and uses dependent upon agriculture without the interference of incompatible residential, commercial, and industrial land uses." Applicant's proposal is an activity and use that is dependent on the agriculture that should be encouraged by Weld County. 952340 Weld County Department of Planning Services August 17, 1995 Page 3 2. HOW DOES THIS PROPOSAL MEET THE INTENT OF THE ZONE DISTRICT IT IS LOCATED IN? See answer to question 1 above. The applicant's uses are agricultural in nature and, therefore, meets the intent of the agricultural zone district. As indicated above, Moark will buy feed from local farm operators and therefore encourage the farming community as a whole. 3. HOW IS THIS USE COMPATIBLE WITH FUTURE DEVELOPMENT AS STATED IN THE WELD COUNTY COMPREHENSIVE PLAN? IF YES, HOW? The closest municipality to the applicant's property is Roggen. Roggen is a community largely associated with farming and ranching. Therefore, applicant's uses will be compatible and consistent with future development of Roggen and Weld County. 4. WHAT TYPE OF USES SURROUND THIS SITE? IS THIS REQUEST COMPATIBLE WITH SURROUNDING USES? There is Ranch grazing land on three sides and irrigated farmland on the other side. Within two miles to the south and southwest is a commercial cattle feed lot and a natural gas refinery plant as well as other irrigated and ranch farming land. The poultry project is compatible to the surrounding area. 5. IS THIS PROPERTY LOCATED WITHIN A FLOOD HAZARD ZONE, GEOLOGIC HAZARD ZONE, OR AIRPORT OVERLAY ZONE AND DOES IT MEET THESE SPECIAL REQUIREMENTS? No. 6. WHAT EFFORTS HAVE BEEN MADE TO CONSERVE PRODUCTIVE AGRICULTURAL LAND? Uses will be limited to 227 acres and all of the surrounding uses will continue to be agricultural in nature. In fact, applicant's uses will encourage further agricultural development because there will be a market for the grain that is raised on the surrounding land. 7. HOW WILL PUBLIC HEALTH, SAFETY AND WELFARE BE PROTECTED? Applicant is not aware of any specific public health, safety or welfare issues. Applicant has operated a similar facility near Grand Junction, Colorado for eight years and an additional facility near Pierce, Colorado. The applicant's reputation is one of the cleanest poultry operations in the United States. Further, because of the applicant's relationships with it's 952340 Weld County Department of Planning Services August 17, 1995 Page 4 clients, applicant must maintain a clean and wholesome environment or its business relationships will fail. 8. WHAT WILL THE SITE BE USED FOR? As explained on the attached site plan, applicant anticipates eventually housing 1.4 million laying hens with support operations on the Use By Special Review permit property in fourteen houses. 9. HOW CLOSE IS THIS SITE TO OTHER RESIDENTIAL STRUCTURES? There is one rental farm home about 1/4 mile East of the property across the road and one ranch home about 3/4 mile south. 10. HOW MANY PEOPLE WILL BE EMPLOYED AT THIS SITE AND WHAT HOURS WILL THEY WORK? The first phase requires 21 people and the completed project requires 48 people. Work will be during day shift with a 40 hour work week. Several key employees will be living at the site. 11. HOW MANY PEOPLE WILL USE THIS SITE? 21 - 48 employees plus drivers and visitors. 12. WHAT TYPE AND HOW MANY ANIMALS, IF ANY, WILL BE ON THIS SITE? The completed project will house 1,400,000 laying hens and 400,000 growing pullets. 13. WHAT TYPE AND HOW MUCH, IF ANY, OPERATING AND PROCESSING EQUIPMENT WILL BE UTILIZED ON SITE? a. An egg processing machine to collect, wash, weigh, andle, carton and package eggs. b. Equipment necessary for containing and care of laying hens and pullets within the houses including drinkers, automatic feeders, egg delivery units and ventilation fans. c. Equipment necessary for moving and processing poultry droppings including spreading, composting, drying and pelletizing. 14. WHAT TYPE AND HOW MANY STRUCTURES WILL BE ERECTED (BUILT) ON THIS SITE? ARE YOU PROPOSING STORAGE OR STOCKPILE OF WASTES ON THIS SITE? IF SO, WHAT IS THE SIZE AND TYPE PROPOSED? The layer and pullet droppings will be spread on fields, sun dried on drying beds, composted or gas dried and pelletized. HOW OFTEN WILL DEBRIS, JUNK, OR WASTE BE DISPOSED OF? BY WHAT MEANS? Weekly. By approved sanitation company. 19. HOW LONG WILL IT TAKE TO CONSTRUCT THIS SITE AND WHEN WILL CONSTRUCTION BEGIN? Depending on time of permits and weather - Phase 1 Fall of 1995 through Spring of 1996, Phase 2 following Phase 1 and Phases 3 and 4 ("future expansion") later as egg market requirements increase. 20. EXPLAIN THE PROPOSED LANDSCAPING PLANS AND EROSION CONTROL MEASURES ASSOCIATED WITH THIS SITE. It is proposed to grow grass or alfalfa in front of the layer buildings and between the buildings and the highway. The use site is nearly level and should not create an erosion or drainage problem. 21. EXPLAIN ANY PROPOSED RECLAMATION PROCEDURES WHEN TERMINATION OF THE SPECIAL REVIEW USE BEGINS. The buildings are industrial type (concrete and steel) and should last in excess of 50 years. In the event of cessation of the chicken operation, the buildings would be excellent for other uses. 22. EXPLAIN THE NEED FOR THE PROPOSED USE (ACTIVITY) IN WELD COUNTY. Applicant is the principal supplier for local King Soopers and several food distributors that serve Colorado and the mountain states. The current markets require around 8,000 thirty dozen cases of eggs per week. These eggs come from approximately 500,000 chickens. The need for local egg production efficiency, high quality fresh eggs, and for good quality agricultural business is apparent, especially those that encourage other agricultural uses such as grain production from surrounding farmers. Applicant will have a need for grain to feed it's chickens, providing an outlet for local suppliers. 23. WHO WILL PROVIDE FIRE PROTECTION FOR THIS SITE? WHAT OR WHO WILL PROVIDE WATER TO THE SITE? Applicant has applied for a well permit into the Laramie - Fox Hills aquifer in addition to storage from pressurized water tanks and small domestic well as back up. 25. HOW WILL STORM WATER DRAINAGE BE HANDLED ON THE SITE? Parking and driveways will be graded to existing road ditch. Other drainage will be distributed on company owned land. First, you wanted more information regarding pellets. Please be advised that it will be a long time before the applicant has sufficient waste materials to justify pelletizing. The plan at the present, besides spreading on fields, is to simply sun dry and/or compost the chicken manure. The compost manure would be in triangle shaped windrows three to four feet high and rounded at the top. Each windrow would be a maximum of 150 to 180 feet long. The temperature of the windrows would be monitored and carbon base would be added to aid in decomposition. There would be approximately six to ten windrows. each in a different week of decomposition. The sun drying would be in drying beds approximately 60 feet by 200 feet in size with thin layers added for drying. The beds would be stirred occasionally to facilitate total drying. The composted and sun dried material will be sold as organic soil builder. When it is justified by sufficient waste material and economics, a gas dryer will be added and the chicken manure will be processed into pellets for plant food. Second, you wanted to know what the applicant will do with any deceased birds. Any deceased birds will be added to the compost process.
