HomeMy WebLinkAbout952183.tiffRESOLUTION RE: APPROVAL OF RECORDED EXEMPTION #1792 - RITCHEY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10)(d), CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption #1792, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption #1792 was submitted by Clinton Ritchey, 19406 Highway 52, Fort Lupton, Colorado 80621, for property which is described as Lot B of RE #928, located in the NW% of Section 26, Township 1 North, Range 66 West of the 6th P.M., Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 137 acres and 5 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1792 submitted by Clinton Ritchey be, and hereby is, approved conditional upon the following: 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. 2. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fees. 3. The applicants have stated in their application that the reason for the recorded exemption request is for agricultural purposes and a proposed building site. The applicant further states that proposed Lot B will remain in agricultural use as a pasture area while proposed Lot A will be a homesite as well as pasture land for certain livestock usage such as horses. Water wells are the proposed water source for both proposed lots while septic systems are proposed for each lot for sewage disposal. Access to both proposed Lots is existing onto Weld County Road 6. The property is located in the Urban Growth Boundary Area of the Town of Lochbuie and the City of Brighton. The Weld County Health Department and Public Works Department have both reviewed this request and have no conflict of interest. In regard to the Ritch proposal, since one lot has already been split off of the pre 72' parcel, a well in the alluvium would not normally be available. The applicant may need to construct a new well in a non -tributary Denver Basin aquifer. This type of well may be available in the southern part of the county, south of Township 5 North. Lot "A" will be a ranchette type of usage on a 5 acre parcel with agricultural type of utilization such as horses. 4. Explain how the uses permitted will be compatible with existing uses surrounding the proposed recorded exemption. Most of the surrounding area is small tracts for building sites, and the remaining parcel areas being used for pasture. The proposed usage of these parcels will remain consistent with the existing zoning and the Comprehensive Plan. 5. Explain how the proposal is consistent with the intent of the zoning district it is located within. Presently agricultural usage - pasture area. Lot "A" will be a small tract and is consistent with the surrounding area which also contains small tract/ranchette type of development. 6. Explain how the proposal is consistent with the efficient and orderly development. Consistent with other agricultural properties within the area in maintaining the agricultural usages. The larger parcel will remain pasture type of usage and the smaller parcel will be used as a home site as well as for certain livestock usages. The proposed 5 acres would be used as a residential tract and the applicant is seeking a well. We could make a household use only well available for the 5 -acre tract. Use of this well for lawn and garden or livestock watering would be prohibited. If these limitations are acceptable to the applicant, we can recommend approval. We ask for a plat note or covenant to reflect the limitation on the use of the well. The larger tract is intended for agricultural use. There appears to be an existing house and old unregistered well on this tract.
