RE: APPROVAL OF RECORDED EXEMPTION #1792 - RITCHEY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under Section
30-28-101(10)(d), CRS, as amended, did determine at a public meeting held in the Chambers of
the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known
as Recorded Exemption #1792, does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land", and
WHEREAS, the request for Recorded Exemption #1792 was submitted by Clinton Ritchey,
19406 Highway 52, Fort Lupton, Colorado 80621, for property which is described as Lot B of
RE #928, located in the NW% of Section 26, Township 1 North, Range 66 West of the 6th P.M.,
Weld County, Colorado, being more particularly described in the plat which shall be provided by
the applicant and known as Exhibit "A", said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels estimated to be approximately
137 acres and 5 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from
the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1792 submitted by
Clinton Ritchey be, and hereby is, approved conditional upon the following:
1. A Weld County septic permit is required for any proposed home. The septic system
shall be installed according to the Weld County Individual Sewage Disposal System
(ISDS) regulations.
2. The applicant shall submit a mylar plat to the Department of Planning Services to
be recorded in the office of the Weld County Clerk and Recorder. The plat shall be
prepared in accordance with the requirements of Section 11.7 of the Weld County
Subdivision Ordinance. The plat shall be submitted within sixty days from the date
of approval by the Board of County Commissioners. The applicant shall be
responsible for paying the recording fees.
3. An access easement shall be shown on the plat across Lot A of RE #928 for the
benefit of Lot A of RE #1792.

Dear Commissioners:
This application for a recorded exemption in the A (Agricultural) zone district is submitted by Clinton
Ritchey. The parcel of land is described as Lot B of RE -928 located in the NW4 of Section 26, T1 N,
R66W of the 6th P.M., Weld County, Colorado. The property is located south of and adjacent to
Weld County Road 6 and approximately 1 1/2 miles east of Weld County Road 31. This request is
to divide a 142 acre lot into two lots of 137 acres and 5 acres, more or less.
RE -928 was approved by the Department of Planning Services' staff on August 27, 1986. RE -928
created two lots of 142 acres and 5 acres more or less. The applicant is now requesting to further
subdivide the 142 acre parcel into two lots of 137 acres and 5 acres, more or less. The applicants
have stated in their application that the reason for the recorded exemption request is for agricultural
purposes and a proposed building site. The applicant further states that proposed Lot B will remain
in agricultural use as a pasture area while proposed Lot A will be a homesite as well as pasture land
for certain livestock usage such as horses.
Water wells are the proposed water source for both proposed lots while septic systems are proposed
for each lot for sewage disposal. Access to both proposed Lots is existing onto Weld County Road
6. The property is located in the Urban Growth Boundary Area of the Town of Lochbuie and the City
of Brighton. The Weld County Health Department and Public Works Department have both reviewed
this request and have no conflict of interest.

The State Engineer sent the enclosed memorandum to all county planning directors
this August alerting them to our new procedure of not providing responses on land use
actions that do not involve the "Subdivision" of land. The enclosed Water Supply
Information Summary Sheet is provided to allow the applicant to assemble the required
information on the water supply for any land use proposal, which may assist you in your
review.
Where a well will be the water supply, the county may require that the applicant
submit a complete copy of their well permit to allow the permitted uses and limitations of
well use to be identified.
Where the supply is to be from a source other than a well, we recommend that the
applicant be required to submit to the county, a copy of the letter of commitment from the
water supplier, be it a water company/district/association or a water hauler who obtains
water from a legal source such as the City of Boulder, Arvada, Denver, or other city water
supplies.

land use proposal. We recommend that the applicant be required to submit to the county, the
complete well permit for a well that is to be the water supply for any proposal.
In regard to the Ritch proposal, since one lot has already been split off of the pre 72' parcel,
a well in the alluvium would not normally be available.
The applicant may need to construct a new well in a non -tributary Denver Basin aquifer.
This type of well may be available in the southern part of the county, south of Township 5 North.
A consulting ground water engineer can determine availability for the various applicants.

Your recorded exemption application will be processed on or before October 6, 1995 . If it is determined
that the application meets the approval criteria of the Weld County Subdivision Ordinance, you will be
notified that the recorded exemption is approved. If the staff determines that the application does not meet
the approval criteria, you will -be notified and asked to appear before the Board of County Commissioners
at a public hearing. You will be informed of the hearing date prior to the hearing. The Board of County
Commissioners will then consider your application and make a final decision on the recorded exemption.
It is the policy of Weld County to refer an application of this nature to any town or municipality lying
within three miles of the property in question or if the property under consideration is located within the
comprehensive planning area of a town or municipality. Therefore, our office has forwarded a copy of the
submitted materials to the City of Brighton and the Town of Lochbuie Planning Commissions for their
review and comments. It is recommended that you and/or a representative be in attendance at these
Planning Commission meetings to answer any questions the Commission members may have with respect

1. Explain the reason for the proposed recorded exemption and how each proposed lot will be used.
Agricultural purposes (Pasture area) - and proposed building (Dwelling) site.
2. Describe the location, size and present use of the area where each proposed new lot will be created.
Current property - 142± acres pasture area - To be divided into two parcels
Lot A will be 5 Acres and Lot B will be 137 ±
Refer to map of Recorded Exemption, location of proposed parcels and acnss. Map attached as
Exhibit "A"
3. Explain how the proposal is consistent with the Weld County Comprehensive Plan and any adopted
municipal plan, if applicable.
Lot "B"to remain agricultural use as pasture area. Trying to preserve land as agricultural land and use.
Lot "A" will be a ranchette type of usage on a 5 acre parcel with agricultural type of utilization such as
horses.
4. Explain how the uses permitted will be compatible with existing uses surrounding the proposed recorded
exemption.
Most of the surrounding area is small tracts for building sites, and the remaining parcel areas being used
for pasture. The proposed usage of these parcels will remain consistent with the existing zoning and
the Comprehensive Plan.
5. Explain how the proposal is consistent with the intent of the zoning district it is located within.
Presently agricultural usage - pasture area. Lot "A" will be a small tract and is consistent with the
surrounding area which also contains small tract/ranchette type of development.
6. Explain how the proposal is consistent with the efficient and orderly development.
Consistent with other agricultural properties within the area in maintaining the agricultural usages. The
larger parcel will remain pasture type of usage and the smaller parcel will be used as a home site as well
as for certain livestock usages.
The smaller tract will also be consistent with other small dwelling tracts within the area. A portion of
the SE1/4 of the Section is currently divided into 24 parcels containing approximately 4 acres each.
7. Explain how adequate provision for the protection of the health, safety, and welfare of the inhabitants
of the neighborhood and the County will be accomplished.
Consistent with established agricultural zoning and use. Continued agricultural use for both parcels of
land maintaining the existing agricultural usages within the area.
The proposed dwelling site will require a well for water service. The sewage system will consist of a
septic tank type of service. This is consistent with the other dwelling sites within the area.

CONDITIONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of the
permit does not assure the applicant that no injury will occur to another vested water right or preclude another
owner of a vested water right from seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless
approval of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump
Installation Contractors in accordance with Rule 18.
3) Approved pursuant to CRS 37-92-602(3)(b)(II)(A) as the only well on a tract of land of 35 acres described as part
of the NE1/4 of the NW1/4 of Section 26, Township 1 North, Range 66 West, 6th P.M. more particularly described
in the attached exhibit A.
4) The use of ground water from this well is limited to ordinary household purposes inside three single family
dwellings, fire protection, the watering of poultry, domestic animals, and livestock on farms and ranches, and the
irrigation of not over one acre of home gardens and lawns.
5) Production from this well is restricted to the Laramie -Fox Hills aquifer which corresponds to the interval between
985 feet and 1305 feet below ground surface. Plain casing shall be installed and sealed to prevent production
from other zones.
6) The maximum pumping rate shall not exceed 15 GPM.
7) The return flow from the use of the well must be through an individual waste water disposal system of the
non -evaporative type where the water is returned to the same stream system in which the well is located.
8) This well shall be constructed not more than 200 feet from the location specified on this permit.
Note• : To insure a maximum productive life of this well, perforated casing should be set through the entire

STATEMENTS
4. We wish to divide the lot into two separate lots
in order to give Kim Ritchey 5 acres.
5. The division will be consistent with the policies
of the Weld County Comprehensive plan.
6. A 'zoning permit application form has been submitted
to the Planning Department and will be consistent
of the zone district in which the subject property
is located.
7. The surrounding properties currently have houses
erected on them simalar to the house proposing
to be built on the 5 acres.
8. The area is now and will be in the future, zoned
for housing and the fore -mentioned 5 acres will
erect a house complying with existing zoning laws.
It will be consistent with the comprehensive plan
of the County or the adopted master plans of affected
municipalities.
9. The proposal will comply to any existing county
or state laws and will not be inconsistent with
efficient and orderly development.
10. A septic permit has been acquired from the Weld
County Health Department and a well permit form
has been submitted to the state and is being processed.
11. The fore -mentioned property that is in consideration
for a recorded exemption is not located in a flood
plain, geologic hazard, and -or Weld County Airport
overlay district; and the application will comply
with section fifty (50), overlay district regulations
outlined in the Weld County Zoning Ordinance.

We have received the above referenced proposal to separate 160 acres into
tracts of 155 and 5 acres. The proposed 5 acres would be used as a
residential tract and the applicant is seeking a well.
We could make a household use only well available for the 5 -acre tract.
Use of this well for lawn and garden or livestock watering would be
prohibited. If these limitations are acceptable to the applicant, we can
recommend approval. We ask for a plat note or covenant to reflect the
limitation on the use of the well.
The larger tract is intended for agricultural use. There appears to be
an existing house and old unregistered well on this tract. We consider this
to be a one-time exemption and thus we would be opposed to any future
separations of the 155 -acre tract of less than 35 acres.
