AR242311B1 RESOLUTION RE: APPROVE INCREASED FEE SCHEDULE FOR FEES COLLECTED BY THE WELD COUNTY DEPARTMENT OF PLANNING SERVICES FOR PROCESSING AND REVIEWING LAND-USE PERMIT APPLICATIONS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, a public hearing was held on the 4th day of January, 1995, at 9:00 a.m., in the Chambers of the Board for the purpose of considering an increased fee schedule for fees collected by the Weld County Department of Planning Services for processing and reviewing land-use permit applications, and WHEREAS, after study and review, the Board deems it advisable to approve the proposed fee schedule, effective January 4, 1995, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the increased fee schedule for fees collected by the Weld County Department of Planning Services for processing and reviewing land-use permit applications be, and hereby is, approved, effective January 4, 1995. Bruce Barker, County Attorney, made this a matter of record. Chuck Cunliffe, Director of Planning Services, entered the favorable recommendation of the Planning Commission, dated December 20, 1994, into the record and stated increases of four to eleven percent are included. No public testimony was offered concerning this matter. Commissioner Kirkmeyer moved to approve the increased fee schedule for fees collected by the Weld County Department of Planning Services for processing and reviewing land-use permit applications based on the recommendations of the Planning staff and the Planning Commission. The motion was seconded by Commissioner Harbert, and it carried unanimously. This Certification was approved on the 9th day of January, 1995. PAWL? Two philosophies exist as to who benefits and should pay for the processing of applications. The first philosophy is that the applicant, developer, or users are the beneficiaries of the processing and should pay all the costs associated with the processing. The second philosophy is that the applicant and community in general are the beneficiaries and that both should bear the costs of processing with application fees and dollars collected by general taxation. Historically, Weld County has attempted to recover at least 50% of the total costs (direct and indirect costs) of the Planning Department's budget through land- use application fees. The attached materials indicate the amount needed to recover 100% of the direct and indirect processing costs for each type of application and the proposed increased fees for 1995. The percentage of fee increases for 1995 range from 4.0% to 11.1%. The new fees are recommended to become effective January 1, 1995. 95001.2 Wo x a.
