Home My WebLink About981409.tiff HEARING CERTIFICATION DOCKET NO. 98-45 RE: SPECIAL MEETING OF THE BEEBE DRAW LAW ENFORCEMENT AUTHORITY DISTRICT BOARD A Special Meeting of the Board of County Commissioners, sitting as the Beebe Draw Law Enforcement Authority, was conducted on Monday, August 10, 1998, at 10:00 a.m., with the following present: Commissioner Constance L. Harbert, Chair Commissioner W. H. Webster, Pro-Tem Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer Also present: Acting Clerk to the Board, Esther Gesick County Attorney, Bruce Barker Director of Finance and Administration, Don Warden The following business was transacted: I hereby certify that pursuant to a notice dated July 20, 1998, and duly published July 29, 1998, in the Platteville Herald, a Special Meeting of the Board of County Commissioners, sitting as the Beebe Draw Law Enforcement Authority, was conducted to consider a ballot question for the 1998 General Election, an Intergovernmental Agreement for Conduct of Coordinated Elections, and setting the 1999 Budget Hearing for December 14, 1998, at 9:00 a.m. There were no minutes to be approved. Don Warden, Director of Finance and Administration, stated the Board of County Commissioners serves as the Beebe Draw Law Enforcement Authority District Board and gave a history of the mill levy for this District. He explained the District did have a mill levy set the first few years; however, since no development was occurring, it was allowed to become defunct. Now that development is reoccurring, the mill levy needs to be reestablished. Mr. Warden further explained since the mill levy has not been in effect since the Bruce Amendment was passed, it is necessary to "de-Bruce" the mill levy. He recommended setting the mill levy at 7 mills, which is the maximum allowed for a law enforcement authority. He indicated the draft resolution for setting the ballot issue needs to be corrected in the third paragraph to replace "Weld County"with "areas located within the jurisdictional boundaries of the Beebe Draw Law Enforcement Authority"; and stated there are four voters in the district, including residents and property owners. In response to Commissioner Kirkmeyer, Mr. Warden stated they will begin developing the area this year and added the re- enactment of the law enforcement authority is a Condition of Approval for the development of the complex. He also stated there will be a Road Improvements Agreement presented for approval at a later time. The motion was seconded by Commissioner Webster, and it carried unanimously. Commissioner Webster moved to approve the Intergovernmental Agreement for the Conduct of Coordinated Elections and authorize the Chair to sign. Seconded by Commissioner Hall, the motion carried unanimously. Commissioner Webster moved to set the 1999 Budget Hearing for December 14, 1998, at 9:00 a.m. Seconded by Commissioner Hall, the motion carried unanimously.
