A public hearing was conducted on April 12, 1995, at 10:00 a.m., with the following present:

Commissioner W. H. Webster

The following business was transacted:
I hereby certify that pursuant to a notice dated March 27, 1995, and duly published March 30, 1995,
in the Windsor Beacon, a public hearing was conducted to consider the request of Craig McConnell
for a Site Specific Development Plan and Special Review Permit for a Bed and Breakfast in the
A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of
record. Chairman Hall advised the applicant that in the event of a tie vote Commissioner Harbert
will review the record and cast the deciding vote. Todd Hodges, Planning Department
representative, entered the favorable recommendation of the Planning Commission into the record
as written, including a change from the word "bedrooms" to "guestrooms" in Condition of Approval
#3. Craig McConnell, applicant, stated his only concern was the regulation regarding the number
of bedrooms in a home and pointed out there are four guestrooms. He stated they are only
operating three guestrooms now; however, five guestrooms would be adequate for anticipated
growth. Mr. McConnell noted the septic system is adequate and all Conditions of Approval and
Development Standards are acceptable. Responding to questions from Commissioners Baxter and
Kirkmeyer, Mr. Hodges confirmed the well permit issue has been resolved and the use is within the
residence in which the applicant resides. He stated a Condition of Approval could be added
concerning the issue if the Board desires and confirmed no non -family members may be employed
at the establishment. Mr. Morrison clarified the State regulates the well permit and penalty
provisions exist, and the Board concurred the Conditions of Approval and Development Standards
as written cover Weld County's requirements. No public testimony was offered concerning this
matter. Commissioner Kirkmeyer moved to approve the request of Craig McConnell for a Site
Specific Development Plan and Special Review Permit for a Bed and Breakfast in the
A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning
Commission, with the Conditions of Approval and Development Standards as entered into the
record, including the amendment to Condition of Approval #3 and Development Standard #8 by
changing "bedrooms" to "guestrooms". The motion was seconded by Commissioner Webster, and
it carried unanimously.
