A GR EEMEN T
THIS AGREEMENT made at Greeley, Colorado, this 17th day of February,
1960, by and between TA' GOULD of Longmont, Colorado, herein designated
first party, and WELD COUNTY, A POLITICAL SUBDIVISION OF THE STATE OF ✓
COLORADO, Acting By and Through Its Board of County Commissioners, herein
designated second party.
WITNESSETH THAT for and in consideration of the mutual covenants
herein agreed to be kept and performed, the parties hereto agree with each
other as follows:
1. First party does hereby grant unto the second party the exclusive
right to remove the gravel from the two areas shown on the annexed diagram
in the Southeast Quarter (SE) of Section Thirty-one (31), Township Three
(3) North, Range Sixty-seven (67) 'jest of the 6th P.m. over a period of
the next five (5) years from the date of this agreement, together with the
necessary rights of ingress and egress and regress to and from said areas
for the purpose of ruining and removing the gravel from said areas.
2. In consideration of the grant of the exclusive right to mine and
remove the gravel from the SE: of said Section 31, second party agrees to
straighten the channel of the St. Vrain River by providing a pew channel
for a distance of six hundred (600) feet, more or less, as shown on the
annexed drawing, the straightening of the channel of said river to be done
and performed by the second party within the next thirty (30) days from and
after the date of this agreement, weather permitting.
3. First party represents and warrants to the second party that he
is the sole owner in fee simple absolute of the areas from which said
gravel is to be mined and removed by the second party, and that he has the
full right and lawful authority to grant to the second party said exclusive
right to mine and remove said gravel. First party further agrees that the
second party shall have five full years from the date of this agreement
within which to mine and remove the gravel from said areas as shown on the
annexed diagram.

4. It is agreed that the annexed diagram is a part of this agreement
as fully as though the same appeared herein above the signatures of the
respective parties hereto.
5. This agreement shall be binding upon the heirs, executors,
administrators and assigns of she first party and the successors and assigns
of the second party.
IN WITNESS WHEREOF the parties hereto have hereunto set their hands
and seals the day and year first above written.
