RE: DENIAL OF SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW
#1225 FOR AN OIL AND GAS SUPPORT AND SERVICE FACILITY (HAULING OF
CRUDE OIL) IN THE A (AGRICULTURAL) ZONE DISTRICT -WILMA PYLE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 16th day
of June, 1999, at the hour of 10:00 a.m. for the purpose of hearing the application of Wilma
Pyle, 29950 Weld County Road 57, Greeley, Colorado 80631, for a Site Specific Development
Plan and Special Review Permit#1225 for an Oil and Gas Support and Service Facility (hauling
of crude oil) in the A (Agricultural) Zone District on the following described real estate:
Lot A of Recorded Exemption #548; being part of
the NW% of Section 2, Township 5 North,
Range 64 West of the 6th P.M., Weld County,
Colorado
WHEREAS, at said hearing on June 16, 1999, the Board deemed it advisable to
continue said matter to June 30, 1999, at 10:00 a.m., and
WHEREAS, at said at said hearing on June 30, 1999, the applicant was represented by
Thomas Hellerich, Attorney, and
WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards
for review of said Use by Special Review, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, has studied the request of the applicant and the recommendation
of the Weld County Planning Commission and all the exhibits and evidence presented in this
matter and, having been fully informed, finds that this request shall be denied for the following
reasons:
1. It is the opinion of the Board of County Commissioners that the applicant has not
shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance, as
follows:
a. Section 24.4.2.1 -- The Board of County Commissioners finds that the
proposal is not consistent with the Weld County Comprehensive Plan
b. Section 24.4.2.2 -- The Board finds that the proposal is not consistent
with the intent of the Agricultural Zone District.

c. Section 24.4.2.3 -- The Board finds that the applicant has not proven this
proposal will be compatible with existing or future development of the
surrounding land uses. Urban development has already occurred in this
area and residential development will continue, thereby making the
expansion of this existing use incompatible.
d. Section 24.4.2.7 -- The applicant has not shown adequate provision for
the protection of the health, safety, and welfare of the neighborhood and
County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the application of Wilma Pyle, for a Site Specific Development
Plan and Special Review Permit#1225 an Oil and Gas Support and Service Facility (hauling of
crude oil) in the A (Agricultural) Zone District, on the hereinabove described parcel of land be,
and hereby is, denied.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 30th day of June, A.D., 1999.
