D., 1918 , between the STATE OF COLORADO, by its duly authorized officers, party of the first part, and Weld County of the State of Colorado, party of the second part, WITNESSETH: • WHEREAS, party of the second part has made application to the State Board of Land Commissioners, having control of the lands held by the State of Colorado, for right-of-way over, upon and across the surface of certain portions of Sec. 36, Twp 9-N, R-60-71, 6th P. M. - - as hereinafter described, for county road or public highway purposes, and, WHEREAS, said State Board of Land Commissioners has, in manner and form as provided by statute, granted such right-of-way for the purpose aforesaid, and none other, upon the terms and conditions herein set forth and has duly authorized the proper officers of said State to execute right-of-way deed: NOW; THEREFORE, THESE PRESENTS WITNESSETH, that said party of the first part, in consideration of the premises and in further consideration of the sum of One and no/100 Dollars 1.00 ) lawful money of the United States, by second party to first party in hand paid, the receipt whereof is hereby confessed and acknowledged, has granted, and'by these presents does grant, unto the party of the second part, its successors and assigns, right-of-way over, upon and across the surface of those certain portions of the herein described laud, as follows, to-wit: A strip of land 30 feet in width for road purposes, entirely along and adjacent to the North boundary of Sec. 36,- Twp 9-N, R-60-W. The party of the second part in accepting this deed covenants and agrees to construct and maintain upon and adjaeoit to said right-of-way hereinabove described such fences, crossings, culverts and subways as shall or nnay; in the opinion of the State Board of Land Commissioners, be necessary to the proper use and enjoyment of the lands adjacent thereto. • It is expressly understood and agreed by and between the parties hereto that this grant of right-of-way is made for the sole and only purpose of a county road or public highway as hereinabove described and for no other pur- pose whatsoever, and in the event that the party of the second part, its successors or assigns shall at any time use or attempt to use the said described strip or parcel of land for any other purpose whatsoever or shall abandon or discontinue the use of the strip or parcel of land hereinabove described, or shall in any manner fail or refuse to comply with any of the terms or conditions hereof, then this grant shall become void and of no effect, and all rights hereunder granted to party of the second part shall immediately terminate. Rg. 60 W. Your favor of the 15th inst. at hand. On July 6, 1917 this section was sold in. the following - manner and is now held under certificates of purchase: Ei to Harry E. Rhoadarmer, W* to Peter Hoakeman, both of Keota, Colo. Therefore the Board cannot grant a right of way without the written consent of the hold- ers of the certificates of purchase. However, with the understanding that should this permission be given, the Board would deduct no acreage for the right of way granted. There are therefore two methods of securing a right of way in such cases. One is to secure written consent from the holders of the certificates of pur- chase to the State Board of Land Commissioners so that they may grant right 'of way, and the filing of right of way application accompanied by those papers ; the _ other,- that the County secure from the holders of the certificates of purchase a quit claim_deed_t a-the right - ---- of way, said quit claim deed to be held in escrow until the final payment on those certificates has been made. These quit claim deeds may be mailed to the State Board of Land Commissioners with the request that the Board concur and that should the contracts or certificates be cancelled at any time prior to final payment and the land revert to the State, the State will grant to the County of Weld a ri=ght of way for the consideration of X1.00 plus the necessary filing fee and fee for issuing deed, upon the receipt of the proper formal right of way application. We estimate the probable cost of opening said road to travel to be$ *7OO �� We, the undersigned viewers, appointed to view the herein described road, recommend thut said road be granted except that part running East and West on section line bewteen sections 13, 14 and 15, and 22, 23 and 24, Township 10, Range 58, and between sections 16, 17 and 18, and 19, 20 and 21, Township 10, range 57. Said excepted portion being considered impracticable on account of hills, thereby necessitating considerable expense for improvement and maintenance.
