HomeMy WebLinkAbout981168.tiff RESOLUTION RE: BAN OF OPEN FIRES WITHIN UNINCORPORATED AREAS OF WELD COUNTY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, pursuant to Section 30-15-401(1)(n.5), C.R.S., as amended, the Board has the authority to ban open fires to a degree, and in any manner it deems necessary, to reduce the danger of wildfires within those portions of the unincorporated areas of the County where the danger of forest or grass fires is found to be high, based upon competent evidence, and WHEREAS, because of the warm temperatures and well below normal rainfall, creating a 15% or less moisture level in thousand hour fuels, there exists an extremely high fire danger for all of the unincorporated areas of Weld County, and WHEREAS, Ed Jordan, Weld County Sheriff, recommends that the Board adopt this Resolution, for the purpose of banning open fires in the unincorporated areas of Weld County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that: 1. Competent evidence exists to believe that there exists an extremely high fire danger for all of the unincorporated areas of Weld County. 2. As a result of the extremely high fire danger, pursuant to Section 30-15-401(1)(n.5), C.R.S., as amended, the Board hereby bans open fires in the unincorporated areas of Weld County. 3. The following activities are hereby deemed to be "open fires" for the purposes of this Resolution and are subject to the ban: a. Building, maintaining, attending or using any fire to burn trash, debris, fence rows, or vegetation, any campfire, warming fire, or charcoal grill, except in designated campgrounds, picnic areas, or developed recreation sites. b. Lighting fireworks of any kind. 4. The following persons and acts shall be exempt from the provisions of this Resolution: a. Persons with a valid written permit from the organized fire district within which an open fire is contemplated, or the Weld County Sheriff if the area for the proposed open fire lies outside of any organized fire district. 981168 SO0016 GC:` 50; Cml HL (EP); C5P RE: BAN OF OPEN FIRES WITHIN UNINCORPORATED AREAS OF WELD COUNTY PAGE 2 b. Any federal, state, or local officer or member of an organized rescue or firefighting force in the performance of an official duty. c. Any fires contained within a liquid fuel or gas fuel stove, fireplaces within buildings, or charcoal grill fires at private residences. d. Burning of irrigation ditches located within and completely surrounded by irrigated farmlands, where such burning is necessary for crop survival, and a specific written permit has been granted by the fire district encompassing the area of the burn, or by the Weld County Sheriff, if the area lies outside of an organized fire district. e. Campfires or bonfires required in religious ceremonies, and for which a valid written permit has been granted in advance. f. A federal agency or the Weld County Sheriff. BE IT FURTHER RESOLVED by the Board that the open fire ban stated herein shall remain in effect to and until August 3, 1998. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 6th day of July, A.D., 1998, nunc pro tunc, the 2nd day of July, A.D., 1998.
