HomeMy WebLinkAbout972597.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO DECEMBER 10, 1997 TAPE #97- 32 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial Center, Greeley, Colorado, December 10, 1997, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner George E. Baxter, Chair Commissioner Constance L. Harbert, Pro-Tem Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer - EXCUSED Commissioner W. H. Webster Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Esther E. Gesick Director of Finance and Administration, Donald D. Warden READ ORDINANCE BY TAPE: Commissioner Harbert moved to read Ordinance #147-M, 191-A, 198 and 199 by tape. Commissioner Hall seconded the motion, which carried unanimously. MINUTES: Commissioner Webster moved to approve the minutes of the Board of County Commissioners meeting of December 8, 1997, as printed. Commissioner Hall seconded the motion, and it carried unanimously. ADDITIONS TO AGENDA: There were no additions to the agenda. CONSENT AGENDA: Commissioner Harbert moved to approve the consent agenda as printed. Commissioner Webster seconded the motion, and it carried unanimously. PRESENTATIONS: 1997 EMPLOYEE SERVICE AWARDS - 10 AND 20 YEARS EMPLOYEES: The Board of Commissioners presented pins to employees for ten and twenty years of service with the County. 972597 BC0016 COMMISSIONER COORDINATOR REPORTS: PUBLIC INPUT: There were no Commissioner Coordinator Reports. No public input was offered. WARRANTS: Donald Warden, Director of Finance and Administration, presented the following warrants for approval by the Board: BIDS: All Funds $267,051.43 Commissioner Webster moved to approve the warrants as presented by Mr. Warden. Commissioner Hall seconded the motion, which carried unanimously. PRESENT REHABILITATION OF WELD COUNTY BRIDGE - ENGINEERING DEPARTMENT: Pat Persichino, Director of General Services, stated there are two vendors. These two bids will be considered for approval on Wednesday, December 24, 1997. BUSINESS: NEW: CONSIDER MEMORANDUM OF AGREEMENT FOR PEER INTERVENTION AND AUTHORIZE CHAIR TO SIGN: John Pickle, Director of Health Department, stated the Weld County Health Department has been awarded $8,500 by the Colorado Department of Public Health and Environment for the implementation of the Greeley Teen Pregnancy Prevention Outreach Program. Funding for this project is from November 3, 1997, through June 30, 1998. Commissioner Webster moved to approve said agreement and authorize the Chair to sign. Seconded by Commissioner Hall, the motion carried unanimously. CONSIDER AGREEMENT WITH UNIVERSITY OF NORTHERN COLORADO SCHOOL OF NURSING AND AUTHORIZE CHAIR TO SIGN: Mr. Pickle explained this agreement is a continuation of an existing agreement which provides clinical experience for University of Northern Colorado nursing students while working with the Health Department. The term of this agreement is from December 1, 1997, through November 30, 2003. Commissioner Hall moved to approve said agreement and authorize the Chair to sign. Seconded by Commissioner Webster, the motion carried unanimously. CONSIDER 1998 DRUG CONTROL AND SYSTEM IMPROVEMENT PROGRAM APPLICATION FOR MULTIJURISDICTIONAL TASK FORCE AND AUTHORIZE CHAIR TO SIGN: Commissioner Harbert moved to approve said application and authorize the Chair to sign. Seconded by Commissioner Webster, the motion carried unanimously. Minutes, December 10, 1997 972597 Page 2 BC0016 CONSIDER LETTER OF UNDERSTANDING AND AUTHORIZE CHAIR TO SIGN - LARIMERIWELD REVOLVING LOAN FUND: Mr. Warden stated this letter of understanding will allow all funds repaid under this contract, as well as funds repaid under all previous CDBG contracts, to be classified as miscellaneous income and retained as an asset of EDAP. Commissioner Harbert moved to approve said letter of understanding and authorize the Chair to sign. Seconded by Commissioner Hall, the motion carried unanimously. PLANNING: CONSIDER INCREASED FEE SCHEDULE FOR FEES COLLECTED BY THE WELD COUNTY DEPARTMENT OF PLANNING SERVICES FOR PROCESSING AND REVIEWING LAND -USE PERMIT APPLICATIONS: Monica Mika, Director of Planning Services, stated most of the fees which are increased are balanced by decreased corresponding fees. The Certificate of Compliance (COC) is the biggest change to the fees, which adds a $50 charge for each application. In response to Commissioner Hall, Ms. Mika stated the proposed fee for a COC is a one time charge which allows the Planning Department to verify all submitted information. In response to Chair Baxter, Ms. Mika stated follow-up is done on each permit, and medical hardships are checked on an annual basis. In response to Bruce Barker, County Attorney, Mr. Warden stated these fees are not included in the Fees Ordinance because it has always been a part of the planning process. In response to Chair Baxter and Commissioner Webster, Ms. Mika stated the increased fee schedules were approved by Planning Commission with one in opposition, and the change to #17 of the PUD fees is due to changing the PUD process. The fees are being redistributed based on the amount of work involved with each case. Commissioner Webster moved to approve said increased fee schedule. Commissioner Harbert seconded the motion. Commissioner Hall questioned if there should be any public input if the hearing was advertised as a public hearing, and the motion was withdrawn. Chris Jeavons, President of the Weld County Builder's Association, spoke on behalf of interested builders. Mr. Jeavons stated his concerns on how the increased fees will impact local builders, and consequently, homeowners. Mr. Jeavons also stated he realized the fees have not been changed for some time, but suggested phasing in the fees over a two-year period of time to distribute the effects of the change. Chair Baxter asked staff to respond to Mr. Jeavons concerns. Ms. Mika clarified the land -use fees have not been raised for two years, and the only increase will be for accessory permits. Mr. Warden displayed an overhead and explained it has been County policy that building inspection fees recover 100% of the cost of that department and that there be a 50 percent cost recovery from the Planning Department. Mr. Warden also explained the indirect costs used to determine recovery levels. Commissioner Webster moved to approve said increased fee schedule. Commissioner Harbert seconded the motion, which carried unanimously. Minutes, December 10, 1997 972597 Page 3 BC0016 CONSIDER INCREASED FEE SCHEDULE FOR FEES COLLECTED BY THE WELD COUNTY DEPARTMENT OF PLANNING SERVICES FOR PROCESSING AND REVIEWING BUILDING AND ELECTRICAL PERMIT APPLICATIONS: Ms. Mika explained the Board has adopted the 1994 Uniform Building Code; however, the County still charges the fees suggested for 1988, and staff recommends the Board adopt the fees suggested in the 1994 Code. Ms. Mika read the recommendation of the Building Trades Advisory Committee into the record. She did note only three members were present at the meeting and there is only one signature on the recommendation. Mr. Mika also stated neither the electrical or prefab structure fees are being changed. Mr. Warden stated the suggested changes will impact the budget by $21,000. Commissioner Harbert commented the County does not charge a sales tax as many of the municipalities do, therefore the builders are already receiving a break in Weld County. In response to Commissioner Hall, Dave Sprague, Planning Department, explained the commercial/industrial jobs are just below 65 percent so the increase is less. Mr. Warden stated the Planning Department often reviews one plan more than once and charges only for the initial review. Commissioner Hall commented that procedure seems unfair for the individuals who are building only one home, and questioned how the department knows if a plan is being used more than once. Commissioner Hall also stated the fees are too high, and suggested the plan be phased in, with the builders billed for an hourly rate. Roger Vigil, Planning Department, stated it would be difficult to know what hourly rate to bill, and how to keep track of interrupted working time. In response to Commissioner Harbert, Ms. Mika stated the plan checking would require move help rather than clerical area. Mr. Warden added that with past experiences it has been very time consuming to justify each time charge to each individual or company. Chris Jeavons, President of the Weld County Builder's Association, spoke again on behalf of concerned builders which will be effected by the increased fees. Mr. Jeavons suggested the Board consider the recommendation of the Building Trades Advisory Committee by phasing in the review fees over a two year period and stated the main concern is plan check fees. In response to Chair Baxter, Mr. Sprague stated the recommendation of the advisory committee is to increase the fees by one-half each year, and distributed the written recommendation to the Board. Commissioner Harbert moved 1994 Uniform Building Code Fees be adopted. Chair Baxter seconded the motion. After discussion, Commissioner Hall moved to amend the motion to phase in plan check fees for commercial and residential over a two-year period, with 50% of the proposed increase for each of the two years. Commissioner Webster seconded the amendment to the motion. Mr. Warden clarified the commercial plan checks are not proposed for increase; therefore, there is no change to those fees, and only residential plan check fees will be phased in over the two-year period. The motion to amend carried three to one, with Commissioner Harbert in opposition. The amended motion carried unanimously. (Commissioner Webster excused.) Minutes, December 10, 1997 972597 Page 4 BC0016 FIRST READING OF ORDINANCE #147-M IN THE MATTER OF THE REPEAL AND RE-ENACTMENT OF CERTAIN PORTIONS OF ORDINANCE #147-L, WELD COUNTY COMPREHENSIVE PLAN ORDINANCE: Kerri Keithley, Department of Planning Services, explained there are two revisions to the Weld County Comprehensive Plan. The word "urban -scale" is to be added to A.Goal 3 and A.Policy 3. Commissioner Hall moved to approve Ordinance #147-M on first reading. Commissioner Harbert seconded the motion, which carried unanimously. FIRST READING OF ORDINANCE #191-A IN THE MATTER OF THE REPEAL AND RE-ENACTMENT OF CERTAIN PORTIONS OF ORDINANCE #191, WELD COUNTY MIXED USE DEVELOPMENT PLAN: Ms. Keithley explained the change in Section 2.7.3 involves paving all parking areas for commercial and industrial development to be consistent with the urban -scale development standards in the Mixed Use Development area. Ms. Keithley stated this change will also provide clarification for the Public Works Department. In response to Chair Baxter, Ms. Keithley stated Ordinance #191-A passed in the Planning Commission meeting with a four to one vote. Commissioner Hall moved to approve Ordinance #191-A on first reading. Commissioner Harbert seconded the motion, which carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the consent agenda. Ordinances #147-M and #191-A were approved on first reading. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
