Kirkmeyer, Chair Commissioner George E. Baxter, Pro-Tem Commissioner Dale K. Hall Commissioner Constance L. Harbert Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Chris Goranson The following business was transacted: I hereby certify that pursuant to a notice dated August 21, 1996, and duly published August 29, 1996, in the North Weld Herald, a public hearing was conducted to consider the request of Don and Linda Owens for a Site Specific Development Plan and Special Review Permit for an agricultural service establishment (equestrian center and ranch) in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Chris Goranson, Planning Department representative, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. He explained the proposal is for an equestrian center ranch which will employ three to five people, be open seven days per week, and have approximately 40 to 60 visitors per week. Mr. Goranson noted Gerrity Oil and Gas Corporation has concerns regarding the proposal, and a representative is present. Don Owens, applicant, submitted a brochure of their present facility, Gloraloma Ranch, as Exhibit B and stated a similar facility is proposed at the subject site. He explained road construction went through the center of their current location, which they have operated and made their living from for 20 years. David Siple, President of Gerrity Oil and Gas Corporation, stated Gerrity owns and operates a well in the SWSE1/4 of the subject property, which is active and must be accessed daily. He stated Gerrity has a current surface lease with the seller and stated concerns are that Gerrity be allowed continued access to the property and have the right to move in heavy-duty equipment for any necessary work. Mr. Siple stated Gerrity completed a line locate for the buyers a few weeks ago and is willing to work with the buyers; however, they must be aware of what Gerrity is doing. Responding to questions from the Board, Mr. Siple explained Gerrity is required to abide by the rules and regulations of the Oil and Gas Commission, and a 150-foot setback from the wellhead 961580 : PL PL1039 RE: HEARING CERTIFICATION - OWENS (USR#1120) PAGE 2 is required. He reiterated the possibility of moving heavy equipment on site and stated Gerrity could utilize up to three acres for certain projects. No further public testimony was offered, and Mr. Owens confirmed no structures would be built within the 150-foot radius. He also agreed to sign any agreement Gerrity provides and confirmed access will be allowed. He reiterated anything Gerrity proposes is fine, and they can relocate the riding arena if necessary. Mr. Owens agreed with all Conditions of Approval and Development Standards. Mr. Morrison and Mr. Goranson suggested the agreement reference access, with the specifics to be resolved between Gerrity and the applicant; and a copy must be provided to Weld County. Mr. Owens confirmed the existing access will not be disturbed. Mr. Goranson also suggested the radius be shown on the plat with a "no construction easement" for setbacks. Mr. Morrison clarified the County must know the agreement is resolved prior to the plat being recorded and suggested adding said requirement as a Condition of Approval. Commissioner Hall moved to approve the request of Don and Linda Owens for a Site Specific Development Plan and Special Review Permit for an agricultural service establishment (equestrian center and ranch) in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval, as amended, and Development Standards as entered into the record.
