ANSWER OF UNITED STATES
COMES NOW defendant, the United States of America, on behalf
of its agency Department of Energy, Western Area Power
Administration("WAPA") , by and through its attorneys, United

Answer, state as follows:
1. WAPA is without knowledge or information sufficient to
form a belief as to the truth of the allegations contained in
paragraphs 1-5, 7-17 of the Complaint and, therefore, denies the
same.
2. With respect to paragraph 6, WAPA admits that it claims
an interest in the property which is the subject matter of this
action, based on a Contract and Grant of Easement for an electric
transmission line dated December 1, 1950, from Leona Perry, and
recorded April 20, 1951, in Book 1301, page 72, in the records of
Weld County, Colorado, and as reflected by the copy attached
hereto, marked Exhibit A. The United States has physically
occupied this easement for electric transmission for over 45
years. This easement is valid and enforceable and burdens the
subject property. WAPA' s rights under the easement are prior and
superior to the claims and interests of the plaintiff and are
prior and superior to those of any and all other defendants. The
United States has been using the easement in a manner which is
actual, open, notorious, exclusive and adverse for well over 18
years in accordance with Colo. Rev. Stat . § 38-41-102 (1996) .

5. Denies each allegation not specifically admitted.
WHEREFORE, Defendant, United States of America, Western Area
Power Administration, prays for judgment as follows:
a) That the relative priorities and rights of all parties
with respect to the property at issue described in Plaintiff ' s
Complaint be determined by the Court;
b) Declare that the United States has a valid and
enforceable easement which burdens the property and that WAPA' s
rights under the easement are prior and superior to those of the
plaintiff and are prior and senior to those of any and all other
defendants.
c) Provide such other relief as the court deems
appropriate.
