RE: ACTION OF THE BOARD REGARDING VIOLATION OF THE WELD COUNTY
BUILDING CODE AND ZONING ORDINANCES - BILLY MATA
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Billy Mata, VI #9700114, is allegedly in violation of the Weld County
Building Code and Zoning Ordinances, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 14th day of October, 1997, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Billy Mata, said property owner, was present at said hearing, and
WHEREAS, Department of Planning Services staff has determined the residence on
said property to be dangerous to persons under the Uniform Code for the Abatement of
Dangerous Buildings, and
WHEREAS, the Board of County Commissioners deems it advisable to continue said
violation for ninety (90) days, during which time the property owner must post and secure said
property against entry and make arrangements for the abatement of asbestos in the building on
said property.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that said violation be, and hereby is, continued to January 13, 1998, at
10:00 a.m.
BE IT FURTHER RESOLVED by the Board that the property owner be, and hereby is,
instructed to post and secure said property against entry and make arrangements for the
abatement of asbestos in the building on said property.

The dangerous building is still located on the property, therefore is a violation of Sections 302(4)
of the Uniform Code for the Abatement of Dangerous Buildings. To bring the property into
compliance the house must be demolished.
The Department of Planning Services also recommends that the County Attorney authorize legal
action against any other persons occupying the properties, any persons claiming an interest in the
properties, and any persons acting in active concert with the identified parties.

ITEMS DISCUSSED: Asbestos on Billy Mata's house. As it sits the asbestos siding is non -friable. When it
is removed (broken) it becomes friable. He has been working with Billy to get him to the appropriate people
to dispose of the asbestos siding. He referred Billy to Cindy Anderson at Risk Removal in Ft. Collins. This
company does the removal and disposal of asbestos. An unoccupied house would cost a minimum of
$2000.00 and an occupied house could range between $10-15,000.00. There are no apparent resources in
helping Mr. Mata to demolish his house.

NOT AVAILABLE. MR. MATA SAID HE HAS NOT PAID FOR THE
REPORT YET. HE DOES NOT HAVE A JOB NOR DOES HE HAVE ANY
MONEY TO HAVE THE ASBESTOS REMOVED OR THE BUILDING
ISHED. HE TRIED THE HOUSING AUTHORITY WHO REFERED
URBAN RENEWAL, BUT THEY HAVE NO MONEY FOR HIM NOW.
ASKED ABOUT HAVING THE COUNTY DO THE WORK AND BILLING HIM,
BUT I TOLD HIM IT IS NOT THE WAY THAT WORKS. I SAID ONE
OPTION THE BOARD OF CTY COMMISSIONERS HAS IS TO HAVE THE
13 WORK DONE AND BILL HIM, BUT IT WOULD PROBABLY COST HIM MUCH
14 LESS TO HAVE IT DONE HIMSELF. HE WILL CONTINUE TO TRY TO

demolish the house located at the above legal description and remove all debris, including the foundation.
I conducted a site inspection on September 3, 1997, and noted that the house has not had the asbestos
siding removed nor has the house been demolished.
In a telephone conversation last week, you told me the asbestos inspection was accomplished and a
report was sent to this office. We have not received a copy of that report to date. Although we do not
wish to impose undue hardship on you, the house at 3801 McAvoy Avenue must be demolished in
accordance with the Abatement order issued to you. This Department has no means to assist you, but
the Weld County Housing Authority may be able to help. As stated in the letter of June 24, 1997, if the
house is not demolished and the debris removed, this work may be performed under the direction of Weld
County and the costs will then be charged to you as the owner of the property.
Failure to comply with the demolition and removal of the debris by September 22, 1997 will result in this
case being scheduled before the Board of County Commissioners.

This letter is in response to our telephone conversation on August 14, 1997. Ed Stoner, Lead
Building Inspector sent you a letter on July 9, 1997 which stated that the demolition and removal
of debris, including the foundation, must be completed by September 1, 1997. The building permit
for the demolition of the structure has been applied for, but to date has not been paid for. Also,
to date we have not received an inspection report from the asbestos inspector. The time frame
given to you will remain the same and all work must be complete by September 1, 1997 or we will
have no choice but to continue with Abatement proceedings.

Dear Mr. Mata,
This letter is to inform you that the residence located at 3801 McAvoy Avenue, Evans Colorado was
inspected on June 18, 1997. Due to the extensive fire damage, it has been determined to be a dangerous
structure as defined by the Uniform Code for the abatement of Dangerous Buildings, Section 302(4) and
must be demolished.
You are hereby ordered to take steps to ensure that no further use or occupancy of the building is allowed
after July 10, 1997. In addition, you are hereby ordered to secure a demolition permit for this structure by
July 1, 1997. You are further ordered to have the demolition and all debris removed from the property by
