The meeting was called to order by Vice-Chairman, Ann Garrison. The summary of the last regular meeting of the Weld County Planning Commission on January 16, 1996, was approved. 1. CASE NUMBER: USR-1106 PLANNER: Gloria Dunn APPLICANT: David L. and Donna J. Reed REQUEST: Site Specific Development Plan and a Special Review permit for a trash business in the A(Agricultural)zone district. LEGAL DESCRIPTION: Part of Lot 2, Union Colony Subdivision in part of the NW4 of the SE4 of Section 9, T5N, R65W of the 6th P.M., Weld County, Colorado. LOCATION: South of and adjacent to East 16th Street, and east of Balsam Avenue Gloria Dunn, asked the Planning Commission members, if they would choose to hear case USR-1106, or continue this case until February 20, 1996, to allow the City of Greeley's Planning Commission to send their formal recommendation on this case. Arlan Marrs moved to hear Case Number USR-1106. Jack Epple seconded the motion. The Vice Chairman asked the secretary to poll the members of the Planning Commission for their decision. Ron Sommer- no; Ann Garrison - no; Marie Koolstra- no; Jack Epple- no; Arlan Marrs-yes; The motion was denied with a four to one vote and USR- 1106 was continued until February 20, 1996, at 1:30p.m. 2. CASE NUMBER: USR-1102 (Continued from January 4, 1996 regular scheduled meeting) PLANNER: Shani L. Eastin APPLICANT: Owens Brothers Concrete Company REQUEST: A Site Specific Development Plan and a Special Review permit for a wet sand and gravel mining operation in the A(Agricultural) zone district. ,66-0'7/A9- �� �2// 960354 MINUTES OF THE WELD COUNTY PLANNING COMMISSION MEETING February 6, 1996 Page 2 LEGAL DESCRIPTION: The W2 of Section 32, T3N, R67W of the 6th P.M., Weld County, Colorado. LOCATION: East of and adjacent to Weld County Road 15; south of and adjacent to Weld County Road 26-3/4. Shani L. Eastin, Current Planner explained this property is located one mile west of Weld County Road 13 and lies directly north of Weld County Road 26. The staff finds this application to be compatible with existing surrounding land uses and with future development in the area. Shani L. Eastin, stated that there are numerous sand and gravel mining operations in this area. The Department of Planning Services staff has received numerous letters from surrounding property owners, which are attached in the case. The applicant have been working with the Department of Planning Services and the surrounding property owners addressing their concerns. The Department of Planning Services is recommending approval of this application with the Conditions of Approval and the Development Standards. The Vice-Chairman asked if there was anyone in the audience who wished to speak for or against this application. The applicant, John Owens, explained this is a family owned business with 130 employees in five plants. Owens Brothers Concrete Company purchased this property in 1985 with the intent to mine it. Their plans are to have permits in process and within two years be mining the property. Paul Banks and Paul Gesso, consultants for Owens Brothers, addressed issues. Paul Banks explained in detail the location and what uses this property has now. The Last Chance Ditch runs through this property of which the Owens Brothers own 1 1/2 shares. This amount of should be enough water required on the property. Paul Banks stated this property was located on 105 acres. The Owens Brothers Concrete Company would be mining 86 acres with annual production of 150,000 tons. Planned truck routing for this time would exit the property to the west on Weld County Road 15 proceed south on Weld County Road 26 over Highway 119 out to 1-25. Estimated operation time would be 250 days a year. Taking the tonnage by the operating days this would average 48 truck trips a day. Water issues addressed surface drainage routed into the pits themselves. The Last Chance Ditch will be maintained as it is, not be disturbed and maintained on-site by the company. There are two laterals on the property. The applicant will ensure the water still flows to the ultimate users of those laterals. The property is located in 100 year flood. The applicant stated they will follow all State and County regulations with regard to Flood Plain development. Paul Gesso stated they agreed with the referrals agencies responses and concerns and that they were working with the owners of gas and oil interests. Letters had been received from North American Resources, Vessels, and Sinclair Pipeline, with written agreements. Paul Gesso addressed concerns with Conditions of Approval#1 that staff was requesting the plat be recorded within 15 days. He stated the plant wasn't even designed and couldn't possibly be done in this short period of time. MINUTES OF THE WELD COUNTY PLANNING COMMISSION MEETING February 6, 1996 Page 3 Discussion followed with Planning Commission members, Assistant Attorney Lee Morrison, and Current Planner, Shani L. Eastin. Upon agreement Condition of Approval#1 would read: The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review Plat prior to recording the plat. The completed plat shall be delivered to the Department of Planning Services within 15 days of approval by the Board of County Commissioners. Marie Koolstra, had questions on pumping the water to low basin and how far an area will this effect. Paul Banks stated the radius influence around a well varies with the characteristics. He estimated it would be three to five hundred feet. Paul Banks explained that five hundred feet relates to 1/2 foot decrease in the water tables. Paul Banks felt the immediate surrounding areas might experience a foot or two drop to the water tables. Paul Gesso also stated strict regulations through the State Engineers Department would also ensure protection of the wells. Don Carroll, Public Works Department addressed concerns with road maintenance. The Public Works Department is recommending that paving be done from the entrance of the site to Weld County Road 13. Don Carroll stated that occasionally they will do this in phases for the company. Maria Koolstra asked how many hours a day the operation would run. Shani L. Eastin, indicated the Zoning Ordinance, Section 44.4.2 specifically states that all sand and gravel operations will be conducted during the hours of daylight The Vice Chairman asked if their was anyone in the audience who would like to speak for or against this application. Herb Acord, surrounding property owner,and representative for his Uncle Gilbert Acord stated that they have lateral ditches coming into their property. He also stated they have underground water to the property to water their cattle, and wanted assurance or some verification that they would continue to have water. Discussion followed and Lee Morrison, Weld County Assistant Attorney, suggested a condition for the issues on the laterals, be addressed. Joe Timko, surrounding property owner also addressed water concerns. Ron Sommer, motioned that Conditions of Approval#3i and#3j be added to state: #3i.) The applicant shall submit an agreement with Gilbert Acord, user of the laterals crossing the subject property, regarding the relocation of the laterals to provide continued delivery of irrigation water. A copy of this agreement shall be provided to the Department of Planning Services;#3j.) If dewatering occurs the applicant shall be submit an agreement to provide adequate water for the unregistered wells and springs of Mr. Gilbert Acord and a copy of that plan shall be submitted to the Department of Planning Services. This provision is conditional upon the allowance of the applicant to place monitoring wells on the property. Jack Epple seconded the motion. The Vice-Chairman asked the secretary to poll the members of the Planning Commission for their decision. Marie Koolstra seconded the motion. The Vice-Chairman asked the secretary to poll the members of the Planning Commission for their decision.
