CASE NUMBER: CompAmend - 6, (Continued from March 7, 1995, meeting). APPLICANT: Gary Tuttle/Tuttle-Applegate, Inc. REQUEST: Amendment to the 1-25 Mixed Use Conceptual Plan. LEGAL DESCRIPTION: The SE4 of the railroad grade of Section 7, the NW4 and the NE4 of Section 18, and the NW4 of the railroad grade of Section 17, all in T2N, R68W of the 6th P.M., Weld County, Colorado. LOCATION: East of Weld County Road 1; north of Weld County Road 20-1/2, and south of the railroad grade. Gary Tuttle, representative for the property owner, spoke in favor of the request. Mr. Tuttle stated that this was a continuation from the March 7 meeting. Mr. Tuttle said applicant was available for any questions pertaining to the case but felt most information was presented at the prior meeting. Mr. Tuttle concurred with staff recommendations. The Chairman asked if there was anyone in the audience who wished to speak for or against this application. No one wished to speak. Judy Yamaguchi moved CompAmend 6 be forwarded to the Board of County Commissoners' with the Planning Commission's recommendation for approval. Jack Epple seconded the motion. The Chairman asked the secretary to poll the members of the Planning Commission for their decision. Motion carried. 950707 WELD COUNTY PLANNING COMMISSION MEETING March 21, 1995 Page 2 APPLICANT: Sylmar Mobile Home Park REQUEST: Site Application (on -site wastewater treatment system). LEGAL DESCRIPTION: The SW4 of Section 31, T1N, R66W of the 6th P.M., Weld County, Colorado. LOCATION: East of and adjacent to State Highway 85; north of and adjacent to Weld County Road 2. Ed Church, representative for Sylmar Mobile Home Park, spoke in favor of the request. Mr. Church stated they were proposing an on site sewage disposal system to replace the current failing septic system, which supplies sewage disposal to 104 spaces (100 coaches and 4 RV homes). The closest current sewage disposal site is in Brighton, they have pursued connecting the park with them and they feel that this would be too costly. Bud Clemons asked what the Park was currently using, Mr. Church stated they are currently using a septic system that is surfacing and is currently under violation. Marie Koolstra was concerned with the current and proposed disposal of the sewage. Extensive discussion followed. Concern that the treatment site was not on the Mobile Home site was brought up by Bud Clemons, Mr. Church stated that the new site is adjacent to the site and is being leased. The Chairman asked if there was anyone in the audience who wished to speak for or against this application. No one wished to speak. Ron Sommer moved that the Chairman sign the site application as being approved and forwarded a copy of the Planning Commission recommendation for approval to the Board of County Commissioners with staff recommendation. Curt Moore seconded the motion. The chairman asked the secretary to poll the members of the Planning Commission for their decision. Brighi Fourth Family Limited Partnership/Rudolf G. Danford REQUEST: A Change of Zone from A (Agricultural) to C-3 (Commercial). LEGAL DESCRIPTION: Lot A of RE -1680, located in part of the SE4 of Section 4, T5N, R66W of the 6th P.M., Weld County, Colorado. LOCATION: West of and adjacent to 59th Avenue; north of Highway 34 Business Route. Glen Droegmueller, representative for the property owners, spoke in favor of the request. Mr. Droegmueller stated that Mr. Danford was now sole owner of the property. The parcel in question was previously zoned both A (Agricultural) and C-3 (Commercial), with the intent to rezone the parcel all C-3 zoning. 950797 WELD COUNTY PLANNING COMMISSION MEETING March 21, 1995 Page 3 The proposed use for the property would be for a retail store, a 6,000 square foot building, 2,500 square feet being store area and the rest being storage. Concerns included access, which have been discussed with the State of Colorado, with a condition of approval that it would be a minimum of 200 feet from Highway 34 right-of-way, it was agreed that one access would be sufficient. The septic has been approved by the Weld County Health Department. There is no domestic water with the City of Greeley at the present time. Bottled water would be used for drinking purposes and a cistern would be used for other domestic purposes until such time as water services are provided as the same as sewer. Ron Sommer was concerned with the City of Greeley Planning denying the request, and Planning Commission approving the request, to meet the guideline into the entry way of the master plan. Mr. Droegmueller agreed to any changes that are made to the plan they will comply with. Keith informed the board that the applicants must apply for a Site Plan Review. The entry way issue would be reviewed in more detail there. Bud Clemons asked Keith which water district serves the area, and presently there is no water district that serves this area, Mr. Droegmueller affirmed this by stating there are only distribution lines. Bud also asked if Mr. Droegmueller believed that the City would provide any services without any annexation. Mr. Droegmueller stated that the City would not force an annexation, only voluntary. Mr. Droegmueller was in agreement with the staffs recommendations. The Chairman asked if anyone in the audience would like to speak for or against the application. No one wished to speak. Bud Clemons moved Case Z-493 be forwarded to the Board of County Commissioners with the Planning Commission's recommendation for approval. Marie Koolstra seconded the motion. CASE NUMBER: S-377 APPLICANT: Jack Olberding, Bill Bedell, John C. Widerquist, Terry A. Henze. REQUEST: A Planned Unit Development Final Plan. LEGAL DESCRIPTION: The NW4 SW4 of Section 29, T2N, R68W of the 6th P.M., Weld County, Colorado. LOCATION: West of and adjacent to Weld County Road 3-1/4; south of and adjacent to Weld County Road 16-1/2. Gary Tuttle, representative of the applicant, spoke in favor of the request. Mr. Tuttle stated that they are in the third and final stage of the PUD and that the Site Plan has not been changed. There is presently a 25 acre lake that sits inside the 40 acre parcel. There are 5 lots that surround the lake each 2 to 3 acres per lot. The outlot is going to be kept up by the Home Owners Association. The Chairman asked if there was anyone in the audience that wished to speak for or against the application. Both Mike Shaw and Greg Shaw who's family resides on the property to the north and east of the proposed subdivision. Mike Shaw's concerns are with the property being agricultural and the idea of a subdivision that is not compatible with agricultural farming and livestock. He stated the only other property owner who has agreed to the subdivision has sold his property to the four families. Another concern of Mr. Shaw was that the property only sits 1 foot above floodplain, leaving the subdivision in a flood area. Greg Shaw also spoke against the application stating his concerns with the wildlife and that some of the wildlife are endangered species. He then entered as exhibits 4 pictures he has taken of some wildlife around the property understanding that the pictures would be considered as evidence. Bud Clemons moved that Case S-377 be forwarded to the Board of County Commissioners with th Planning Commisson's recommendation for approval. Jack Epple seconded the motion. The Chairman asked the secretary to poll the members of the Planning Commission Board for their decision. CASE NUMBER: USR-1075 APPLICANT: Rex Hiner REQUEST: A Site Specific Development Plan and Special Review permit amending existing SUP -423, for an asphalt and concrete batch plant, and addtiion of an oil field construction business, and a recreational facility in the A (Agricultural) zone district. LEGAL DESCRIPTION: The NW4 of Section 31, T6N, R65W of the 6th P.M., Weld County, Colorado. LOCATION: South of and adjacent to "O" Street; east of and adjacent to 25th Avenue. Mike Ketterling, representative of the property owner, spoke in favor of the application. There is currently a Use by Special Review permit on the property for the asphalt and concrete plant and permits for mining and graveling. Mr. Hiner would like to use the property also for storing of equipment and use the lake for recreational use. Applicant is in agreement with the staff recommendation's with exception to a septic tank and use of portable toilets which they have been presently using for temporary use. They would also like to ask that the recommendation by the City on screening the equipment be removed, stating that Mr. Hiner keeps up his property. 930797 WELD COUNTY PLANNING COMMISSION MEETING March 21, 1995 Page 5 Richard Kimmel asked staff where they had planned to place the fences. Todd Hodges stated that they had planned to place them adjacent to any property owner and any right-of-ways. Another screening area they are looking at screening was an area where they are presently storing. Ron Sommer asked how the second storage area was brought into the application. The Board was confused as to what exactly they were screening from. Jeff Stoll from the Weld County Health Department spoke on behalf of the issue of the septic system. Jeff told the board that they are allowing a minimal septic with the exception of portables in the event of a special occasion. Bud Clemons asked what they are currently using, and Jeff stated they are using portable toilets. Mr. Clemons also asked if they would only be allowed to use the portables in the event of a special sporting event, Jeff said they were concerned with this and also with being consistent with other similar applications and their policy. Richard Kimmel asked Mr. Stoll if they were in need of a vault system, and would be able to use the portables only in the event of special occasions. Bud Clemons was concerned with the wording of temporary use of the potables with a special occasions, Jeff said that they could amend the wording to state it to say they would allow the use of portables in the event of a special occasion. Rick Dinkle, who spoke for the applicant and also manages the property for Mr. Hiner, stated that at the current time they have no intention of holding any type of special event, their are currently six members to the lake. They use the lake in the summer months and park only a few RV campers, which they are then removed in the fall. Mr. Dinkle enforces each day that the campers, which have there own portables, are disposed of daily. When asked how many people are at the lake at one given time, Mr. Dinkle said no more than ten. The existing use that is on site for the gravel site is a septic which is located behind Mr. Hiner's home. Richard Kimmel asked Jeff Stoll if the Health Department would be in agreement with saying that portable toilets could be used in the recreational area at this time with the idea of getting a vault system if there is a substantial change. Jeff agreed that if the board felt that this lake is different from other ski lakes, and that they have demonstrated they can adequately handle the capacity, that they would be a agreement. Judy Yamaguchi asked if this was a private or restricted area, Mr. Dinkel stated that is was private and was fenced off and used only by members. Guests are allowed from time to time. The Chairman asked if anyone in the audience wished to speak for or against the application. No one wished to speak. Ron Sommer moved that Developmental Standards # 7 and 14 be changed as follows: ( 7) - Portable toilets will be allowed for use in the recreational area; (14) - Outdoor storage shall be limited to the areas as delineated on overhead A & B. CASE NUMBER: USR-1076 APPLICANT: Craig McConnel REQUEST: A Site Specific Development Plan and a Special Review permit for a bed and breakfast in the A (Agricultural) zone district. LEGAL DESCRIPTION: Section 1, T8N, R56W of the 6th P.M., Weld County, Colorado. LOCATION: East of and adjacent to Weld County Road 155; approximately 1 mile north of Weld County 94 right-of-way. Craig McConnel, applicant, spoke in favor of the application. Mr. McConnel asked to clarify that the wording in the application be changed to say guest rooms instead of the current wording of bedroom, which would be in accordance with the Weld County Building Inspection Department. Todd Hodges stated that he spoke with the Building Inspection Department in regards to the maximum number of 5 bedrooms total. Bud Clemons asked for clarification on the difference between bedroom and guest rooms. Ed Stoner was called to clarify at this time, but the board decided they needed more clarification before sending it on to the Board of County Commissioners. Mr. McConnel is currently residing in the basement which he considers to be bedrooms. There are currently three guest rooms. One of the bedrooms now can be converted over to a guest room if needed. The Weld County Building Code Ordinance states that more than 5 guests rooms is considered a hotel. Ron Sommer moved that Case USR-1076 be forwarded to the Board of County Commissioners with approval along with Developmental Standards with clarification given differentiating bedrooms from guest rooms and to amend the location as stated. Bud Clemons seconded the motion. The Chairman asked the Secretary to poll the Planning Commission for their decision. CASE NUMBER: 2nd Amended USR-877 APPLICANT: C&M Aggregates REQUEST: A Site Specific Development Plan and 2nd Amended Special Review permit for an asphalt and concrete batch plant. LEGAL DESCRIPTION: That part of the NW4 of Section 17, T2N, R68W of the 6th P.M., Weld County, Colorado. LOCATION: North of and adjacent to Weld County Road 20-1/2; approximately 1-1/2 miles west of Weld County Road 7. 95079j7 WELD COUNTY PLANNING COMMISSION MEETING March 21, 1995 Page 7 Vern Nelson, representative for the property owner, spoke in favor of the application, also giving history of the property owners past and present. The application involves a 15 acre parcel within USR-877. They are asking to use the installation of one concrete and asphalt batch plant, a storage for recycled concrete, and 2 portable offices. No structures are being planned. Access to site to remain the same. Their plan is to consolidate 2 operations into 1 operation. The transfer of material would be by conveyor instead of by trucks, which they feel will reduce traffic. No changes in septic. If approved this would allow the company to operate on either property, but not both consecutively. The Planning Commission had concerns with 2 plants running at the same time, Mike Reifer clarified that this would not happen, but would like the option of mining one area and going back to the other. Ron Sommer also asked for wording to conditions on running the plant concurrently. Planning Commission asked that a condition of approval be worded for the board to hear before their decision. Keith Schuett suggested verbage as follows. #21 The Concrete Batch Plant and Asphalt Batch Plant located on USR 2nd Amended 877 shall not be located or operated concurrently with a Concrete Batch Plant or Asphalt Batch Plant located on USR-1046. The Chairman asked if their was anyone in audience that would like to speak for or against the application. No one wished to speak. Ron Sommer moved that an additional Development Standard be added. Judy Yamaguchi seconded the motion. Motion carried. The Chairman asked the Secretary to poll the members of the Planning Commission for their decision.
