Dear Mr. Ballstadt:
As counsel for the Windsor Reservoir & Canal Company we have reviewed the
referenced case concerning Moriah Estates.
The Board of WRCC has approved the subdivision P.U.D. with the following proviso or
exception:
1. The final design and layout of the inflow structure or erosion control matters
presently described in the Foundation Engineering report under erosion control as
"rip rap" shall be reviewed and approved by the superintendent for WRCC. This
is Mr. Bill Johnston who may be contacted through the WRCC general office in
Eaton, Colorado at (970) 454-3377.
I have spoken to Foundation Engineering and am comfortable with the design.
Foundation Engineering has recognized that the final design and configuration
will need to be determined by site specifics and everyone seems in accord with
this practicality.
With this understanding, the WRCC has no further comment or object to the subdivision
and will welcome notification of our involvement relative to inflow.

Dear Commission Members:
I support the plans for the Moriah Estates as proposed by Mr. Jim Scott of Integrity Builders. It
seems that Mr. Scott is proposing a development that will result in a very high quality residential
area while at the same time preserving the rural atmosphere, surrounding agricultural areas, open
spaces, view and other desireable aesthetic values of the area. These qualities are what we
residents appreciate and want to see maintained for the area.
I understand there has been some consideration or interest by Windsor in possibly annexing the
Moriah area. I am against that occurring because I believe it would help destroy the character and
qualities of the area that we like so much. I specifically dislike the idea of street lights being on at
night. I believe that is a requirement for areas within the city limits.
My first preference would be for the surrounding areas to remain in agricultural production with
little or no additional residential or industrial development. However, realizing that development
will eventually occur, 1 think Mr. Scott is proposing a reasonable alternative for development.
I hope you will give my opinion and concerns ample consideration in your decisions.

At the July 2, 1998 meeting,the Windsor Planning Commission recommended that this proposed
subdivision request be denied since the property is located within the Town's Growth Management Area
Boundary,and that the Applicant should be required to file an annexation petition with Windsor for
posshbtc annexation to the Town. Since(a)the proposed subdivision lics within the Town's Growth
Management Area Boundary,and(b)the proposed lot sizes and the proposed septic tank layout of the
subdivision still do not meet the Town's minimum standards for estate lots,the Windsor Planning
Comnnsstan recommends denial of this rezoning request.

Subject: Moriah Estates Water Budget RECEIVED
Dear Mr. Scott:
The Weld County Health Department (WCHD) has reviewed the water budget,
conducted by Wright Water Engineers, Inc., for the proposed Moriah Estates
Subdivision. The water budget is dated January 18, 1999.
The WCHD has several comments concerning the water budget. They are as follows:
1) According to page 2 of the water budget, the property where Moriah Estates is
proposed has water rights that yield approximately 91.3 acre-feet per year. It
appears that the water budget was conducted under the assumption that the
entire 91.3 acre-feet was retrieved and applied each year to the property. Based
upon your testimony at the Weld County Planning Commission, I was under the
impression that the property was not very productive. Was the entire 91.3 acre-
feet applied to the land despite the fact that it was non-productive?
2) The water budget was conducted using a factor for potential evapotranspiration
for certain crops. Again, since the land was non-productive, were the factors used
representative of the consumption of non-productive crops? In the event the
property was not very productive and the yield was less than typical, we
recommend that the potential evapotranspiration be adjusted accordingly and the
water balance re-calculated.
3) According to page 2, the water budget was conducted assuming that no irrigation
will occur in the open space. However, the materials that you submitted to the
Weld County Planning Department, more specifically, page 12 of the Development
Guide, states that "The use of existing irrigation water on these fields and harvest
of the grass hay will lend itself to a number of secondary advantages." This item

must be clarified. Irrigation of the open space would significantly affect the water
budget and the groundwater levels beneath the subdivision. In the event the open
space will be irrigated the water budget should consider this fact and be re-
calculated. In the event you will not be irrigating the open space we will
recommend that a condition be placed on the plat or in the covenant that prohibits
irrigation of the open space.
Additionally, we request that you submit the water budget to the staff at the Colorado
Geological Survey for their review and comments. Please provide us a copy of any
comments that they may have.
We would appreciate a response to our comments prior to your next hearing with the
Weld County Board of County Commissioners.

I would respond to your comments and concerns in a letter dated
January 20, 1999 as follows:
1. Yes. All water rights currently associated with this parcel of land
have historically been used to irrigate crops. The testimony given at the
Weld County Planning Commissions' meeting regarding the productivity of
the parcel, was given by the former farmer, Manuel Pineda, and a
neighboring farmer, Fred Walker. Both testified this land was not "Prime"
farm land. I myself am not a farmer and can only testify that the Soil
Conservation Service classified this land as moderately productive.
2. As for the productivity of this land and amount of water used.
Again, I am not a farmer, but I believe there are many other factors that
contribute to the productivity of a parcel of land. Soil type, and the ability to
hold moisture certainly would play some roll, as well as topography and
fertileness of the soil.
3. As you know, this report is but an estimate as to the effect
development will have on the ground water level. We took the position of
not irrigating the open space in this report, knowing this would be the best
possible position achievable with regards to ground water level and
recognizing it as a fall back position, if it were to become necessary. We,
however, are not inclined to give up the right to irrigate the open space
based upon estimation and speculation about what factors contribute to
ground water levels on this particular site. Our belief is that reduction in
ground water levels are very much possible with the lining of the west
branch of the Challgren Lateral ditch, the change to underground pipe for
the east branch of the Challgren Lateral ditch, as well as a significant
reduction in irrigated land. We have shown that ground water levels
measured at two different times of the year will not effect septic systems.

We would be willing to install monitoring wells, which we would use to
monitor the effects of the post development ground water levels, and curtail
irrigation of open space as dictated by these findings. We believe this
could be accomplished by the installation of a vertical perforated pipe in
any profile hole that demonstrates potential for ground water at the time
leach field investigations are being done.
In conclusion, as explained to me by Celia Greenman and our
engineer, ground water levels can be affected by many factors. Some of
these are within our control, but some are not. To date, we have shown
that ground water levels are not a factor on a majority of the sites, and
where ground water is present it is at sufficient depth as not to have affect
on septic systems. We are willing to monitor the sites and to curtail
irrigation as needed to assure the proper function of all septic systems. If

I recently received the water budget for Moriah Estates that was prepared by Wright Water
Engineers(January 18, 1999)and ,lam Scott's response to comments from the Weld County
Health Department (February 18, 1999). The Health Department memo(January 20, 1999) was
forwarded to me last month.
Thewater budget indicates that less water will enter the groundwater System post-development.
this analysis,combined with lining of the ditch, suggests that the water table will fall after
development,creating a more favorable situation for ISM. Mr. Scott's proposal to monitor the
groundwater levels to determine whether irrigation of the open space is feasible is very
reasonable, provided that the wells are monitored on a routine basis. I don't know the schedule
Ibr development, hut it would be useful to have these wells instilled as soon as possible to assess
how the spring and summer precipitation will affect the water table.
The use of ISDS still faces potential problems relating to low permeability soils and shallow
bedrock, hut the chances for success arc improved with deeper groundwater levels. Please call

Larimer-Weld Water Issues Group
The Larimer-Weld Water Issues Group was established in 1997 to discuss
and develop options to assure the future availability of adequate water
supplies for urban, agricultural and environmental uses in northern
Colorado.
Mission Statement
Preserve, for the region's use, water resources in this basin
while not adversely affecting the market value of water rights.
The basic issue is to assure that enough water is available for the future of
our region to provide the same opportunities for our children and
grandchildren that we had. In assuring our water supply, we want to achieve
two parallel goals: to maintain individual flexibility for water right owners to
manage or sell their water to pursue their own objectives, and at the same
time, to create the incentives and shared vision that will enable the region to
retain and enhance its base water supply. The shared vision we seek is one
where the application of water supplies will enhance habitat, recreational
possibilities, agricultural values and provide water for the urban and
industrial growth that will occur. If water is lost from the region, there will
be less for habitat, less for recreation, less for agriculture, less for urban
expansion and, in addition, the remaining supplies may deteriorate in
quality. For these reasons, we believe that it should be a shared regional
value to retain our base water supply while, at the same time, recognizing
and respecting individual property rights.

IN A REGIONAL COMMITTEE TO DISCUSS AND DEVELOP OPTIONS TO
ADDRESS THE ISSUE OF FUTURE WATER SUPPLIES FOR NORTHERN COLORADO;
AND APPOINTING THREE CITY REPRESENTATIVES TO THE COMMITTEE
WHEREAS,historically,the foundation of northern Colorado's vibrant economy has been
the availability of adequate water resources; and
WHEREAS,northern Colorado has enjoyed an abundant supply of high quality water,due
to the efforts of various individuals and organizations committed to sound planning and development
of the area's water resources;and
WHEREAS,the citizens of Fort Collins enjoy a unique and quality environment, due to the
availability of adequate water resources for both agricultural and urban uses;and
WHEREAS, the need for additional water supplies in the Denver metropolitan area has
proven to be a threat to the future availability of water supply in Northern Colorado to meet the
needs of both agricultural and urban uses; and
WHEREAS,citizens and government officials in Northern Colorado have expressed concern
about the urgent need to plan for the future of the area to ensure there will be adequate water supplies
to meet existing and future water needs; and
WHEREAS,the City Council,the Water Utilities Board,and City staff are concerned about
planning for future water supplies and have expressed interest in working with other government
officials, representatives from agriculture, representatives from environmental groups, and other
interested citizens to discuss and develop options to ensure the availability of adequate water
supplies in the future for urban,agricultural, and environmental uses in Northern Colorado.
NOW,THEREFORE,BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS,that:
Section I. That the City Council hereby expresses its support for the establishment of a
regional committee or group of government officials, representatives from agriculture,
representatives from environmental groups, and other citizens to discuss and develop options to
ensure the availability of adequate water supplies in the future for urban, agricultural, and
environmental uses in northern Colorado.
Section 2. That the City Council hereby appoints Councilmember Chuck Wanner, Water
Utilities Boardmember Robert Ward, and Water Utilities General Manager Michael Smith to
represent the City of Fort Collins and serve as members of any regional committee dt group
established to address water supply issues in Northern Colorado.
Passed and adopted at a regular meeting of the Council of the City of Fort Collins held this

EXPRESSING ITS SUPPORT FOR THE COUNTY'S INVOLVEMENT
IN A REGIONAL COMMITTEE TO DISCUSS AND DEVELOP OPTIONS TO
ADDRESS THE ISSUE OF FUTURE WATER SUPPLIES FOR NORTHERN COLORADO;
WHEREAS, historically, the foundation of northern Colorado's vibrant economy has

WHEREAS, northern Colorado has enjoyed an abundant supply of high quality water,
due to the efforts of various individuals and organizations committed to sound planning and
development of the area's water resources;and
WHEREAS, the citizens of Larimer County enjoy an unique and quality environment,
due to the availability of adequate water resources for both agricultural and urban uses;and
WHEREAS, the need for additional water supplies in the Denver metropolitan area has
proven to be a threat to the future availability of water supply in Northern Colorado to meet the
needs of both agricultural and urban uses;and
WHEREAS, citizens and government officials in Northern Colorado have expressed
concern about the urgent need to plan for the future of the area to ensure there will be adequate
water supplies to meet existing and future water needs;and
WHEREAS, water rights are in most cases private property, owned by individuals and
the private property rights of these water owners must be respected;and
WHEREAS, the Board of County Commissioners is concerned about planning for
future water supplies and have expressed interest in working with other government officials,
representatives from agriculture, water owners, representatives from environmental groups, and
other interested citizens to discuss and develop options to ensure the availability of adequate
water supplies in the future for urban,agricultural,and environmental uses in Northern Colorado.
NOW,THERFORE,BE IT RESOLVED,THAT:
Section 1. That the Board of County Commissioners hereby expresses its support for the
establishment of a regional committee or group of government officials, representatives from
agriculture,representatives from environmental groups,and other citizens to discuss and develop
options to assure the availability of adequate water supplies in the future for urban, agricultural,
and environmental uses in northern Colorado.
Section 2. That the Board of County Commissioners hereby appoints Commissioner
John Clarke to represent Larimer County and serve as a member of any regional committee or
group established to address water supply issues in Northern Colorado.
Section 3. Due to the severe infrastructure needs within Larimer County, and the
necessity of Larimer County to ask citizens for additional tax revenues to fund these needs,
including justice facilities and expansion to the detention center, Larimer County's particip'a'tion
in this committee shall be contingent on the efforts of the committee being implemented utilizing
existing revenue sources and notpropose a county-wide tax increase.

We, the undersigned, wish to voice our support for the proposal for Moriah Estates from Integrity
Builders. We believe this proposal should be approved as a PUD in Weld County. Some of our
considerations are noted below:
1. We believe the proposed development is compatible with the existing adjacent land
uses and zoning for Weld County and Windsor.
2. We believe the proposed development will maintain much of the rural character of
the area as compared to the future possibilities of more dense development or uses.
3. We believe the proposed development will provide a very attractive and desireable
residential component to people interested in a lifestyle of semirural America and
provide a housing alternative that is in very high demand.
4. The development will maintain the aesthetics of our viewshed to the west. This is
one of our major reasons for moving to the area.
5. We would prefer the Moriah Estates area not be annexed to Windsor because of
some of the requirements that would include; such as higher capacity roads leading
to more traffic in the area and street lights that would detract from the rural
atmosphere of the area.
6. The greenbelt areas proposed in the development plan will maintain some
productive capacity of the land and provide open space for the enjoyment and use
of the residents.
