return to the Town of Windsor Planning Department within thirty
(30) days. If comments from your office are not received within
thirty (30) , we will assume that you approve the proposal in its
current form. We do, however, appreciate a response even if you
only mark the form "no comment".
DESCRIPTION OR OTHER DETAILS: The Planning Commission will hold a
public hearing on September 18th and the Town Board on September
23rd, 1996 . Please feel free to request additional information
from either the Town or the developer in your response. If you do
not feel you can respond within the allotted time or can only
respond upon receipt of additional information, please let us know.

BEING A RESOLUTION MAKING CERTAIN FINDINGS OF FACT AND
ESTABLISHING THE TOWN OF WINDSOR'S INTENT TO ANNEX CERTAIN REAL
PROPERTY KNOWN AS THE JACOBY FARM ANNEXATION AND A
DETERMINATION OF SUBSTANTIAL COMPLIANCE WITH THE MUNICIPAL
ANNEXATION ACT OF 1965.
WHEREAS, a petition has been filed by the Union Colony Bank, Trustee, to annex to
the Town certain real property known as the Jacoby Farm West Annexation, more particularly
described within the petition which is attached hereto and incorporated herein by this reference;
and
WHEREAS, pursuant to the Municipal Annexation Act of 1965, the Town is required
to establish a date, time, and place for a public hearing on said annexation; and
WHEREAS, the Town is further required to determine that the petition for annexation
is in substantial compliance with the Municipal Annexation Act of 1965.
NOW, THEREFORE, IT IS HEREBY FOUND AND RESOLVED BY THE BOARD
OF TRUSTEES OF THE TOWN OF WINDSOR, COLORADO, AS FOLLOWS:
l 1 1. The petition for annexation has been signed by more than 50 percent of the land
owners in the proposed annexation, said land owners owning more than 50
percent of the land in the area to be annexed.
2. At least 1/6 of the boundaries of the proposed annexation are contiguous to the
boundaries of the Town of Windsor, pursuant to Section 31-12-104(1)(a),
Colorado Revised Statutes, as amended.
3. A community of interest exists between the area proposed to be annexed and the
Town of Windsor.
4. A public hearing shall be held at 7:00 P.M. on September 23, 1996, at the Town
Hall, 301 Walnut Street, Windsor, Colorado.
Upon motion duly made, seconded and carried, the foregoing Resolution was adopted this
12nd day of August, 1996.

territory, excluding public streets and alleys, described as (see attached
legal description) , containing 144.986 acres more or less, allege
the following to be true and correct:
The perimeter of the proposed annexation has a distance of 10. 026.85
_ feet, of which 1.361 .00 feet are contiguous to the existing TOWN
limits of the TOWN OP WINDSOR. A minimum of 1/6 of the perimeter of the
proposed annexation is contiguous to the TOWN or WINDSOR.
We further allege:
• 1. It is desirable and necessary that said territory be annexed to the
TOWN OP WINDSOR.

Statement of Community Need
for
Proposed Annexation and Zoning
The Jacoby Farm Annexation represents a 144.284 acre parcel of land located
immediately adjacent to the present core of the Town of Windsor, north of State
Route 392 and west of Weld County Road 15, and is bisected by the Cache La Poudre
Ditch No. 2 in the northwest corner of Windsor, Colorado. The site currently is
utilized as an irrigated farm.
The overall goal of the project is to provide a variety of high quality mixed uses for the
Town of Windsor: with land for a new neighborhood shopping center, an office park,
an apartment complex, a seniors apartment complex, condominiums, townhouses,
patio homes and a mixture of smaller (6,000 s.f.), medium (8,000 s.f.), and larger
(12,000 s.f. plus) single-family lots in a traditionally-styled development where
residences, parks, schools, jobs, and shopping are linked by a pedestrian-friendly
network of tree-lined streets and bikepaths.
The requested mixture of PD-R, MF-2. and GC/PUD will allow the careful
integration of these mixed uses as a logical extension of both the existing town and the
Brunner Farm (Old Town) planned community providing a graceful addition of
needed land uses to the Town of Windsor in keeping with its character and scale.
Following are a list of reasons which explain why the Jacoby Farm Annexation and
Master Plan could be a valuable asset for the Town of Windsor:
1. This annexation and master plan allow the Town to plan its logical growth
outward from its existing core, without leapfrogging over or around unannexed land
or straining public infrastructure and/or facilities.
2. This annexation and master plan can supply land for a variety of needed uses in
a high quality planned environment in scale with the existing community.
3. This annexation and master plan allows for a complementary mixture of needed
uses in harmony with the existing character of the Town of Windsor.
4. This annexation and master plan is designed to integrate the onsite mixed uses
logically with each other as well as with the adjacent offsite uses.
5. This annexation and master plan can provide an adequate inventory of properly
located land to support, high quality retail and commercial development for the
convenience of the present and future residents of the Town.
6. This annexation and master plan allows for high quality residential
development adjacent to existing and future schools, parks, and commercial centers.
7. This annexation and master plan conform to Windsor's Comprehensive Plan
adopted 1993.
8. This annexation and master plan will be developed to conform to Windsor's
Colorado Highway 392 Corridor Plan Design Criteria.
9. Proposed land uses recommended by the committee of citizens appointed by
the Town for the update of the Comprehensive Master Plan adopted 1993.
10. Windsor water is adjacent to this site.
11. Windsor sewer has adequate capacity and can be provided through a minor
extension of the 18" main in Weld County Road 15 south of Main Street.
12. Drainage for the project will not impact existing Windsor stormwater facilities.
All drainage on the northern portion of the site will be directed to on-site detention
facilities which will discharge water at historic rates into the No. 2 Ditch. All drainage
on the southern portion of the site will be directed to on-site detention facilities which
will discharge water at historic rates to Main Street.
13. This project will complete the annexation of Weld County Road 15 and install
full improvements to the current northern boundary of the Town.
14. View corridors developed as part of the master plan will allow views of the
mountains, and extensively landscaped public areas such as trails, parks, and school
grounds.
15. The project can be constructed in multiple phases which permits a controlled
build-out as market demand for the various uses dictate.
In conclusion, this annexation and master plan will provide a logical, careful and
harmonious addition of a variety of needed land uses in keeping with the character and
scale of the existing community.
- IMPACT STATEMENT -
JACOBY FARM ANNEXATION
The 144. 986 acre parcel involved in this annexation is located north of State
Highway 392 and west of Weld County Road 15 and is further described as
being a Part of the Southwest Quarter of Section 17 and Part of the Southeast
Quarter of Section 18, Township 6 North, Range 67 West of the 6th P.M.,
County of Weld, State of Colorado. The annexation petition has been signed by
one-hundred percent (100%) of the property owners.
• Water Service - Town of Windsor - Infrastructure to be constructed by
developer at the developer's expense.
• Sanitary Sewer Service - Town of Windsor - Infrastructure to be constructed
by developer at the developer's expense.
• Drainage Facilities - Town of Windsor - Infrastructure to be constructed by
developer at the developer's expense.
• School District - Weld County School District RE-4 (See attached Impact
Statement from Brian Lessman).
• Fire Protection - Windsor-Severance Fire Protection District.
• Police Protection - Town of Windsor Police Department.
• The Master Plan submitted with the Annexation Petition shows access to the
property from Weld County Road 15. The full width of WCR 15 will be
annexed as well as the land. No access is planned from State Highway 392.
• A copy of the affected districts is attached.
All development proposals will be required to comply with the subdivision and
site plan regulations of the Town of Windsor.

Impact Statement
Jacoby Farm Annexation
This annexation proposes 907 multi family units and 205 single
family units. Based upon current estimates this would produce a
student population on a low end of 325 students and a high end
estimate of 750 students. An average estimate for purposes of
this document is deemed to be 540 students from this development.
Current student population is distributed according to the
following:
Elementary 43%
Middle School 28%
High School 29%
Accordingly, should similar demographics apply to new
construction, district elementary schools would grow by 232
students, middle school by 150 students and high school by 155
students.
All students would attend Skyview Elementary School, once annexed
to the Town of Windsor under current boundary considerations.
Skyview has a current enrollment of 305 with a capacity of
approximately 380-400 students. New growth from this annexation
would put this building over capacity by 137-157 students.
Expansion of this facility by temporary building or new
construction would impact the district by approximately 6, 000
square feet for an estimated total of $570, 000.
Should the district determine that a new school and boundary
changes would be in order, an estimated $5. 7-7 . 0 million dollars
would be a reasonable estimate based upon current market
conditions.
Windsor Middle School is currently over capacity. All new growth
in temporary or permanent construction is estimated to be
$350, 000 - $450, 000 if in the form of additions. At some point,
given other development, the district may look at a second middle
school. The impact of a second middle school is estimated to be
$11. 5-13 . 0 million dollars.

Windsor High School has a capacity of 800 with a current
enrollment of 605. New students may be absorbed into Windsor
High School if immediate construction would occur. However,
given current student population demographics and other
developments in the community, this building could reach current
capacity within the next 3-4 years.
Should the district determine that these students would be bussed
due to distance from current elementary schools an additional 5
school busses may need to be purchased for a total cost of
$350, 000 at 100% build out. These costs would develop as new
housing starts caused the need for transportation. One bus per
70 new students at a cost of $70, 000 per bus would be the impact.
In summary, the range of impact at 100% build-out is estimated to
be in the range of $1. 37 million for additions and transportation
to current buildings to $18.3 million for new buildings and
transportation. Time associated with build-out and other
developments in the community may have an impact on student
growth as well. Certainly new schools would have the
consideration of other developments in association with this
project. However, this project is of such significance, that as
a single project, it has the potential at 100% construction to
impact thoughts for new buildings.
