RE: APPROVE CORPORATE EASEMENT TO U S WEST COMMUNICATIONS, INC., AND
AUTHORIZE CHAIR TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Corporate Easement for telephone
service to the new Weld County Jail from the County of Weld, State of Colorado, by and
through the Board of County Commissioners of Weld County, to U S West Communications,
Inc., with terms and conditions being as stated in said easement, and
WHEREAS, after review, the Board deems it advisable to approve said easement, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Corporate Easement for telephone service to the new Weld
County Jail from the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, to U S West Communications, Inc., be, and hereby is,
approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said easement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 30th day of December, A.D., 1996.

CORPORATE EASEMENT
The undersigned Grantors for and in consideration of Ten Dollars ($10.00) and other good and
valuable consideration, the receipt whereof is hereby acknowledged, do hereby grant and convey
unto U S WEST Communications, Inc., a Colorado Corporation, whose address is 1801
California St., Suite 5100, Denver, CO 80202, its successors,, assigns, lessees, licensees and
agents a perpetual easement and the right to construct, reconstruct, operate, maintain and remove
such telecommunications facilities from time to time, as said Grantee may require upon, over,
under and across the following described land which the Grantor owns or in which the Grantor
has any interest,to wit:
A tract of land 30 feet in width by 30 feet in length located in Tract "A" of the Weld County
Business Park P.U.D. located in the Northwest Quarter of Section 31, Township 6 North, Range
65 West of the 6th Principal Meridian, County of Weld, State of Colorado, said tract of land
being more particularly described as follows: Commencing at the Northwest corner of the said
Business Park; thence S89°34'39"E 475.83 feet; thence S00°25'21"W 70 feet to the Point of
Beginning; thence continuing S00°25'21"W 30 feet; thence S89°34'39"E 30 feet; thence
N00°25'21"E 30 feet; thence N89°34'39"W 30 feet to the Point of Beginning.
Grantee shall have the right of ingress and egress to and from the above described easement, the
right to clear and keep cleared all trees and obstructions as may be necessary. Grantee shall be
responsible for all damage caused to the Grantor arising from the Grantee's exercise of the rights
herein granted. The Grantor reserves the right to occupy, use and cultivate said easement for all
purposes not inconsistent with the rights herein granted. In the case where power needs to be
brought to the easement described in this document, the local power company, by this mention,
will have the right to co-exist for the sole purposes of providing power to Grantee's facilities.
The rights, conditions and provisions of this easement shall inure to the benefit of and be binding
upon the heirs, executors, administrators, successors and assigns of the respective parties hereto.
Any claim, controversy or dispute arising out of this agreement shall be settled by arbitration in
accordance with the American Arbitration Association, and judgment upon the award rendered
by the arbitrator may be entered in any court having jurisdiction thereof. The arbitration shall be
conducted in the county where the property is located.

Re: Easement for U S West Communications.
Dear Ms. Armes:
Please find enclosed two copies of the standard U S West Corporate Easement form describing
the easement which is necessary to place equipment cabinets for telephone service to the new
Weld County Jail.
If you have any questions, please call me on 970-330-2741.
If the form is satisfactory, please have one copy signed by the authorized individuals and
notarized. Please call me when the form is approved and I will pick it up at your office.
To be able to meet your requested service date of 3-1-97 to the new jail, U S West needs
approval of this easement by no later than 1-10-97 according to Sue Skaley.
