In order to provide more accurate, estimates, the answers are provided on an enterprise basis.. 1. Explain, in detail, the proposed use of the property. Old-West Catering is a rustic catering operation providing "Old West" atmosphere, food, and a meeting place for agricultural groups, civic organizations, church picnics, wedding receptions, anniversaries, etc. that promotes the rural surroundings and farm life. The catering consists of grilling and buffet style serving primarily inside and around the shop facility nicknamed the "party barn". Dances and other entertainment are occasionally included. The events are primarily dinner events on Fridays, Saturdays and Sundays. Lunches and events on weekdays are held on occasion. Anderson Farms Harvest-Fest is a celebration of the fall harvest that consists of activities for suburban and urban families. The activities provide a good time while promoting an understanding of rural life. Activities consist of hay and corn mazes, a farm animal "get acquainted" barn for petting and bottle-feeding, hay rides and a pumpkin patch. Families are also welcome to picnic and enjoy the atmosphere and views. During weekdays, a program and lesson plan has been developed for local school children to learn about animals, crops and their relationship to food and the environment. A classroom made from hay bales is set up in the "party barn" for teachers and the operators family to demonstrate farm life and activities. 2. Explain how this proposal is consistent with the intent of the Weld County Comprehensive Plan. This use is consistent with the Weld County Comprehensive plan through the preservation, enhancement and growth of agriculture. Old West Catering and Anderson Farms Harvest-Fest supplement the farms income while providing an entertaining and educational experience to their urban and suburban neighbors. Efforts to preserve productive agriculture land include the maintenance, enhancement and growth of a viable, profitable, agricultural business. The proposed site is not located within a flood hazard zone, a geologic hazard zone or airport overlay zone. The proposed use is important for Weld County to preserve the agricultural experience historically attributed to the area. 3. Explain how this proposal is consistent with the intent of the Weld County Zoning Ordinance and the zone district in which it is located. This proposal meets the intent of the agricultural zoned district where the site is located. The Anderson Farms Harvest-Fest raising pumpkins and promoting the rural atmosphere is permitted in the "A" district. The business aspect of Anderson Farms Harvest-Fest and Old West Catering may be permitted as a Use-by-Special-Review. Public health safety and welfare are protected through adherence to applicable county, state and federal regulations and requirements. 4. What type i3f uses surround the site? Explain how the proposed use is consistent and compatible with surrounding land uses. Agricultural uses surround this site. Uses consist of farmland and some cattle feeding and ranching operations. This proposal is compatible with the surrounding agricultural uses and the Weld County Comprehensive Plan. There are three (2) residential homes located within 500 feet of the property boundary. There are no residential homes located within 500 feet of"Party Barn" where the catering and most of the Harvest-Fest activities occur. Agriculture production has existed on this property since the site was homesteaded. 5. Describe, in detail, the following: a. How many people will use this site? Old-West Caterir_ag will be operated throughout the year, with the majority of events occurring Friday through Sunday of the week. The number of guests present at any one event is estimated to range from 50 to 400 people, with the majority of eve its averaging 100 people. Anderson Farms Harvest-Fest-The total number of people on the premise will vary during the week, with the greatest numbers anticipated during weekends. During peak periods, it is anticipated that as many as 400 people (adults and children) will be on the premise at any one given time. b. How many employees are proposed to be employed at this site? Old-West Catering is a family operated business. Only on rare occasions that an event exceeds 300 guests will additional people be hired on a contract basis. Typically, volunteers from the participating organizations assist operations. Anderson Farms Harvest-Fest will employ as many as three (3) people to assist with this enterprise during weekend operations. As a seasonal operation, this would involve hiring part-time employees c. What are the hours of operation? Old-West Catering will generally be operated during the afternoon and evening hours, with occasional events scheduled over the noon hour. All activities will conclude by 11:00 p.m. Anderson Farms Harvest-Fest will operate from 9:00 a.m. until 9:00 p.m. d. What type and how many structures will be erected (built) on this site? Existing structures (farm shop, barn, and outbuildings) are utilized for operation of all enterprises. An extension to the existing shop may be required in the future to augment existing seating capacity for on-site events. This extension will be in the form of a 30' X 40' cement pad, covered with a roof. The extension will be open-sided, and used primarily for a seating area for larger catered events or as a luncheon area for visiting school groups. In addition, a commercial kitchen will be built within the confines of the existing farm shop for the purpose of food preparation. e. What type and how many animals, if any, will be on this site? Any and all animals associated with a "typical" farming operation may be present at the site. This will include such animals as (cattle, horses, sheep, goats, pigs, poultry, rabbits, ducks, etc). The number of farm animals present at the site will not exceed that permitted as a "use by right". f. What vehicles (type/size/weight) will access this site & how often? Passenger vehicles (cars, mini-vans, pick-up trucks, SUVs) will be the primary vehicles accessing the site. On occasion, tour buses—those associated with bringing larger groups for catered events —will also access the site. During the week day operation of"Anderson Farms Harvest-Fest", school buses are also anticipated. g. Who will provide fire protection to the site? The facility is located within the Mountain View Fire District. h. What is the water source on the property (both domestic & irrigation) All domestic water is provided by the Left Hand Water District. A"will serve" letter is included in this application. Water used for irrigation purposes is delivered via the Boulder-Weld ditch. I. Describe the sewage disposal system (existing & proposed) on premise. The existing sewage disposal system (septic) will be modified to meet required standards to handle the waste associated with operation of a commercial kitchen, and that associated with use of the existing bathroom facilities by 200 guests. The system will be designed and certified by a registered professional engineer and permitted with the Weld County Health Department. For those infrequent catered events that exceed this 200 person threshold, additional waste disposal— in the form of portable toilets—will be utilized. During operation of"Anderson Farms Harvest-Fest"sufficient portable toilets will be provided to accommodate the maximum number of anticipated people at the site (400), in addition to that provided in the farm shop. J. If storage or warehousing is proposed, what type of items are stored? Food storage and dry goods (paper products, napkins, etc) utilized for catering purposes are stored in the shop/kitchen. 6. Explain the proposed landscaping for the site. The landscaping shall be separately submitted as a landscape plan map as part of the application submittal. No landscaping is proposed for the site 7. Explain and proposed reclamation procedures when termination of the Use by Special Review activity occurs. No reclamation procedures are necessary to reclaim the site upon termination of the Use by Special Review activities. 8. Explain how the storm water drainage will be handled on the site. No major structural or land forming construction is necessary for the Use by Special Review. No additional provisions for stormwater drainage are planned. 9. Explain how long it will take to construct this site and when construction and landscaping is scheduled to begin. No major constriction or landscaping are planned for the site. Operations will continue upon finalizing the Special Use permits 10. Explain whore storage and/or stockpile of wastes will occur on the site. No storage or stockpiling of wastes will occur on the site. Refuse will be stored in covered dumpsters and removed routinely by a contracted refuse company. RIGHT TO FARM COVENANT Weld County is one of the most productive agricultural counties in the United States. The rural areas of Weld County may be open and spacious,but they are intensively used for agriculture. Persons moving into a rural area must recognize there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts, including noise from tractors and equipment; dust from animal pens, field work, harvest, and gravel roads; cdor from animal confinement, silage, and manure; smoke from ditch burning; flies and mosquitoes; the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved"out of the way"of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Weld County covers a land area of over 4,000 square miles in size(twice the State of Delaware)with more than 3,700 miles of state and county roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads,no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases,will not be equivalent to municipal services. Children are expcsed to different hazards in the county than in an urban or suburban setting. Farm equipment and oilfield equipment,ponds and irrigation ditches,electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children.
