HomeMy WebLinkAbout990927.tiff Coy;;:T Y WELD COUNTY COUNCIL March 16, 1999 I ` 1�` `!O Tapes 126AB99 & 127AB99 Oi P' C''' l J The Weld County Council met in regular session in full conformity with the Weld County Home Rule Charter at Weld Centennial Center, 915 10th Street, Greeley, CO, Tuesday, March 16, 1999, 6:30 p.m. ROLL CALL: The meeting was called to order by President Dan Oster. Vice President Al Roberts, Councilman Dwaine Kurtz, Councilman Rob Masden and Councilwoman Joyce Smock were present, constituting a quorum of the members. Also present: Council secretary 13ev Thomas. APPROVAL OF MINUTES: Councilman Roberts made a motion to approve the March 1, 1999 Council minutes as written. Councilman Dwaine Kurtz seconded the motion and it carried. CORRESPONDENCE: Vice President Al Roberts reported he had received the Commissioners' Resolution canceling violation hearings scheduled for March 9. He reported information received from County Assistant Attorney Lee Morrison regarding Midtown Materials.. The trailer from which Midtown Materials had been operating within Weld County's MUD has been removed. There are still materials on the site, but no business is being conducted from that location. COORDINATOR REPORTS: Weld County Sand and Gravel Deposits The Council discussed letters from Weld citizen John Folsom regarding sand and gravel deposits in Weld County. President Oster had discussed this matter with Commissioner Vaad. Commissioner Vaad reported that the Weld County Planning Commission forwards development applications to the State of Colorado to verify that the necessary procedures regarding minerals have been met before the Weld County Commission acts on the applications. Paunch Odor in Briggsdale Area President Oster reported that he received a telephone call from Weld citizen Judy Curtis regarding paunch odor in the Briggsdale area. President Oster brought the matter to the attention of the Commissioners and Commissioner Baxter assured Mr. Oster that he would return Ms. Curtis' phone call. Intergovernmental Agreements for School Funding Councilman Dwaine Kurtz addressed a March 1 letter received from Weld citizen John Folsom. Mr. Kurtz stated that the Colorado Supreme Court has ruled that l V �ir°I 990927 Weld County Council Minutes March 16. 1999 Page 2 of 4 governments, through intergovernmental agreements, cannot demand or "require" school funding of developers as per Mr. Folsom's letter. Councilman Dwaine Kurtz reported, however, that mutual agreements for school funding have been worked out between governments and developers. Election Department Report Vice President Al Roberts reported that Weld County personnel still have not received updated information from the State of Colorado regarding election rules. Human Services Councilman Dwaine Kurtz summarized for the Council the content of his informational meeting with Division of Human Services Director Walt Speckman. Mr. Kurtz reviewed Human Services' organizational and structure charts and provided details about employment services as well as services for the aging and for families. Intersection at US Highway 34 and Weld County Road 57 President Dan Oster reported on his ongoing involvement with the Colorado Department of Transportation regarding US Highway 34 and Weld County Road 57. He is trying to facilitate communication between the Colorado Department of Transportation and the citizens affected by the alterations to the intersection. UNFINISHED BUSINESS: 1999 Council Meeting Locations Councilman Dwaine Kurtz has finalized arrangements for the April Council meeting to be held at the Johnstown Town Hall. Councilman Masden reported that Don Sandoval, Regional Director for Department of Local Affairs, will speak at the Council's May meeting in Greeley. Councilman Roberts will check with parliamentarian Art Willis about doing a work session with the Council on June 1 regarding parliamentary issues. Councilman Rob Masden is planning the June 15 Council meeting to be in Ft. Lupton or Lochbuie. President Dan Oster will ask Weld County Finance Director Don Warden to make a presentation at the July 20 Council meeting in Greeley. Councilman Dwaine Kurtz will check about a Human Resources speaker for the September Council meeting in Greeley. Out-of-Greeley Meeting Invitations/Dinners The Council will be meeting out of Greeley four times in 1999. The town council of the host town will be invited to the Council meeting. The town council members will also be invited to join, at their own expense, a dinner with the County Council before the meeting. Council members will provide the Council secretary with a list of locations where information about the out-of-Greeley Council meetings should be posted. Weld County Council Minutes March 16, 1999 Page 3 of 4 Distribution of Unapproved Council Minutes Councilman Roberts made a motion, seconded by Councilman Masden, that the Council's unapproved minutes be sent only to the Weld County Attorney and the five County Council members and that no copies of unapproved minutes will be posted on bulletin boards. Councilman Kurtz made a motion to amend the motion to include that a copy of unapproved minutes will be sent to the Commissioners via their secretary. Councilman Masden seconded the motion. The amendment to the motion carried with Councilman Roberts and Councilwoman Smock voting no. The amended motion carried unanimously. Policy for Supplying Council Documents to the Public Councilwoman Joyce Smock made a motion that the Weld County Council follow the Commissioners' Ordinance 84T regarding distributing documents to the public. The Council secretary is to notify the persons currently receiving the Council's approved minutes of this County policy. Councilman Roberts seconded the motion and it carried. Evaluation of Council's Appointment Process President Oster tabled the idea of evaluating the Council's appointment process until after Mr. Don Sandoval speaks to the Council. Evaluation of Council's Website Entry The Council decided not to make alterations to the Council's website entry at this time. NEW BUSINESS: Procedures RE: Conflict of Interest Questions County Attorney Bruce Barker is preparing the conflict-of-interest information (that he shared with the Council on March 1) into a format that could be adopted into the Weld County Council's Rules and Regulations. Procedures RE: Council's Appointment Process President Oster said that an addition to the Council's Rules and Regulations regarding the Council's appointment process would be considered after Mr. Don Sandoval speaks to the Council. Payment of the Bills Councilman Dwaine Kurtz made a motion to approve payment of the following bills: Mileage for President Dan Oster $ 71.28 Mileage for Vice President Al Roberts $67.88 Mileage for Rob Masden $30.24 Mileage for Joyce Smock $32.40 Mileage for Judy Curtis $23.22 Weld County Council Minutes March 16, 1999 Page 4 of 4 Subscription to Farmer& Miner $24.00 Councilwoman Joyce Smock seconded the motion and it carried.
