As you are aware,our Department has withheld our referral concerning this land use application, for
a poultry husbandry and processing facility, in order to obtain a referral or a response from the
United States Department of Agriculture. After several weeks of attempting to obtain a response
from the United States Department of Agriculture, I spoke with Dr. Hansen of the USDA. As you
know, our primary concern with this application is that Mr. Waddell is proposing to provide water
for the operation from a cistern. Dr. Hansen indicated that they have concerns with the use of a
cistern as a water supply,however, there are no Federal rules that prohibit them. Section 24.5.1.1
of the Weld County Zoning Ordinance requires that the facility have "Adequate water service in
terms of quality, quantity, and dependability..." It is our opinion that a cistern does not provide an
adequate quantity of water,nor is it dependable. As a result, we do not consider a cistern to provide
"adequate water service" and encourage your Department to recommend for denial of this proposal.
A continuous supply of water to facilities of this nature is one of the basic methods to prevent
disease. Some of our concerns are as follows:
The lack of a continuous supply of water may result in conservation of water during cleaning
cycles, etc. that results in poor cleaning practices.
The water has a greater chance of being contaminated due to the multiple handlings during the
transportation process.
Water may not be available during periods of inclement weather, i.e. snowy roads.
Because there is a finite amount of water on-hand at the facility,the operation has the potential
to run out of water during a processing event. This could result in equipment being unsanitized
for long periods of time, etc.
However,in the event this application is approved we recommend that the following conditions be
a part of any approval.
We recommend the following to be conditions of approval:
1. The applicant shall obtain a permit for the use of the cistern from the Weld County Department

of Public Health and Environment. At a minimum, the cistern must meet the following
minimum criteria:
a) The cistern must be constructed of stainless steel.
b) The cistern must be equipped with a automatic chlorination device with an alarm that will
sound in the event that it malfunctions.
c) The cistern must be equipped with a low water level alarm to alert the operator that only a
minimal amount of water remains.
2. In accordance with the Weld County ISDS Regulations,the septic system proposed to serve the
poultry processing facility shall be designed by a registered professional engineer. In the event
the design hydraulic flow of the proposed septic system exceeds 3,000 gallons per day
(according to the Weld County ISDS Regulations), the applicant must receive approval from
the Colorado Department of Public Health and Environment in accordance with the Regulations
for the Site Application Process ( 5 CCR 1002-22).
3. The applicant shall submit a manure and wastewater runoff handling plan for review and
approval to the Weld County Department of Public Health and Environment. The plan shall
describe how manure that is generated on the property will be disposed, and describe how
stormwater that comes into contact with manure on the property will be managed. The applicant
should consider the Best Management Practices as described in the Confined Animal Feeding
Operation Control Regulations(5 CCR 1002-81). The plan should also describe how dead birds
will be disposed.
4. The applicant shall provide evidence that the facility is in compliance with the rules and
regulations of the Colorado Department of Agriculture and the United States Department of
Agriculture.
The following are recommended to be development standards:
1. Fugitive dust shall be controlled on this site. In the event that nuisance dust conditions are
created by the facility, at the request of the Weld County Department of Public Health and
Environment, a dust control plan must be submitted and adhered to.
2. All liquid and solid waste shall be stored and removed for final disposal in a manner that
protects against surface and groundwater contamination.
T."There shall be no permanent disposal of solid wastes, as defined in the Regulations Pertaining
to Solid Waste Disposal Sites and Facilities (6 CCR 1007-2), at this site.

4/. The facility shall maintain compliance with Confined Animal Feeding Operations
Control Regulations (5 CCR 1002-19)and, Section 47 of the Weld County Zoning Ordinance,
as amended.

-5. The maximum permissible noise level shall not exceed the light industrial limit of 70 db(A),
measured according to Section 25-12-102, C.R.S.
. Any required NPDES Permit shall be maintained in compliance with the Water Quality
Control Division of the Colorado Department of Public Health& Environment.
7, All construction on the property shall be in accordance with the requirements of the Weld
County Building Code Ordinance, as amended.
81 The facility shall not discharge run-off or other waste waters to surface or groundwater with
exception to what is allowed by the Confined Animal Feeding Operations Control Regulations.
9 Wastes materials, not specifically addressed by other development standards, shall be
handled, stored, and disposed in a manner that controls fugitive dust, blowing debris,
and other potential nuisance conditions.
10. The applicant shall remove,handle, and stockpile manure from the poultry in a manner that will
prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a
condition that facilitates excessive odors, flies, insect pests, or pollutant runoff. The surface
beneath the manure storage areas shall be of materials which are protective of State waters.
These areas shall be constructed to minimize seepage or percolation of manure contaminated
water. In no event shall the facility impact or degrade waters of the State in violation of the
Confined Animal Feeding Operations Control Regulation (5 CCR 1002-19).
11. The facility shall be operated in a manner which controls odor. Odors detected off site shall not
equal or exceed the level of fifteen-to-one dilution threshold, as measured pursuant to
Regulation 2 of the Colorado Air Pollution Control Regulations. In the event that odors
conditions are in excess of what is allowed by this condition, an odor control plan must be
submitted and adhered to.
,12. The facility shall be operated in a manner to control flies. Additional fly control measures shall
be implemented at the request of the Weld County Department of Public Health and
Environment in the event that flies (which can be determined to be associated with the facility)
are in such a number to be considered a nuisance condition. Additional measure shall also be
implemented in the event the Weld County Department or Public Health and Environment
receives a significant number of fly(associated with facility) complaints, and in the judgement
of the Weld County Health Officer, there exists a fly condition requiring abatement.
13. Any septic system located on the property must comply with all provisions of the Weld County
Individual Sewage Disposal System Regulations.
14. There shall be no burning conducted at the site, with exception to burning defined as
"agricultural open burning" as defined by Regulation No. 1 of the Colorado Air Quality Control

Commission Regulations.
.15. The applicant shall comply with Weld County Ordinance No. 172 pertaining to cisterns.
16. The facility shall comply with the approved manure and wastewater runoff handling plan.
17. Water obtained to fill the cistern shall be obtained from a"community water system" as defined
by the Colorado Primary Drinking Water Regulations or an alternative source as approved by
the Weld County Department of Public Health and Environment. The operator shall maintain
3 years worth of records that describes where the water was obtained to fill the cistern. The
water shall be transported from the "community water system" in a clean vessel and transferred
to and from the vessel in a manner that does not compromise the quality of the water.
18. The facility shall comply with all applicable rules and regulations of the Colorado Department
of Agriculture and the United States Department of Agriculture.
19. In the event that a more reliable source of water, i.e. community supply or well, becomes
available, the facility shall abandon the cistern and obtain water service from that source.

As you are aware, our Department has withheld our referral concerning this land use application in
order to obtain a referral or a response from the United States Department of Agriculture. Due to
the proposed size of this operation,this facility must be inspected by the USDA. After several weeks
of attempting to obtain a response from the United States Department of Agriculture, today I
received a phone mail message from Dr. Hansen of the USDA. Dr. Hansen indicated that they have
concerns with the use of a cistern as a water supply,however,there are no Federal rules that prohibit
them. As you know, our primary concern with this application is that Mr. Waddell is proposing to
provide water for the operation from a cistern. We do not consider a cistern to be a reliable water
supply.
We recommend that you request a continuance at the Planning Commission hearing scheduled for
September 21, 1999. We will provide you our recommendation in the next couple of days.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Weld County Use by Special Review Standards. Our comments and requirements are as follows:
COMMENTS:
WCR 100 is designated on the Transportation Plan Map as a local gravel road which requires 60 feet of right-of-
way at full build out. There is presently 60 feet of right-of-way. This road is maintained by Weld County. Pursuant
to the definition of SETBACK in the Weld County Zoning Ordinance (Ordinance 89, as amended), the required
setback is measured from the future right-of-way line.
There is an existing single access to the facility. This access point and circulation pattern appear to be adequate
for the facility. The applicant is identifying additional parking to accommodate customers and employees.
I am referring the storm water drainage to the Weld County Health Department as it is related to chicken and turkey
processing and the open pen areas may fall under the 25-year, 24-hour rainfall retention facilities.
REQUIREMENTS:
During my site investigation, I noted three stick built homes being stored on the property directly east of the existing
residence. If these homes are to remain on the property, the applicant shall identify a circulation pattern to
accommodate access and parking to be approved by Weld County Public Works Department. If they are to be
removed, please contact Don Somer, 356-4000, extension 3750, regarding the permit process.
