Greeley,Colo. ,Wednesday,May 15th. 1901. The Board of County Commissioners of Weld County,Colorado,met at 9: 00 o'clock A.M.pursuant to adjournment of the 14th.inst. Present:- Hon. S.R.Huffsmith, Chairman, H.J.Parish, Commissioner, " C.H.Rea, Sharon Atkinson, Clerk, By J.B.Phillips , Deputy. IN THE MATTER OF PETITIONS FOR REBATE OF TAXES. The Board then resumed the consideration of petitions for rebate of taxes and the following petitions praying for the cor- rection and abatement of certain assessments and taxes coming on for consider- ation and after carefully investigating the claims of each petitioner at,u fully advised in the premises,the Board on motion ordered that action be taken upon each petition,as follows,to-wit:- Stanley Davis, Granted a rebate of taxes for the Year 1900 on the S. * N.E.4,Lots 1 to 4 N.E.. S.E.4,Lots 1 to 4 _ N.W.4 S.E.4 and S. # N.W.4 of Sec. 15 Tp. 5 N.R.65 W. on a valuation of $480.00. John E.Painter, Granted a rebate of taxes for the year 1900 on hie Lost Creek Ranch on a valuation of $480.00. J.H. Dickson, Granted a rebate of taxes for the year 1900 on Sec. 1Q Tp. 2 N.R.67 W. on a valuation of $1650.00. E.E.Byron, Granted a rebate of taxes for the year 1900 on Personal Property valued at $1900.00 and Military and County Poll tax for 1900. W.M.Darling, Granted a' rebate of,taxes s for 'the year. 1900-on_Lot 5lpart Lot 6 Bloak 67 Greeley and Improvements on a valuation of $310.00. Henry S.Wilson, Granted a rebate of Military and County Poll tax for the year 1900. F.N.Briggs , Granted a rebate of taxes for the year 1899 on moneys and credits on a valuation of $7600.00. J.W. Smillie, Granted a rebate of taxes for the year 1900 on 90 acres in the N.W.4 Sec. 28 Tp.7 N.R.66 W. on a valuation of 3125.00. The following petitions for rebate of taxes were carefully considered and on motion ordered disallowed,via:- Elate N. Davis, S.R.Hunter, Lulu Burr. 2' I Proceedings of the Board of County Commissioners.__ clay Term, 1 _ 1_ County Tre-asurer' s report for the month of April was presented,examined on motion audited and ordered placed on file. The bond of Thompson Bros in the penal sun of $1000.00 for the faithful performance of their contract as County printers was presented,examined and the sureties thereon being considered ample and sufficient,it was on motion ordered that the same be approved and placed on file. / ' IN THE MATTER OF PETITION OF E.E. BYRON. Now on .this day comes E.E. Byron,by F.A.Meredith this ageht,and presents his petition setting forth that he is the owner orrthe S. * S.W.4 of Sec. 17 Tp. 1 N.R.66 W. ;that the Union Pacific Railroad runs through said land thereby taking about 7 or 8 acres for its right of way,which is not taxable;that in 1896 he listed said land for taxation,less the 8 acres for said right of way; ' that in 1897 the County Treasurer,for some unknown reason,assessed said 8 acres as additional and the taxes not having been paid thereon the said Treasurer sold the same to Weld County for the taxes of 1896; that said sale is a cloud upon the title to his land and by reason of it being erro- neous he prays that said sale be redeemed without expense to him. After investigating the matter and being fully advised in the premises the Board,on motion,ordered that the prayer of the petitioner be and is hereby granted. The proceedings of the Board held April 27th.May 6th;7th06th,9thIllth,13th014th,and 15th. 1901 were read and on motion duly approved. IN THE MATTER OF ,PETITION OF GEORGE L. SHEPARD. Now on this day the Board having underconsider- ation the petition of George L. Shepard setting forth that the taxes assessed against him for the years 1893 to 1899 ,inclusive,on omitted moneys,and credits are erroneous,as will more fully appear in his said petition,and prays that said assessments _and taxes may be corrected in accordance with the facts in the case; that he is ready and willing to pay ail taxes justly due - from him On said property. After carefully considering the matter,it was on motion ordered that the prayer of the petitioner be and is hereby granted and the County Treasurer be and he is hereby authorized to accept the sum of $25.00 from said petitioner in full settlement of all taxes assessed against him on moneys and credits for the year 1899 and prior years. IN THE MATTER OF PETITION OF HENRY C.LUTHER. itow on this day the Board having under re-con- sideration the petition of Henry C.Luther praying for a rebate of taxes assessed against him for the year 1900 on certain real estate and personal property,the same having been heretofore disallowed on April 27th. 1901,and being in possession of additional facts in tae matter and believing that he is entitled to _a rebate;on motion ordered that the action of. the Board taken on said petition on April 27th. 1901 be and the same is hereby rescinded and held for naught and the prayer of the petitioner be and is hereby granted and that he ne allowed a rebate of said taxes on a valuation of $300.00. 1' ", c IN THE MATTER OF PETITION FOR ROAD IN TP.5 N.R.67 W. A special meeting of the Board of County Commissioners of Weld County ,Colorado was held at 8: 00 o'clock A.M.pursuant to call by the Chairman. P resent:- Hon. The Board reconsidered its action taken on May llth.1901 in declining to make further recommendations for Water Commissioner of District No.4 and on motion of Commissioner Rea and duly seconded by Commissioner Parish it was ordered that the resolution passed and adopted on the said 11th. day of May} relative to the Board refusing to make further recom- mendations for Water Commissioner within and for District No.4,be and the same is hereby rescinded and held for naught. IN THE MATTER OF COUNTY PHYSICIAN. The contract with Dr. C.H. CalliCounty Physician, having expired,applications were received and read from Dr.Ernest Wi11s,Dr. C.H. Ca1) and Dr. T. C. Gibson for appointment to the position of county physician for the ensuin,; year. On motion a vote was taken,which resulted in the unanimous selection of Dr.Ernest Wills for county physician,whereupon he was duly appointed to saidposition for the period of one year from July lst. 1901. S.Junge,Justice of the Peace of Precinct No.l ,owing to the death of one of his bondsmen the same was not approved and the Clerk was directed to notify him to file a new bond within ten days from date ,otherwise his office would be declared vacant. I Mayor H:C.Watson came before the Board and stated that the City of Greeley and the property owners on 9th.Ave. from 8th.to 13th. streets propose to grade said avenue and put on cement gravel so as to make it a first class thoroughfare and asked the Board to appro- priate the sum of V75.00 as Weld County' s proportion of the expense. After due consideration it was ,on motion,ordered that his request be granted and that the said sum of 075.00 be and the same is hereby appropriated for that purpose. Davidson of Platteville came before the Board and stated that Lots 1 to 12,30 & 31 Block 3 and Lots 1,2 & 3 Block. 17 in the Town of Platteville were sold. to Weld County on Dec. 1301898 for the taxes of 1897; that said Weld County has paid subsequent taxes thereon and said lots still remain unredeemed and are of very little value and not worth the cost of redemption if the regular interest and penalties are charged. He desires to redeem said lots from said tax sale provided satisfactory terms could be agreed upon and offered to pay the sum of $46.14 for a redemption certificate for said lots. Said amount being the actual cost to the county without interest or penalties and includes the 1900 taxes thereon. After due consideration ,it was on motion ordered that his offer be and the same is hereby accepted and the County Treasurer is hereby authorized to issue proper certificates of redemption therefor upon payment of said sum of $46.14.
