Box 758 Greeley, CO 80632 RE: Objection to Notice of Denial -Petition to Review TO WHOM IT MAY CONCERN: The following explains why we disagree with the Assessor's valuation and feel it is entirely unfair. We are located in the Cottonwood Creek Condo/Patio Home area between 19th Street and 28th Avenue extending to 20th Street. We are in a patio home on the west side located at 1928 29th Avenue. There are three private circle streets off 29th Avenue containing the patio homes. Basically, they are all the same construction and design having only a small difference in footage. Main differences in the residences are solar heating systems, two gas fireplaces and the inside improvements made by owners and some have a third floor loft or room. The unit next to ours (1926 29th Avenue) has 1342 sq.ft., a completely finished basement yet the new valuation on this is only $93,822.00. Since 1989, the taxes on this unit have been approximately $617.00 while our have been approximately $890.00- this equals a hugh difference over the many years for the same property. The unit at 1922 29th Avenue has 1508 sq. ft. and yet is valued at only $94,495.00 The unit at 1904 29th Avenue has 1354 sq. ft. and is valued at $105,555.00 The unit at 1902 29th Avenue is valued at $99,032.00 The unit at 1934 29th Avenue with 1861 sq. ft. is valued at $86,671.00. The unit at 1948 29th Avenue has 1740 sq.ft. and it is only valued at $82,000.00. Page two - Walker, William V. Sr. and Ann L. Walker The above are all patio homes. We do not feel our unit is marketable at $111,093.00. We anticipated an increase to maybe $96,000.00 - $98,000.00 at an extreme but do not agree with your valuation. As you can readily see by comparison of patio homes right next to each other, there is no uniformity in the valuations placed on them. This hearing will be held at the Weld County Centennial Center, 915 10th Street, Greeley, Colorado, in the First Floor Hearing Room. A number of hearings have been scheduled at this time; peitioners will be asked to sign in with the Clerk upon arrival, and cases will be heard on a first come / first heard basis. You have a right to attend this hearing and present evidence to the Board in support of your petition. The Weld County Assessor or his representative will be present. The Board will make its decision on the basis of the record made at said hearing, as well as your petition, so it would be in your interest to have a representative present. If you plan to be represented by an agent or an attorney at your hearing, prior to the hearing you shall provide, in writing to the Clerk to the Board's Office, an authorization for the agent or attorney to represent you. If you do not choose to attend this hearing, a decision will still be made by the Board by the close of business on August 5, 1997, and mailed to you on or before August 10, 1997. Because of the volume of cases before the Board of Equalization, all cases shall be limited to 15 minutes, of which you will be allowed 10 minutes for your presentation. Also due to volume, cases cannot be rescheduled. It is imperative that you provide evidence to support your position. This may include evidence that similar homes in your area are valued less than yours or you are being assessed on improvements you do not have. Please note: The fact that your valuation has increased cannot be your sole basis of appeal. Without documented evidence as indicated above, the Board will have no choice but to deny your appeal.
